- DEFINITIONS OF TERMS
For the purpose of interpreting this ordinance [appendix], certain words or terms used herein shall be defined as follows:
Words used in the present tense include the future tense.
Words used in the singular number include the plural, and words used in the plural include the singular.
The word "person" includes a firm, association, organization, partnership, corporation, trust, and company as well as an individual.
The word "lot" includes the word "plot" or "parcel." The word "building" includes the word "structure." The word "shall" is always mandatory.
The word "used" or "occupied" as applied to any land or building shall be construed to include the words "intended, arranged, or designed to be used or occupied."
The word "map," "zoning map," or "Aragon Zoning Map" means the "Official Zoning Map of the City of Aragon, Georgia."
Except as specifically defined herein, all words used in this ordinance [appendix] shall carry their customary meaning as defined by a standard dictionary.
(1)
"Accessory use" - A use customarily incidental and subordinate to the principal use or building and located on the same lot with such principal use or building.
(2)
"Building" - Any structure having a roof supported by columns or by walls and intended for shelter, housing, or enclosure of persons, animals, or chattel.
(3)
"Building line" - A line established by law or by agreement, usually parallel with a property line, beyond which a structure may not extend.
(4)
"Building, accessory" - A building subordinate or supplemental to the main building on a lot and used for purposes customarily incidental to that of a main or principal building and located on the same lot therewith.
(5)
"Building, principal" - A building in which is conducted the main use of the lot on which said building is located.
(6)
"Customary incidental home occupation" - An occupation, profession or trade customarily carried on by an occupant in a dwelling unit as a secondary use which is clearly incidental to the dwelling unit for residential purposes and which meets the following conditions:
(A)
The occupation, profession or trade is carried on wholly within the principal building;
(B)
Not more than 30 percent of the floor area of the principal building is used for the conduct of said home occupation;
(C)
No merchandise or articles are displayed for advertising purposes, nor are displayed in such a way as to be visible from outside the dwelling;
(D)
No merchandise or articles are stored other than inside the principal building;
(E)
There is no alteration of the residential character of the building or premises;
(F)
No person not resident on the premises is employed;
(G)
One off-street parking space for each 150 square feet of floor area devoted to the home occupation is provided;
(H)
No motor power other than electrically operated motors are used and the total horsepower of such motors does not exceed three horsepower, or one horsepower for any single motor;
(I)
No name plate or sign is displayed upon the premises except one unlighted sign not exceeding one square foot in area and located not less than 20 feet from any property line.
(7)
"Dwelling" - A building designed, arranged, or used for permanent living quarters for one or more persons.
(8)
"Dwelling unit" - A building, or portion thereof, providing complete living facilities for one family.
(9)
"Family" - One or more persons occupying a dwelling and living as a single housekeeping unit.
(10)
"Junkyard" - Any such use involving the storage or disassembly of wrecked automobiles, trucks, or other vehicles; storage, baling or otherwise dealing in bones, animal hides, scrap metal, used paper, used cloth, used plumbing fixtures and used brick, wood, or other building materials. Such uses shall be considered "junkyards" whether or not all or part of such operations are conducted inside a building or in conjunction with, addition to, or accessory to, other uses of the premises.
(11)
"Lot" - A portion or parcel of land devoted to a common use or occupied by a building or group of buildings devoted to a common use, together with the customary accessories and open spaces belonging to the same.
(12)
"Lot, depth of" - The mean horizontal distance between the front and rear lot lines, measured in the general direction of the side lot lines.
(13)
"Lot, width of" - The distance between side lot lines measured at the building line.
(14)
"Manufactured home" - A structure transportable in one or more sections which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein.
(15)
"Manufactured home park" - A parcel of land which has been planned and improved for the placement of manufactured homes for nontransient use.
(16)
"Nonconforming use" - A building, structure, or use of land existing at the time of enactment of this ordinance [appendix], and which does not conform to the regulations of the district in which it is located.
(17)
"Roominghouse or boardinghouse" - A dwelling, other than a hotel or lodginghouse, where meals or housing accommodations, for three or more persons, are provided for hire.
(18)
"Sign, business" - An attached or free-standing structure which directs attention to a business or profession conducted on the premises.
(19)
"Sign, outdoor advertising" - A structural poster panel or painted sign, either freestanding or attached to the outside of a building, for the purpose of conveying information, knowledge, or ideas to the public about a subject either related or unrelated to the premises upon which [it is] located.
(20)
"Sign, incidental" -
(A)
A nonilluminated announcement sign not exceeding one square foot in area and attached wholly to a building;
(B)
A sign pertaining only to the rent, lease or sale of the premises upon which displayed and not exceeding six square feet in area;
(C)
A sign or bulletin board not exceeding 12 square feet in area upon the premises of a church or other institution for the purpose of displaying the name of the church or institution and the activities or services;
(D)
Direction or information signs of a public or quasi-public nature not exceeding eight square feet in area which state the name or location of a town, village, hospital, community center, private school, college, youth organization, church, or other place of worship, or the name or place of meeting of an official or civic body.
(21)
"Street" - A public or private way which affords the principal means of access to abutting properties.
(22)
"Street, primary" - A street or thoroughfare designated as a major or collector street in the City of Aragon.
(23)
"Structure" - Anything constructed or erected, the use of which requires location on the ground, or attachment to something having location on the ground.
(24)
"Yard" - A space on the same lot with a principal building open, unoccupied, and unobstructed by buildings, or structures from ground to sky except where encroachments and accessory buildings are expressly permitted.
(25)
"Yard, front" - An open, unoccupied space on the same lot with a principal building, extending the full width of the lot, and situated between the street and the front line of the building projected to the side lines of the lot.
(26)
"Yard, rear" - An open, unoccupied space on the same lot with a principal building, extending the full width of the lot and situated between the rear line of the lot and the rear line of the building projected to side lines of the lot.
(27)
"Yard, side" - An open, unoccupied space on the same lot with a principal building, situated between the building and the side lot line of the lot and extending from the front yard to the rear yard. Any lot line not a rear line or a front line shall be deemed a side line.

(11)
