10.38 Construction

Subject To Geologic, Flood, Or Other Natural Hazards

10.38.010 Purpose

The purpose of this chapter is to protect the general public from geologic, flood or other natural hazards that might be detrimental to the health, safety and general welfare of the residents of the Town. Any application for a conditional use or building permit which has, in the opinion of the building official, potential soils, earthquake, flood or other discernable hazards or adverse environmental impacts may be required to provide a report addressing such hazards or impacts.

10.38.020 Requirements

  1. Report Preparation: The report shall be prepared by a licensed civil engineer and shall make recommendations for the suitability of the property to accommodate the proposed construction.
  2. Special Conditions: Whenever a report indicates a parcel may be subject to potential or actual hazards or impacts, the applicant shall meet the special conditions required by said report and/or the planning commission. If such conditions cannot be met, or will not be met, the application shall be denied.
  3. Applicability of Flood Control Ordinance: All requests for permits in potential flood areas shall be subject to all provisions of the town flood control ordinance.
    1. In any area which, in the opinion of the planning or building department, is subject to possible flood hazard, an engineer's report certifying the mitigating measures to be undertaken to remove the building from the flood area.
    2. The engineering report shall be reviewed and approved by the planning commission.

10.38.030 Hazardous Wastes

No hazardous waste of any type shall be disposed of in the town. Such material shall be transported to sites specifically approved for that purpose.

10.38.040 Well Protection

All wells used for culinary purposes shall meet all requirements of the department of environmental quality for well protection, and the provisions of AVLU 10.34 water source protection.
