The purpose of this chapter is to authorize beekeeping subject to certain requirements intended to avoid problems that may otherwise be associated with beekeeping in populated areas.

(1) It shall also be unlawful to maintain an apiary in violation of the requirements of this chapter.
(2) Notwithstanding compliance with the various requirements of this chapter, it shall also be unlawful for any person to maintain an apiary or to keep any colony on any property in a manner that threatens public health or safety, or creates a nuisance.
(3) A person shall not locate nor allow a hive on property owned or occupied by another person without first obtaining written permission from the owner or occupant.
(4) A person shall comply with all state laws as stated in Chapter 11 “Utah Bee Inspection Act.”
Each beekeeper shall ensure that a constant source of fresh water is available on the same property as the apiary to minimize any nuisance created by bees seeking water on neighboring property.
As per the towns code enforcement ordinance 16.01.010, a first violation of this chapter that does not result in physical injury or property damage to another shall be an infraction. This can result in fines and/or misdemeanor criminal charges as per AV civil code enforcement ordinance 16.02.010.
