Alternative Energy Overlay District

§ 163-64.1 Purpose.

The Alternative Energy Overlay District is designed to encourage the development of low-impact renewable energy projects that are beneficial to the community while remaining compatible with the City's sensitive coastal environment.

§ 163-64.2 Permitted uses.

All alternative-energy-oriented land uses within the Overlay District are subject to the issuance of a conditional use permit, as provided in Part 5, Article XXVI, of this chapter. The construction of electrical generating facilities using renewable forms of energy such as solar, radiation, wind and water, including experimental and demonstration projects, are encouraged, provided that the facilities do not significantly detract from the scenic, recreational or environmental value of the land.

§ 163-64.3 Bulk, space and yard controls.

A. 
Due to the uniqueness of each potential project, the space, bulk and yard controls will be evaluated case by case. Development projects subject to the overlay district controls are prohibited unless the project complies with all applicable Department of Environmental Protection Coastal Zone Management Regulations.
B. 
Plans submitted for Planning Board approval should illustrate the specific geographic extent of the uplands, wetlands and wetland buffer areas at each proposed site.
C. 
Each facility should include a landscape design with indigenious plants along the roadway corridors.

§ 163-64.4 Accessory uses and structures.

A. 
Accessory uses and structures required for the principal use are permitted within the Overlay District, subject to the provisions of § 163-68 of this chapter.
B. 
In addition, all maintenance areas should be screened and include techniques that will prevent materials from entering the roadways and waterways as a result of weather events.

§ 163-64.5 Temporary uses.

Temporary uses are permitted in the Overlay District if required for the operation of the principal use and subject to the provisions set forth in § 163-69 of this chapter.

§ 163-64.6 Parking requirements.

A. 
Parking facilities should be designed with paved surfaces minimized.
B. 
New road construction should be limited to situations where a clear need exists.

§ 163-64.7 Signs.

A. 
Signs are permitted in the District, subject to compliance with the commercial district provisions set forth in § 163-71 of this chapter.
B. 
Advertising signs are not encouraged uses at Overlay District sites.

§ 163-64.8 Performance standards.

All development shall comply with the applicable performance standards set forth in § 163-73 of this chapter.

§ 163-64.9 Additional conditional use standards.

A. 
Only those uses that require direct water access should be located within the wetland and wetland buffer areas.
B. 
Energy facilities shall be required to submit site-specific information demonstrating that the facilities will not result in adverse impacts to the wetland and wetland areas.
C. 
Retail sales are not permitted at the alternative energy sites.
