CHAPTER 8

MH MANUFACTURED/MOBILE HOME DISTRICT

9-8-1: MANUFACTURED/MOBILE HOMES:

It is unlawful for any person, firm, association or corporation to place, keep or maintain any occupied or unoccupied singlewide manufactured home or single or double wide mobile home, upon any lot, piece or parcel of ground within the city that is not in a legal manufactured/mobile home district, except as otherwise provided in this title. 9-8-2: GENERAL REQUIREMENTS:

   A.   No manufactured/mobile home or RV community and/or subdivision shall be located or installed in a flood prone area as designated by the national flood insurance rate map for the city of Artesia without prior approval of the city's acting floodplain manager. No community shall be located in any area that is situated so that drainage from any barnyard, or other source of filth can be deposited in its location.
   B.   Manufactured/mobile home and RV communities shall not be exposed to objectionable smoke, noise, odor or other adverse influences.
   C.   Sites for manufactured/mobile home or RV communities shall have an acceptable relationship to the major traffic thoroughfare plan, and the site shall be accessible without causing disruption in residential areas.
   D.   It shall be shown that the proposed manufactured/mobile home or RV community shall not overcapacitate utility and drainage facilities.
   E.   All manufactured/mobile homes shall be skirted with material matching in design and color.
   F.   Requests for new manufactured/mobile home districts shall follow the same procedure as for any other new zoning request.
   G.   Addressing and numbering for lots/spaces shall comply with chapter 14 of this title.
   H.   Structural repairs, alterations, and modifications within a manufactured/mobile home shall not be permitted without a New Mexico manufactured housing division's licensed contractor per NMAC 14.12.2.14 and shall be inspected and approved by the state construction industries division (CID).
   I.   Additions may be placed against and alongside the manufactured/mobile home, but shall be independent and in no way attached to the manufactured/mobile home. Permits and inspections shall be conducted by the city's building inspection division.
   J.   Aboveground fuel storage tanks are prohibited, this includes propane tanks in excess of twenty five (25) gallons.
   K.   Manufactured/mobile home and RV subdivisions and parks shall comply with the minimum requirements found in appendices B, C and D of the city's adopted fire code. (Ord. 969, 6-9-2015)

9-8-3: MANUFACTURED/MOBILE HOME SUBDIVISIONS:

   A.   Compliance With Local And State Provisions: All manufactured/mobile home subdivisions shall meet the requirements set forth for the development of a subdivision in the regulations for the city. All manufactured and/or mobile homes shall meet New Mexico manufactured housing specifications.
   B.   Manufactured Home Placement Permit: A city manufactured home placement permit (herein MHPP) and a copy of the New Mexico manufactured housing permit issued by the New Mexico regulation and licensing department/manufactured housing division shall be required for occupancy of the home. An MHPP shall require a fee as determined by the city per resolution.
   C.   Approval Of Structures: No accessory building permit shall be issued and no buildings or structures shall be constructed until the building inspector/code enforcement officer has approved the same as complying with this title.
   D.   Regulations: The following regulations shall apply to manufactured/mobile home subdivisions:
      1.   Location: Singlewide manufactured/mobile home subdivisions shall be located in MH manufactured/mobile home districts only.
      2.   Lots Defined: Manufactured/mobile home lots shall be clearly defined and shall consist of a minimum of four thousand two hundred (4,200) square feet with a width of not less than thirty five feet (35').
      3.   Placement: A manufactured/mobile home subdivision shall consist of not less than twenty four (24) contiguous lots for the placement of manufactured/mobile homes for residential occupancy.
      4.   Off Street Parking: Off street parking for two (2) vehicles shall be provided for each manufactured/mobile home in the subdivision.
      5.   Front Yard Setback: The minimum depth of the front yard for manufactured/mobile homes and other main buildings from the front property line shall be twenty feet (20'). Accessory buildings shall be set back at least twenty five feet (25') from the front property line.
      6.   Side Yard Setback: The minimum width of each side yard from the interior property line shall be five feet (5').
      7.   Rear Yard Setback: The minimum depth of the rear yard from the rear property line shall be twenty feet (20').
      8.   Application: The front yard setback requirements shall apply to all streets.
      9.   Accessory Buildings: Accessory buildings shall be a minimum of ten feet (10') from any manufactured/mobile homes and any other buildings.
   E.   Site Utilities: Water, sewer, and electrical public tie ins shall be permitted and inspected by the city. Electrical, plumbing, and gas connections to the manufactured and/or mobile home shall be inspected and approved by the New Mexico manufactured housing division or CID.
   F.   Permanent Foundations: All manufactured/mobile homes shall be placed on a permanent foundation system per New Mexico manufactured housing rules and regulations (14 NMAC 12.5.11). (Ord. 969, 6-9-2015)

9-8-4: MANUFACTURED/MOBILE HOME AND RV PARKS:

   A.   Required Location: All manufactured/mobile home parks shall be located in a manufactured/mobile home district only. All RV parks shall be located in either a manufactured/mobile home district or commercial district only.
   B.   Site Plan Requirements: A site plan of the park shall consist of the following:
      1.   Location of each existing and proposed structure.
      2.   Location, area and dimensions of each space.
         a.   Manufactured/mobile home park spaces shall require a minimum of four thousand (4,000) square feet per space, with a minimum width of thirty five feet (35').
         b.   RV park spaces shall require a minimum of one thousand two hundred fifty (1,250) square feet per space, with a minimum width of twenty five feet (25').
      3.   Location and dimensions of all adjoining and interior roads, driveways and utilities.
   C.   Minimum Number Of Spaces: All parks shall contain at least twenty (20) spaces.
   D.   Conversion Of Additions To Permanent Residences Prohibited: No manufactured/mobile homes or RVs may be remodeled by additions, lean-tos or the like, for the purpose of converting the same into permanently located residences. The use of fireproof temporary awnings and cabanas or other factory built accessories shall not be considered as such remodeling.
   E.   Permitted Uses: In manufactured/mobile home or RV parks, the following uses are permitted:
Manufactured/mobile home park offices, community gardens, recreation rooms and areas, laundry and service rooms for park residents only.
Recreational vehicles (RVs).
Residential manufactured/mobile homes.
Single-family houses for park owner or caretaker.
   F.   Building Height: No buildings, structures or manufactured/mobile homes shall exceed a height of thirty five feet (35') as measured from finished grade to the highest point of the roof.
   G.   Distance From Adjacent Structures: No manufactured/mobile home, RV or other building shall be closer than ten feet (10') to any building, RV or other manufactured/mobile home. For this purpose, "manufactured/mobile home" includes porches, patios, carports and other additions to the basic unit.
   H.   Yards: Yard depths shall apply to exterior boundaries of the entire community site, not to actual or apparent lines of space, as follows:
      1.   Front Yard Setback: The minimum depth of the front yard for manufactured/mobile homes and other main buildings from the front property line shall be twenty feet (20'). Accessory buildings shall be set back at least twenty five feet (25') from the front property line.
      2.   Side Yard Setback: The minimum width of each interior side yard property line shall be ten feet (10').
      3.   Rear Yard Setback: The minimum depth of the rear yard property line shall be twenty feet (20') for manufactured/mobile homes, RVs and other main buildings. Accessory buildings shall be setback at least ten feet (10') from the rear property line.
      4.   Application: The front yard setback requirement shall apply to all streets.
   I.   Off Street Parking: Off street parking for two (2) vehicles shall be provided for each manufactured/mobile home in the park. RV parks shall provide one off street parking space for each RV space in the park.
   J.   Anchors: All manufactured/mobile homes shall be securely anchored to the ground in accordance with the manufacturer's installation instructions. Where the manufacturer's installation instructions are not available, the requirements shall be as set out in section 49.5.1 of the state of New Mexico manufactured housing rules and regulations, 14 NMAC 12.2. 9-8-5: RECREATIONAL VEHICLE (RV) SUBDIVISIONS:

   A.   Requirements: RV subdivisions shall meet the requirements set forth for the development of a subdivision in the regulations for the city.
   B.   RV Placement Permit: A city RV placement permit (RVPP) shall be required for occupancy of an RV. An RVPP shall require a fee as determined by the city per resolution.
   C.   Carports: Temporary metal carports may be permitted and may be placed no closer than twenty feet (20') from the front property line and five feet (5') from the interior side property line.
   D.   Regulations: The following regulations shall apply to RV subdivisions:
      1.   Location: RV subdivisions shall be located in an MH manufactured/mobile home district only.
      2.   Lots Defined: RV lots shall be clearly defined and shall consist of a minimum area of four thousand two hundred (4,200) square feet, with a width of not less than thirty five feet (35').
      3.   Number Allowed: One RV per lot.
      4.   Placement: An RV subdivision shall consist of not less than twenty four (24) contiguous lots for the placement of RVs for residential occupancy.
      5.   Off Street Parking: Off street parking for two (2) vehicles shall be provided for each lot in the subdivision.
      6.   Front Yard Setback: The minimum depth of the front yard from the front property line shall be twenty feet (20').
      7.   Side Yard Setback: The minimum width of each side yard from the interior property line shall be five feet (5').
      8.   Rear Yard Setback: The minimum depth of the rear yard from the rear property line shall be twenty feet (20') for RVs and other main buildings.
      9.   Application: The front yard setback requirements shall apply to all streets.
      10.   Accessory Storage Sheds: Accessory storage sheds shall be a minimum of ten feet (10') from any RV and any other buildings or structures.
   E.   Site Utilities: Water, sewer, and electrical public tie ins shall be permitted and inspected by the city. (Ord. 969, 6-9-2015)
