SECTION 1

Introduction.

§ 1.1 Authority.

These Regulations are adopted and enacted under the authority of Chapter 124 of the General Statutes of the State of Connecticut, as amended [C.G.S. § 8-1 et seq.] and are hereby known as the Zoning Regulations of the Town of Avon.

§ 1.2 Purpose.

These Regulations are adopted for the purposes set forth in Chapter 124, § 8-2 of the C.G.S., as amended. These Regulations are established to meet statutory responsibilities and to achieve the following purposes:
A. 
Promoting public health, safety, and general welfare;
B. 
Providing adequate light, air, and privacy;
C. 
Preventing overcrowding of the land and avoiding undue concentration of population;
D. 
Lessening congestion in the streets;
E. 
Facilitating adequate transportation, sewage, schools, parks, and other public requirements;
F. 
Securing safety from fire, panic, flood, and other dangers;
G. 
Conserving the value of buildings and property;
H. 
Encouraging the most appropriate use of land throughout the Town of Avon with reasonable consideration for the existing or planned character of the area;
I. 
Protecting historic factors within the Town of Avon;
J. 
Protecting existing and potential public surface and ground drinking water supplies;
K. 
Controlling erosion caused by wind or water and providing for sedimentation control pursuant to C.G.S. Chapter 446h, § 22a-329;
L. 
Encouraging energy conservation, the use of solar and other renewable forms of energy, and energy-efficient patterns of development;
M. 
Guiding the growth of the Town of Avon in accordance with the latest Plan of Conservation and Development (POCD);
N. 
Promoting housing choice and economic diversity in housing, including housing for both low- and moderate-income households;
O. 
Providing for the development of housing opportunities, including opportunities for multifamily dwellings, that are consistent with the terrain and infrastructure capacity; and
P. 
Encouraging the most appropriate use of land throughout Avon by reasonably considering the physical site characteristics of each zoning district and its suitability for such uses.

§ 1.3 Zoning Districts and Boundary Interpretation.

A. 
Zoning Districts. The Town of Avon is divided into the following zoning districts:

Recreation/Open Space (ROS)
Residential Districts
Residential-15 (R-15)
Residential-30 (R-30)
Residential-40 (R-40)
Rural Residential (RU-2A)
Commercial and Industrial Districts
Office Park (OP)
Neighborhood Business (NB)
Commercial Specialized (CS)
Commercial Retail (CR)
Commercial Park A (CPA)
Commercial Park B (CPB)
Industrial (I)
Restricted Industrial (RI)
Industrial Park (IP)
Other Districts
Avon Village Center (AVC)
Darling Drive/Security Drive DD/HOD
Avonwood Road AR/HOD
Educational Land (EL)
Overlay Districts
Ridgeline Protection Overlay Zone (RPO)
Attainable Housing Overlay Zone (AHOZ)
Floodplain (FP)
B. 
Zoning Boundaries. Zone boundaries are established by the Commission and are shown on a map entitled "Zoning Map; Town of Avon, Connecticut." The Commission shall determine the location of zone boundaries in case of uncertainty.
C. 
Zoning Boundary Interpretation. Unless otherwise clearly designated on the Zoning Map, zone boundaries shall be interpreted as:
1. 
Following the center line of a street, highway, road, river, brook, or stream;
2. 
Following property lines;
3. 
Following the lines of a particular geophysical feature including floodplains and steep slopes; or
4. 
Running parallel to any of the before-mentioned lines, at distances measured, where zone boundaries appear to be set back from such lines.

§ 1.4 Interpretation of Regulations.

A. 
Uses Prohibited If Not Permitted. Only those uses identified in Section 4.2 (Consolidated Use Table) of these Regulations shall be permitted. Any use of land, buildings, or structures that are not expressly permitted in a district by these Regulations are prohibited in that district, unless the Planning and Zoning Commission determines that a proposed use is compatible and in harmony with the district in which it is proposed.
B. 
Minimum Requirements. The requirements established within these Regulations shall be minimum requirements and, except where specific exceptions are made within these Regulations, shall apply uniformly to each piece of property, category of use, or kind of structure.
C. 
Strictest Standards Control. In the event that conflicting requirements are found in these Regulations, the most restrictive requirement shall be applied. Wherever the requirements of these Regulations are at variance with the requirements of any other adopted rule or regulation, the most restrictive or that imposing the highest standard shall govern.
D. 
Other Local, State, and Federal Requirements. All land uses in Avon shall comply with all applicable local, state, and federal requirements, including, but not limited to, compliance with the Avon Subdivision Regulations[1] and the Regulations of the Avon Inland Wetlands Commission,[2] the Avon Water Pollution Control Authority, the Avon Fire Marshal, the Avon Town Engineer, and the State of Connecticut Departments of Health, Energy and Environmental Protection, and Transportation.

E. 
Property in Two Districts or in Two Municipalities. Where any established or proposed lot falls into two or more zoning districts or two or more municipalities, any question of uncertainty as to district boundaries, permitted uses, setbacks, or other regulatory requirements shall be determined by the Commission.
F. 
Reference to Technical Standards. Where references are made in these Regulations to technical standards contained in technical manuals or publications, the latest published edition or version of those technical manuals or publications shall be used in the application of technical standards.

§ 1.5 Conformity Required.

A. 
No building, structure or land shall be used, designed for any use or changed to any use, other than is permitted in the zone in which such building, structure, or land is located except in conformance with these Regulations.
B. 
No building or structure shall be erected, reconstructed, structurally altered, enlarged, moved, or maintained except in conformance with these Regulations.
C. 
No conveyance of land shall be made that reduces the remaining land of the grantor below the area, width, or yard requirements of the zone.

§ 1.6 Severability.

Should any phrase, clause or section of these Regulations be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of these Regulations as a whole, or any part thereof, other than the part so declared to be invalid.

§ 1.7 Effective Date.

These Regulations and any amendment or change hereto shall be in full force and effect upon the date established by the Commission in accordance with the provisions of the Connecticut General Statutes, as amended. A record of all amendments to the Zoning Regulations since the initial adoption on October 21, 1957, is on file in the Avon Planning and Community Development Office.
The effective date of these Regulations is 23 October, 2025.
