Sec. 8-180. - Definitions.

As used in this article and throughout this Code, the following terms shall mean as indicated below:

Manufactured home means a structure transportable in one or more sections, which, in the traveling mode, is eight body feet or more in width by 40 body feet or more in length, or, when erected on site, is 320 or more square feet, and which is built on a permanent chassis and foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein; except that such term shall include any structure which meets all the requirements of this paragraph. Manufactured homes generally come in single- or two-section units. Excluded are travel trailers, motor homes, and modular housing.

Mobile home means a structure, transportable in one or more sections, which, in the traveling mode, is eight body feet or more in width by 40 body feet or more in length or, when erected on site, is 320 or more square feet and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities and includes the plumbing, heating, air conditioning, and electrical systems contained therein manufactured prior to June 15, 1974.

Modular home means it is built to about 80 to 90 percent completion in a factory before transportation to a property. The home arrives at the job site in multiple pieces, and a licensed operator sets each piece in its place on the foundation. Once it is completed, a prefabricated modular home looks indistinguishable from a traditionally built home.

Sec. 8-181. - Regulations for manufactured homes.

(a)

Mobile homes (built before 1974) are not allowed within the town limits of Albany. Manufactured homes are permitted only within existing approved mobile home parks. An application to replace an existing mobile home or manufactured home is available through the town clerk if owner meets all of the requirements in article VIII.

(b)

All manufactured homes must meet the manufacturing standards established by the 1994 requirements by HUD and the Louisiana Manufactured Housing Commission as per R.S. Title 51, Trade and Commerce.

(c)

The siding of the manufactured home shall be painted metal, vinyl, Masonite, wood or other compatible-looking material meeting HUD and the Louisiana Manufactured Housing Commission as per R.S. Title 51, Trade and Commerce. This outside appearance shall be maintained during the term of the mobile home's stay in the town.

(d)

The roof shall have a roof pitch as required by HUD and the Louisiana Manufactured Housing Commission as per R.S. Title 51, Trade and Commerce, and shall have a surface of wood shakes, asphalt composition, wood shingles, fiberglass, or metal.

(e)

Manufactured homes can be located in an approved mobile home park within the town limits.

(f)

No mobile home or manufactured home can be located in a named subdivision. (See subdivision ordinance.)

(g)

No mobile home or manufactured home can be located in commercial zone (C-1).

(h)

No manufactured home can occupy the same lot as an existing residence. The minimum lot size of 80 feet wide by 120 feet long or a lot size equal to 9,600 square feet or larger is required. The lot sizes are the same as for a residential home. (See subdivision ordinance.)

(i)

The size of a manufactured home is restricted to a minimum size of 12 feet wide by 65 feet in length.

(j)

A manufactured home cannot be over five years old at time of installation.

(k)

A mobile home or manufactured home in the town limits must be occupied by the owner of the property or a member of his immediate family; immediate family shall be construed to be a son, daughter or parent.

(l)

When a manufactured home or mobile home becomes vacant, damaged or uninhabitable it must be removed from the property within 30 days.

(m)

Mobile home or manufactured home cannot be installed or used for the purpose of rental property unless located in an approved mobile home park.

(n)

An application to replace an existing mobile home or manufactured home is available through the town clerk if owner meets all of the requirements in article VIII.

Sec. 8-182. - Permits for a manufactured home.

(a)

Both the manufactured home owner and the mover must get a permit before the manufactured home can be moved into, out of or within the Town of Albany, excluding only major arterial roads for the purpose of simply crossing through the town. The permits must be obtained at least two business days before the manufactured home arrives in the town limits and shall be good for 30 calendar days.

(b)

The manufactured home mover must furnish a copy of the title or registration with proof of age and the VIN number of the manufactured home, and proof of his license that is approved by the Louisiana Manufactured Housing Commission, and proof of insurance and/or a surety bond, and a deposit will be required before the permit is granted.

(c)

The manufactured home mover shall have the permit and a copy of the title or registration with proof of age and the VIN number of the manufactured home and shall have it with him at all times while the move is in progress within the town.

(d)

Superintendent of water, sewer and streets to identify locations of water, sewer, tie-ends and sizing of culverts. (Each resident will have its own water meter.)

(e)

Setback lines. Front setback lines will be no less than 25 feet from servitude, side yards minimum is ten feet, back setback ten-foot minimum. Plot plan stamped by licensed engineer or surveyor is required to approve placement of manufactured home.

(f)

Property must have a flood determination in the form of a preliminary elevation certificate stamped by a licensed engineer or surveyor.

(g)

Travel trailers and/or motor homes are prohibited to be placed on a lot and used as a dwelling or occasional use.

(h)

Permit fees shall be assessed to the owner and the mover for any manufactured home moving into or within the town. Permit fee shall be $500.00.

Sec. 8-183. - Installation.

(a)

Installation, setup, anchoring, etc. shall be according to HUD standards and the Louisiana Manufactured Housing Commission as per R.S. Title 51, Trade and Commerce, 912.21—912.53.

(b)

The Louisiana Manufactured Housing Commission sticker shall be on the manufactured home at installation time.

(c)

The manufactured home shall have steps at the front door and steps at the rear door for safety purposes. Steps must meet FHA and VA federal guidelines (concrete).

(d)

Skirting shall be required around the total perimeter of the manufactured home including decks/porches and landings and shall be maintained. The type of skirting shall be approved for manufactured home use. Skirting required and in place at final inspection.

(e)

The manufactured home owner shall have 30 days to comply with subsection (d) above after inspection of the setup, anchors, water, gas, sewer and electricity is energized and the home is ready to inhabit.

(f)

All manufactured homes already in Albany shall have 90 days to comply with subsection (d) above after enactment of this article.

(g)

Electrical power to the manufactured home will not be energized until the inspection is complete and approved.

(h)

The manufactured home cannot be inhabited until the inspection is done and approved and the electricity is energized.

(i)

Concrete runners for manufactured home must equal length of manufactured home runner width, a minimum of 24 inches.

(j)

Anchors, tie downs must meet FHA and VA codes and federal guidelines.

Sec. 8-184. - Violations—Penalties.

If the manufactured home owner and/or the mover violate this article in any way, the town shall have the authority to cite, fine, incarcerate or seek any and all injunctive relief and damages to compel the owner and mover to remove the manufactured home from the town at their expense. Further, each violation of this article shall constitute a separate offense, and subject to a $25.00 per day fine. Otherwise this article shall be punishable to fullest extent of the jurisdiction of the Town of Albany.

Sec. 8-185. - Residential modular homes.

(a)

Does not include manufactured homes.

(b)

A prefabricated structure of conventional construction used for dwelling purposes moved onto a site in essentially complete constructed condition, in one or more parts and when completed is a single family unit on a permanent foundation.

(c)

Must be at least 1,200-square-foot living area.

(d)

Must be off frame—no metal or steel frames.

(e)

The pitch of the roof shall be no less than five feet rise for every 12 feet of run, for homes with a single predominant roofline.

(f)

The eave projections of the roof shall not be less than ten inches (excluding roof gutters) unless the roof pitch is 8/12 or greater.

(g)

The minimum height of the first story exterior wall must be at least seven feet, six inches.

(h)

The materials and texture of exterior materials must be compatible in composition, appearance, and durability to the exterior materials commonly used in standard residential construction.

(i)

The following building construction documents are required for permitting:

(1)

Continuous footing foundation. The modular home must be designed to require and be permanently attached to a continuous permanent footing foundation supports around the perimeter.

(2)

Modular home manufacturer building drawings. With cover page showing applicable codes constructed to:

a.

2012 International Building Code for one- and two-family dwellings—Framing/Doors/Windows/etc.

b.

2011 National Electrical Code—Electrical Details.

c.

2013 Louisiana State Plumbing Code—Drawings/pipesizes/etc.

d.

2012 International Mechanical Code—HVAC Details.

(j)

Furnish one set of complete plans from the manufacturer with original structural engineers seal. They must be properly signed and showing that the structure meets wind gust loads of the 2012 International Residential Building Code for one- and two-family dwellings. Copies of engineers seals will not be accepted.

(k)

Open wall inspection report (showing approval of all open wall factory inspections—framing, plumbing, electrical, and HVAC).

(l)

Furnish a site plan showing the modular building located on site with the proper setbacks from each property line as required by the town planning department.

(m)

Furnish one set of drawings showing the footing and foundation as engineered by a registered engineer. Manufactured home tie downs will not be accepted.

(n)

Third party inspection certificates will not be acceptable in lieu of engineers seals.

(o)

Modular buildings must be erected on site by a Louisiana licensed residential builder or a general contractor who is properly licensed by the state.

When all data is received and a permit application is filled out, the permit process and plan review will be made. Please allow up to 14 days to process the permit application.
