Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
ABANDONED PROPERTYAny real property located in the Town which contains a building or structure which is vacant and any one or more of the following conditions exist:
(1) There are unpaid real property taxes or water and sewer charges against the property for a period of one year or more.
(2) Junk or debris has accumulated on the property or in the building or structure on the property.
(3) The building or structure has unsecured openings.
(4) There is evidence of insect, vermin or rodent infestation.
(5) The Code Enforcement Official has determined that the building or structure has a negative visual impact on the surrounding neighborhood and/or caused a substantial depreciation in property values in the immediate neighborhood.
(6) The Code Enforcement Official has determined that the building or structure contains one or more violations of any state or local law, ordinance, rule or regulation, and the owner has failed to correct such violations within six months of the date written notice of such violation is sent by regular first-class mail from the Code Enforcement Official to the owner.
(7) The Code Enforcement Official has given written notice of the requirement to register pursuant to §
121-51.1C and the owner has failed to register the property within 30 days of such written notice.
DAYSConsecutive calendar days.
EVIDENCE OF VACANCYAny condition that, on its own or combined with other conditions present, would lead a reasonable person to believe that the property is vacant. Such conditions may include but not be limited to 1) overgrown and/or dead vegetation; 2) the accumulation of rubbish, garbage or debris on the property; 3) statements by neighbors, passersby, delivery agents or government agents that the property is unoccupied, among other evidence that the property is vacant.
FORECLOSUREThe legal proceeding by which real property is sold at a judicial sale to satisfy the debt on a loan secured by such real property.
MORTGAGEEThe creditor, including but not limited to service companies, lenders in a mortgage agreement and any agent, servant, or employee of the mortgagee, or any successor in interest and/or assignee of the mortgagee's rights, interests or obligations under a mortgage loan agreement.
NOTICE OF DEFAULTA written notice that a default has occurred under a mortgage and that the mortgagee intends to proceed with a foreclosure sale.
OWNERAny person, copartnership, association, corporation, entity, or fiduciary having a legal or equitable title or any interest in real property.
OWNER OF RECORDThe person having title to the property according to the records of the Dutchess County Clerk.
PROPERTYAny improved residential real property, or portion thereof, situated in the Town of Amenia, and includes all the buildings or structures located on the property.
