CHAPTER 2

GENERAL REGULATIONS; MAP

10-2-1: ESTABLISHMENT OF DISTRICTS:

For the purpose of this title, all land within the City and its contiguous area is hereby designated on the zoning map as being one of the following districts:

10-2-2: BOUNDARIES OF DISTRICTS:

The boundary lines of the districts are amended and established following lot lines, centerlines of streets, alleys or railroad rights-of-way, or such centerlines extended, centerlines of creeks or the corporate limit line as shown on the zoning district map attached and marked as exhibit A attached to the ordinance codified herein. Said zoning district map is hereby adopted as the zoning district map for the City of Atlanta, Illinois, and all previous zoning district maps are hereby repealed. (Ord. 00-01, 3-22-2000)

10-2-3: APPLICATION OF REGULATIONS:

   (A)   Building Or Land Use: No building or land shall hereafter be used and no building or part thereof shall be erected, moved or altered unless for a use expressly permitted by and in conformity with the regulations for the district in which it is located.
   (B)   Zoning Of Annexed Areas: All territory which may hereafter be annexed to the City shall from time of annexation be considered as being in the R-1 District until and unless otherwise designated by zoning title amendment as specified in the procedure in chapter 9 of this title, or unless otherwise designated at the time of annexation. 10-2-4: CONTINUANCE OF NONCONFORMING USES AND STRUCTURES:

Any lawful use of land or structure existing at the time of adoption of this title, or subsequent amendment of this title, may be continued with the following limitations: (Ord. 15-02, 4-21-2015)
   (A)   Nonconforming Use Not To Expand: Any structure containing a nonconforming use may not be expanded nor substantially remodeled. Structures may be repaired or remodeled to maintain original uses. Nonconforming use porches shall be allowed to be reconstructed in residential districts only, but shall not be expanded from the original footprint. (Ord. 15-02, 4-21-2015; amd.    (B)   Nonconforming Use Not To Rebuild: Any structure containing a nonconforming use, which has been damaged to the extent of fifty percent (50%) of its current fair value, as estimated immediately prior to damage, shall not be repaired or reconstructed except in conformity with this title.
   (C)   Discontinued Nonconforming Use Not To Reestablish After One Year: No nonconforming use shall be reestablished after having been discontinued for twelve (12) months. Vacating of premises or building or nonoperative status shall be evidence of a discontinued use.
   (D)   Nonconforming Use Not To Be Substituted: No nonconforming use may be substituted for any other nonconforming use or any conforming use. (Ord. 15-02, 4-21-2015)

10-2-5: OFF STREET PARKING:

   (A)   Hard surfaced off street automobile parking shall be provided on any lot on which any of the following uses are hereafter established; such space shall be provided with vehicular access to a street or alley. For purposes of computing gross off street parking area required, the ratio of two hundred fifty (250) square feet per parking space shall be used. Following are minimum requirements for specific uses: (1-2-1968)
Boarding and rooming houses
 
1 space for each 2 rooms occupied by boarders or roomers
Dwellings
 
2 spaces per dwelling; 2 spaces per duplex
Hospitals and other institutions for care and treatment
 
1 space for each 4 beds, plus 1 space for each staff and visiting doctor, plus 1 space for each 3 employees
Office uses
 
1 space for each 300 square feet of gross floor area
Retail establishments
 
1 space for each 300 square feet of gross floor area
Theater, auditorium including school auditorium, church or other place of public assembly
 
1 space for each 8 seats available at maximum capacity
Tourist accommodations
 
1 space for each room offered for tourist accommodations
Wholesale, storage and manufacturing establishments
 
1 space for each 5 employees

   (B)   If off street parking space for nonresidential uses as required in subsection (A) of this section cannot be provided on the same lot on which the principal use is conducted, the Zoning Enforcing Officer may permit such space to be provided on other off street property, provided such space is within four hundred feet (400') of the main entrance to such principal use. Such off street parking space shall thereafter be deemed to be required open space associated with this permitted use and shall not be reduced nor encroached upon in any manner. (1-2-1968)

10-2-6: OFF STREET LOADING:

Every building or structure used for other than residential uses and constructed after the adoption of this title shall provide space on the property to be used exclusively for loading and unloading of vehicles. Such space shall be in accordance with the following schedule:

For buildings over 400,000 square feet, 6 spaces, plus 1 additional space for each additional 200,000 square feet.
For the purpose of determining adequacy of loading area, each space shall be not less than ten feet (10') in width, forty five feet (45') in length and fourteen feet (14') in height. (1-2-1968)

10-2-7: OBSTRUCTIONS TO VISION AT INTERSECTIONS PROHIBITED:

On any corner lot in all districts, except the C-1 General Retail District, there shall be no obstruction to traffic visibility within thirty five feet (35') of the intersection of the two (2) street property lines of the corner lot. (1-2-1968)

10-2-8: OUTDOOR ADVERTISING SIGNS:

   (A)   Newly constructed outdoor advertising signs along the U.S. 66 and Interstate 55 corridors shall not be closer than two thousand five hundred feet (2,500') from any other outdoor advertising sign on said corridors.
   (B)   Signs that are erected on the U.S. 66 and Interstate 55 corridors shall be constructed not more than twenty five feet (25') distant from the road right-of-way. (Ord. 07-01, 4-17-2007)
