CHAPTER 7

EXCEPTIONS; MODIFICATIONS

10-7-1: LOT OF RECORD:

When a lot which is an official lot of record at the time of adoption of this title does not comply with the area, yard or other requirements of this title, an application may be submitted to the board of appeals for a variance from the terms of this title in accordance with the procedure outlined in title 2, chapter 3 of this code. Such a lot may be used as a building site; provided, however, that the yard and other requirements of the district are complied with as closely as possible in the opinion of the board of appeals. 10-7-2: EXCEPTIONS TO YARD REQUIREMENTS:

   (A)   Allowable Projections Of Residential Structures Into Yard: Architectural features of residential buildings such as windowsills, cornices and roof overhangs may project into the required yard, provided such projections are not more than four feet (4') and do not reach closer than four feet (4') to any lot line.
   (B)   Allowable Projections Of Business Structures Over Sidewalk: Signs, awnings, canopies and marquees are permitted to overhang the sidewalk in the C-1 general retail district only; providing, that overhanging signs are a minimum of eight feet (8') above the sidewalk at any point and that all other structures are a minimum of six feet eight inches (6'8") above the sidewalk at any point.    (C)   Allowable Projections Of Accessory Building Into Rear Yard: One-story accessory buildings, when separated from the principal structure on the lot by ten feet (10') or more, may project into the rear yard, providing such projection extends not closer than five feet (5') to the rear lot line.    (D)   Allowable Projections Of Fences Into Yards:
      1.   Within residential districts, fences may be constructed in or project into yards; providing, that: a) no fence or planting more than three feet (3') high or thirty percent (30%) solid shall be located within thirty feet (30') of a street intersection; b) no fence more than four feet (4') high may be located closer to the front of the lot than the principal building; and c) no fence more than six feet (6') high shall be allowed on any other part of the lot.       2.   All fences erected after the effective date hereof shall be set back two feet (2') from the property line, with the said two foot (2') setback to be free of all obstructions, to allow for passage and mowing of the said two feet (2'). (Ord. 05-02, 5-3-2005)

10-7-3: EXCEPTIONS TO HEIGHT LIMITS:

The height limitations of this title shall not apply to church spires, belfries, cupolas and domes not intended for human occupancy; monuments, water towers, transmission towers, chimneys, smokestacks, derricks, conveyors, flagpoles, radio towers, masts and aerials. (1-2-1968)
