ARTICLE 2

Definitions

§ 2.1 Interpretation of Terms.

For the purposes of these regulations, certain terms used herein shall be used, interpreted, and defined as follows and to achieve the following purposes these Regulations shall:
A. 
Be made in accordance with the comprehensive plan and in consideration of the Plan of Conservation and Development adopted under C.G.S. § 8-23;
B. 
Be designed to (1) lessen congestion in the streets; (2) secure safety from fire, panic, flood and other dangers; (3) promote health and the general welfare; (4) provide adequate light and air; (5) protect the state's historic, tribal, cultural and environmental resources; (6) facilitate the adequate provision for transportation, water, sewerage, schools, parks and other public requirements; (7) consider the impact of permitted land uses on contiguous municipalities and on the planning region, as defined in C.G.S. § 4-124i, in which such municipality is located; (8) address significant disparities in housing needs and access to educational, occupational and other opportunities; (9) promote efficient review of proposals and applications; and (10) affirmatively further the purposes of the federal Fair Housing Act, 42 U.S.C. 3601 et seq., as amended from time to time;
C. 
Be drafted with reasonable consideration as to the physical site characteristics of the district and its peculiar suitability for particular uses and with a view to encouraging the most appropriate use of land throughout the municipality;
D. 
Provide for the development of housing opportunities, including opportunities for multifamily dwellings, consistent with soil types, terrain and infrastructure capacity, for all residents of the municipality and the planning region in which the municipality is located, as designated by the Secretary of the Office of Policy and Management under C.G.S. § 16a-4a;
E. 
Promote housing choice and economic diversity in housing, including housing for both low and moderate income households;
F. 
Expressly allow the development of housing which will meet the housing needs identified in the state's Consolidated Plan for Housing and Community Development prepared pursuant to C.G.S. § 8-37t and in the housing component and the other components of the state Plan of Conservation and Development prepared pursuant to C.G.S. § 16a-26;
G. 
Be made with reasonable consideration for the impact of such regulations on agriculture, as defined in subsection (q) of C.G.S. § 1-1;
H. 
Provide that proper provisions be made for soil erosion and sediment control pursuant to C.G.S. § 22a-329;
I. 
Be made with reasonable consideration for the protection of existing and potential public surface and ground drinking water supplies; and
In addition, these Regulations may also provide for additional items as contained in C.G.S. § 8-2.
These Regulations may not require items prohibited under C.G.S. § 8-2.

Words used in the present tense include the future tense.
2. 
The singular includes the plural, and the plural the singular.
3. 
The word "shall" is mandatory and not discretionary.
4. 
The word "may" is permissive.
5. 
The word "person" includes a partnership, corporation, or other entity.
6. 
The word "building" includes the word "structure."
7. 
The word "zone" includes the word "district."
8. 
The word "Commission" means the Planning and Zoning Commission of the Town of Avon.
9. 
The phrase "these Regulations" shall refer to the entire Zoning Regulations.

§ 2.2 Terms not Defined.

The Commission shall establish the appropriate definition for words not defined in this section or in case of an uncertainty.

§ 2.3 Definitions.

The definitions contained in this section shall be used for the purpose of interpreting the various provisions of these Regulations.
0.2-PERCENT ANNUAL-CHANCE FLOODPLAIN

ACCESSORY
Customarily incidental and subordinate to a principal building, structure, or use located on the same lot (e.g., accessory building, structure, or use).
ACCESSORY DWELLING UNIT
A second dwelling unit, either within the existing principal single-family dwelling or separate from such dwelling and can be used as a complete, independent living facility with provisions for cooking, eating, sanitation, and sleeping.
AFFORDABLE HOUSING
Housing where total housing costs do not exceed 30% of household income for persons or families whose annual income does not exceed the lesser of the statewide or area median income (AMI).
ALTERATION
A change or rearrangement in the structural parts of a building, the movement of all or any part thereof, or the substantial reconstruction thereof, in order to produce a substantial change in appearance, character, or construction. It also means an enlargement, whether by increase in height, coverage, volume, or floor area.
ANIMAL, LARGE
Domestic animals whose mature weight is generally 500 pounds or more, such as horses and ponies.
ANIMAL, MEDIUM
Domestic animals whose mature weight falls within the range of 30 to 500 pounds, such as sheep and goats.
ANIMAL, SMALL
Domestic animals with a mature weight of less than 30 pounds, such as poultry, fowl, and rabbits.
AS OF RIGHT
Able to be approved in accordance with the terms of zoning regulation or regulations without requiring that a public hearing be held, a variance, special permit or special exception or some other discretionary zoning action be taken, other than a determination that a site plan is in conformance with applicable zoning regulations.
ASSISTED LIVING FACILITY
A residence facility for the elderly or disabled that contains independent living units with provisions for cooking, eating, sanitation, and sleeping; that provides for meals, personal care, and supervision of self-administered medication; and that provides a transition between independent living and skilled nursing care.
ATTIC
A space immediately below the roof of a building, less than or equal to six feet in height or greater than 200 square feet, that is used solely for utilities, storage, or other accessory uses and that is not generally intended, designed, or used for regular human occupancy.

BASE FLOOD

BASE FLOOD ELEVATION (BFE)

BASEMENT
See Section 3.5D.2 (Floodplain Overlay District) for definition.
BERM
A mound of earth typically used as a landform design element or buffer.
BUFFER
Land area used to visibly separate one use from another or to block noise, lights, or other nuisances, generally through the use of landscaping, structures, and/or vegetation.
BUILDING
A structure having a roof supported by walls on all sides and intended for shelter, housing or enclosure of any person, animal, or material of any kind. Buildings that are physically connected only by structures other than buildings, such as covered walkways, shall be deemed to be separate buildings. For the purposes of ridgeline Regulations, see the definition provided in Section 3.5.A.3.
BUILDING LINE
A line parallel to the property lines set back a distance equal to the yard requirements established for the zone in which the lot is located.
BUILDING, FOOTPRINT
All parts of a building that rest, directly or indirectly, on the ground, including, but not limited to garages, bay windows with floor space, chimneys, porches, decks, cantilevered floor space or decks, and covered breezeways or walkways.
BUSINESS, NEW
Any business which moves into a new location subsequent to the adoption of these Regulations.
CALIPER
The diameter of a tree trunk measured 6" above the ground.
CERTIFICATE OF OCCUPANCY
A document issued by the Building Inspector allowing the occupancy or use of a building and certifying that the structure or use has been constructed in compliance with applicable Regulations and approvals.
CLEAR-CUTTING

COMMERCIAL KENNEL
A place maintained for boarding or grooming dogs or cats, and includes, but is not limited to, any veterinary hospital which boards or grooms dogs or cats for nonmedical purposes. [C.G.S. § 22-327]
COMMUNITY CENTER
Public locations where members of a community gather for group activities, social support, public information, and other purposes.
COMMUNITY FACILITY
Premises owned and operated by a governmental or chartered nonprofit organization but not including fraternal, sports, or similar membership organizations.
CONGREGATE LIVING FACILITY
A residence facility for elderly or disabled residents that contains independent living units with provisions for cooking, eating, sanitation, and sleeping and that provides communal dining facilities and other appropriate support services such as housekeeping, organized social and recreational activities, and/or transportation.
CONSTRUCTION, NEW

CONSTRUCTION, START OF

CONTRACTOR'S YARD (STORAGE YARD)
Any land, building or structure used for the purpose of storing contracting or construction equipment and material or performing shop work or assembly work by any building trade or other contractor, including office space.
CONVENIENCE GOODS
Goods such as food, dairy, bakery, or drug products, which may regularly be required in the day-to-day functions of a residential home.
COST
See Section 3.5D.2 (Floodplain Overlay District) for definition.
DAY CARE
A facility which provides care, protection, and supervision for children or adults on a regular basis away from their primary residence for less than 24 hours per day.
DAY CARE, CENTER
A program of supplementary care for more than 12 related or unrelated children outside their own homes on a regular basis. [C.G.S. § 19a-77]
DAY CARE, FAMILY HOME
A program of supplementary care within a private family home, as defined in C.G.S. § 19a-77.
DAY CARE, GROUP HOME
A program of supplementary care for not less than seven nor more than 12 related or unrelated children on a regular basis, or one that meets the definition of a family day care home, as defined in C.G.S. § 19a-77, except that it operates in a facility other than a private family home.
DECIBEL
A unit of sound pressure level which is commonly used to express noise level.
DENSITY
The maximum number of dwelling units permitted per acre of developable land.
DESIGN FLOOD ELEVATION
See Section 3.5D.2 (Floodplain Overlay District) for definition.
DESIGN FLOOD HAZARD AREA (DFHA)
See Section 3.5D.2 (Floodplain Overlay District) for definition.
DEVELOPMENT
The construction, reconstruction, alteration, or expansion of a building equal to or greater than 100 square feet in area. For the purposes of floodplain Regulations, see the definition provided in Section 3.5D.2 (Floodplain Overlay District).
DWELLING, MULTIFAMILY
A building designed for, or occupied by, three or more families living independently of each other, with the number of families in residence not exceeding the number of dwellings provided.
DWELLING, SINGLE-FAMILY
A building, or portion thereof, designed for single-family residential occupancy, with provisions for cooking, eating, sanitation, and sleeping.
DWELLING, TWO-FAMILY
A building designed for, or occupied by, two families living independently of each other, each with provisions for cooking, eating, sanitation, and sleeping.
EARTH
Sand, gravel, soil, mulch, clay, quarry stone, and other earthen materials.
EARTH ALTERATION
Shall consist of the removal, fill, and grading of earth materials.
EASEMENT
The right of the public, a corporation, another person or entity to use public or private land owned by another for a specific purpose.
ELDERLY
Age 62 or older or, in the case of elderly occupancy, where at least one member of the immediate family is age 62 or older.
EMERGENCY MEDICAL CARE FACILITY
A medical office staffed by a licensed medical professional, such as a physician or veterinarian, providing emergency treatment for humans or animals on a walk-in basis. This term shall not include an urgent care center.
EMERGENCY SERVICES
Those extraordinary services, such as fire protection, ambulance, and rescue, provided for the general health and welfare of the Town residents.
FARMING
Cultivation of the soil, dairying, raising or harvesting of any agricultural or horticultural commodity, including the raising and keeping of livestock (excluding pigs). Includes farm buildings, and accessory buildings thereto, orchards, ranges, greenhouses, hoophouses and other temporary structures or other structures used primarily for the raising and, as an incident to ordinary farming operations, the sale of agricultural or horticultural commodities.
FARMING, LIMITED
Farming on a tract of less than 10 acres provided the use is accessory to the principal use of the premises.
FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA)

FIXTURE

FLOOD (FLOODING)

FLOOD INSURANCE RATE MAP (FIRM)

FLOOD INSURANCE STUDY (FIS)

FLOODWAY

FLOOR
The bottom surface of a room or of any other interior space within a building.
FLOOR AREA
The total number of square feet of floor space within the exterior walls of a building, not including space in cellars, basements, or unfinished attics.
FLOOR AREA, MAXIMUM
The maximum cumulative area, as specified in and permitted by these Regulations, of all floors in any one building, except that the area of basement floors and attic floors shall not be included in the calculation of maximum building floor area.
FOUNDRY
An establishment that produces ornamental and/or functional objects made from metal. May include that of concrete production and products. Such establishment shall be limited to the use of electric, electronic, and induction heating of metals and manufacture and storage of chemicals or plastics.
FUNCTIONALLY DEPENDENT USE OR FACILITY

GLARE

GOLF COURSE
A facility, other than a miniature golf course, for the playing of golf, at which there may be a clubhouse including restrooms and locker rooms. A golf course may provide additional services customarily furnished such as swimming pools, tennis courts, play fields, park land, driving ranges, and related retail sales that may include a restaurant and cocktail lounge.
GRADING
Any excavating, grubbing, filling, or stockpiling of earth materials or any combination thereof, including the land in its excavated or filled condition.
GROUP HOME
A community-based residential facility, housing six or fewer individuals, within a single-family residence that is licensed by the Department of Public Health or Department of Children and Families within the State of Connecticut.
HEIGHT
The vertical distance from the average finished grade for a building or other structure to the mean elevation of the roof, measured from the highest mean elevation between its ridge and its corresponding eve. For buildings which have more than one roof line, height requirements shall be measured to the highest roof. Standpipes, soil stacks, chimneys, and similar accessory utility structures, as well as television and radio antennas that are affixed to a building, may extend not more than an additional five feet above the highest point of the roof of the building to which they are accessory, provided the roof complies with the maximum building height limitation.

HISTORIC STRUCTURE

HOME OCCUPATION
An occupation or business activity which results in a product or service for financial gain; is conducted in whole or in part in the dwelling unit; is clearly subordinate to the residential use of the dwelling unit; occupies less than 25% of the dwelling unit; doesn't affect the residential character of the property; and does not create a nuisance in the neighborhood. May include that of cottage food operation.
HOME OCCUPATION, MAJOR
A home occupation in which not more than one person other than residents residing on the premises is employed on the premises; may have more customer activity than a minor home occupation; and that accommodates both dwelling and home occupation parking needs.
HOME OCCUPATION, MINOR
A home occupation in which no persons other than residents residing on the premises are engaged in the occupation; has no visible exterior evidence of the conduct of the occupation; does not create need for off-street parking beyond normal dwelling needs; does not generate additional traffic from nonresidents; and for which no equipment is stored or used on-site other than that normally used in household, domestic, or general office work. May include that of cottage food operation.
HOTEL
A building or group of attached or detached buildings containing more than 25 total guest rooms intended for rental or lease to transients by the day, week or month, whether individually or combined in guest suites. A hotel shall have at least one full-time employee on site during daytime hours. A hotel typically provides services and amenities such as daily maid service, restaurant, meeting rooms, conference rooms and/or recreation facilities.
IMPERVIOUS COVERAGE
The percentage of lot area covered by impervious surfaces.
IMPERVIOUS SURFACE
A hard, typically man-made surface that prevents, or substantially decreases, the percolation of storm water into the soil including building roofs, streets, parking lots, sidewalks, other paved surfaces, and other essentially impenetrable surfaces.
LANDSCAPED AREA
An area maintained in natural or artificial ground cover, lawn, trees, shrubs, or other plantings and including walks or drives to and from a street.
LICENSED MEDICAL MARIJUANA DISPENSARY FACILITY
A place of business where marijuana may be dispensed or sold at retail by a licensed pharmacist to qualifying patients or primary caregivers and for which the Connecticut Department of Consumer Protection has issued a dispensary facility permit to an applicant.
LICENSED MEDICAL MARIJUANA PRODUCTION FACILITY
A secure, indoor facility where production of marijuana occurs and is operated by a person to whom the Connecticut Department of Consumer Protection has issued a producer license and whose purpose is to cultivate marijuana for palliative use, selling, delivering, transporting or distributing such marijuana only to licensed dispensaries.

LIVING AREA
That portion of the total floor area of a residential dwelling which has ceilings, walls and floors finished in a manner which is clearly intended for human occupancy, and which conforms to the Building Code.
LOADING SPACE
A space within the main building or on the same lot, providing for the standing, loading, or unloading of trucks.
LOGO
A simple graphic presentation which may include numbers or letters used to identify a business.
LOT
A parcel of land occupied or approved to be occupied by a building or buildings.
LOT, AREA
The total square footage of the horizontal surface within the boundary lines of a lot.
LOT, COVERAGE
That percentage of the lot area that is covered by the roof area of all buildings and structures on the lot. Roof overhangs shall not be calculated as lot coverage unless they project more than 18 inches from the exterior of the foundation wall.
LOT, FRONT
A lot which abuts and fronts on a street and which meets the lot width requirement of the zone.
LOT, LINE
A line of record bounding a lot.
LOT, REAR
A residentially zoned lot which does not meet the lot width requirement of the zone, and which is approved for building purposes under these Regulations. May also be referred to as a flag lot.
LOT, WIDTH
The distance between the side lot lines measured along the front yard setback requirement.
LUMINAIRE
See Section 5.10C (Lighting) for definition.
MAJOR GROCERY STORE
A self-service retail market larger than 20,000 square feet of gross building area that sells food and household goods, provided that 50% or more of the area used for displaying goods is used for the display of food.
MANUFACTURED HOME
See Section 3.5D.2 (Floodplain Overlay District) for definition.
MANUFACTURED HOUSING UNIT
A single-family dwelling unit designed to be transported after fabrication on its own wheels, or on flatbed or other trailers or detachable wheels; arriving at the site where it is to be occupied in a dwelling complete and ready for occupancy, except for minor and incidental unpacking and assembly operations, connection to utilities, and the like. A manufactured housing unit shall not include mobile homes.
MANUFACTURER CERTIFIED PRE-OWNED MOTOR VEHICLE
A motor vehicle which has been certified in accordance with an automobile manufacturer sponsored program which provides quality pre-owned vehicles covered by a comprehensive, factory-backed protection plan and which vehicles are in compliance with manufacturer certified standards.
MANUFACTURING
Businesses engaged in the processing, manufacturing, production, compounding, assembly, packaging, treatment or fabrication of materials and products from processed or previously manufactured materials. This definition shall include incidental storage, wholesale sales, and distribution of such products.
MARKET VALUE

MIXED USE DEVELOPMENT PLAN (MUDP)
See Section 3.4.A (Avon Village Center) for definition.
MOTOR VEHICLE
Any passenger motor vehicle (excluding buses), any truck not exceeding a 3/4-ton capacity, and any other motor vehicle which is primarily used for agriculture or for maintenance on the premises.
MOTOR VEHICLE SERVICE STATION (GAS STATION)
An establishment whose primary business is to provide petroleum products and/or service for motor vehicles. May include an associated convenience store and accessory electric vehicle charging infrastructure.
MOUNTED FIXTURE HEIGHT
See Section 5.10C (Lighting) for definition.
MULTIFAMILY DWELLING
A building designed and occupied exclusively as a residence for three or more groups of people living as families.
NATIVE PLANTS
A plant that is indigenous to the northeast and grows naturally in the region, without direct or indirect human intervention.
NONCONFORMING
(e.g., nonconforming use, building or structure, lot). Not conforming to the applicable requirements or provisions of these Regulations.
NURSERY
A building or site for the growing of flowers, plants, shrubs, or trees outdoors for commercial gain and which may include sale of such products and related garden merchandise as an accessory use. Garden supply stores and sales of equipment and implements are not included in this definition.
OFFICE, GENERAL
Use of a site for business, professional, or administrative offices, excluding medical offices.
OFFICE, MEDICAL
Use of a site for facilities which provide medical treatment, preventative care, and/or outpatient physical or mental health care on a routine basis, but which does not provide overnight care or serve as a base for an ambulance service. An urgent care center shall not be considered a medical office.
OPEN SPACE
Land areas retained for use as active or passive recreation areas or for resource protection in an essentially undeveloped state.
OUTDOOR STORAGE
The keeping, other than in a building, of any goods, materials, or merchandise on a parcel for any period of time.
OVERLAY DISTRICT
A type of zone/district that is placed over an existing base zone(s), which identifies special provisions in addition to those in the underlying base zone(s).
PASSIVE RECREATION
See Section 3.5A.3 (Ridgeline Protection) for definition.
PATIO
A level, surfaced, area adjacent to a building at finished grade, without permanent walls or a roof.
PERMEABLE PAVING OR SURFACES
A range of materials using sustainable techniques for permeable pavements with a base and subbase that allow the movement of stormwater through the surface and back to the groundwater. In addition to reducing site runoff, this effectively traps suspended solids and filters pollutants from entering the groundwater. Examples depending on construction and use may include roads, paths, lawns and lots that are subject to light vehicular traffic, such as car/parking lots, cycle-paths, service or emergency access lanes, road shoulders, and residential sidewalks and driveways.
PERSONAL SERVICE ESTABLISHMENT
A business that provides services of a personal, domestic nature to individuals or groups of individuals, including shops such as barbershops, beauty salons, tailoring establishments, shoe repair shops and other similar operations, rather than the sale of a product. "Day care" is not included in this definition.
PERVIOUS COVERAGE
The percentage of a lot not covered by completely impervious surfaces.
PERVIOUS SURFACE
Any material that permits absorption of storm water into the ground. May include pervious concrete, porous asphalt, paving stones or concrete or plastic-based pavers, among others.
PODS (PORTABLE ON DEMAND STORAGE STRUCTURES)
Temporary, transportable storage units designed and used primarily for temporary storage of building materials, household goods, personal items and other materials for use on a limited basis on residential property. Any "PODS" greater than 10 cubic yards (Cy) are subject to these Regulations. POD units greater than eight feet in height, eight feet in width or 16 feet in length (38 CY) are strictly prohibited.
PREMISES
All land comprising a lot, including all buildings, structures, and uses located on the lot.
PRINTING/PUBLISHING ESTABLISHMENTS
An establishment for the scanning, manipulating, printing, displaying, assembling, finishing, or otherwise managing images and/or documents in tangible or intangible form. This includes small printing businesses and larger industrial-scale establishments.
QUARRYING

RECREATIONAL FACILITY, INDOOR
An indoor facility, with or without seating for spectators, and providing accommodation for a variety of nonprofessional, individual or organized athletic activities.
RECREATIONAL VEHICLE
See Section 3.5D.2 (Floodplain Overlay District) for definition.
RESTAURANT
An establishment used principally for the preparation and service of food and beverages for consumption either on or off the premises.
RESTAURANT, CLASS I
A restaurant whose gross floor area is 1,500 square feet or less; seating capacity is 20 or less; food and beverages served on the premises are actually or expected to be consumed primarily off the premises; and no drive-through windows are provided.
RESTAURANT, CLASS II
A restaurant whose gross floor area is 2,000 square feet or less; seating capacity is 50 or less; and food and beverages served on the premises are actually or expected to be consumed primarily on the premises.
RESTAURANT, CLASS III
A restaurant that does not meet all of the criteria of either a Class I Restaurant or a Class II Restaurant.
RETAIL STORE
A building, or portion thereof, whose primary business is to sell products directly to consumers.
RETAINING WALL
A structure constructed and erected between lands of different elevations intended to stabilize the surfaces, prevent erosion and sedimentation and/or protect structures.
RIDGELINE

RIDGELINE, SETBACK AREA
See Section 3.5.A.3 (Ridgeline Protection) for definition.
RIGHT-OF-WAY
An area of land not on a lot that is dedicated for public or private use to accommodate pedestrian, bicycle, and vehicular movement and necessary public utility infrastructure (including, but not limited, to water lines, sewer lines, power lines, and gas lines).
SELECTIVE TIMBERING
See Section 3.5.A.3 (Ridgeline Protection) for definition.
SHOPPING CENTERS
Commercial building(s) totaling more than 20,000 square feet of gross building area, managed as a single operating unit, which includes retail stores, and which may include financial institutions, personal services, business and professional offices, and restaurants, but excluding major grocery stores. SIGN
Any natural or artificial structure, object, device, light, or display which is used to advertise, identify, or attract attention to any object, product, institution, organization, business, service, or location by any means, including, but not limited to, letter, number, banner, flag, insignia, device, designs, symbols, fixtures, colors, illumination, or logo, and which is situated so that it can be seen from a street. One flag or any one insignia of any governmental agency shall not be considered a sign within the purpose of this regulation.
SIGN, AREA
The smallest area which encompasses all letters, designs, symbols, logos including the advertising surface. The sign area shall include any background material if such material is designed to be an integral part of the sign because of its texture, color or building material.
SIGN, BUSINESS PROMOTION
A sign for sales, special promotions, or new business announcements.

SIGN, WALL
A sign which is attached to any surface or plane of a building, and which does not extend beyond the perimeter of the building or above the roof line.

SIGN, WINDOW
A sign applied or attached to the exterior or interior of a window or located in such a manner within a building that it is visible from the exterior of the building through a window. These signs are non-illuminated, non-flashing, non-moving signs, located within a window of a commercially zoned, or commercially used building or establishment. Merchandise for sale on the premises that is located in a window display shall not be considered a sign. The types of window signs are: window signs containing any text regarding the service or product sold, leased, used, or rented by the commercial establishment or window sign or window decoration not containing any text regarding any product or commercial product intended primarily to obstruct view from the exterior into the commercial establishment for a valid, lawful purpose.

SMALL WIND ENERGY SYSTEM (WINDMILL)
A wind energy conversion system consisting of a wind turbine, a tower, and associated control or conversion of electronics, which has a rated nameplate capacity of not more than 20 kW and which is intended to primarily reduce on-site consumption of utility power. The maximum height of such shall be the vertical distance from the average finished ground level at the main tower edges to the highest point of the structure, including any blade, lighting rod, or antenna. If a blade extends above the tower at any point in its arc, then the tip of the rotor blade at its highest point, or blade-tip height shall be used.
SPECIAL FLOOD HAZARD AREA (SFHA)

STORY
That part of a building between any floor and the ceiling or roof above it. Basements shall be included in determining the number of stories in a building if the ceiling of the basement is three feet or more above the average ground level. Attics shall not be deemed to be separate stories.
STORY, HALF
That portion of a building between a gable, hip, or gambrel roof and the floor below provided that the floor below is not more than two feet below the intersection of the roof and the wall. (See Graphic)

Any right-of-way used for public travel, or any proposed way shown on a recorded subdivision approved by the Commission.

A boundary line of any public or private street.

TEMPORARY SPECIAL EVENTS
A temporary accessory use of not more than three consecutive days' duration for any one occurrence held outdoors in an open area. Such event may include a fair, carnival, festival, flea market, automobile show, arts and crafts show, or sidewalk sale which is used as a promotional device to advertise an established commercial use and/or as a fund-raising event for a nonprofit organization and may be expected to attract more than 300 persons during the event. Such an event may include temporary retail food vendors; retail vendors from both within and outside the project; and exhibitors of arts, crafts, jewelry, farm produce, and other retail products. Special events shall not include those activities which are merely an extension of the principal use itself, such as a school graduation or athletic competition.
TRAILER
Any vehicle or structure, capable of moving, or being moved, over streets and highways on its own wheels or on flatbeds or other carriers, that is designed or utilized to: provide temporary or permanent quarters for the conduct of a business, profession, trade, or occupation; serve as a carrier of new or used goods, products, or equipment; or be used as a selling, advertising, or display device.

TWO FAMILY OR DUPLEX DWELLING
A building designed and occupied exclusively as a residence for two groups of people living as families, independently of each other.
URGENT CARE CENTER
A medical walk-in clinic focused on the delivery of medical care for minor illnesses and injuries in an ambulatory medical facility.
USE, ACCESSORY
A use customarily incidental and subordinate to the principal use of a structure or lot; or a use, not the principal use, that is located on the same lot as the principal structure.
USE, PRINCIPAL
The main or primary purpose for which a structure or lot is designed, arranged, or intended, or for which it may be used, occupied, or maintained under these Regulations.
VARIANCE
A relaxation of the terms of the Zoning Regulations where such variance will be in harmony with the general purpose and intent of the Regulations and with due consideration for conserving the public health, safety, convenience, welfare, and property values solely with respect to a parcel of land where, owing to conditions especially affecting such a parcel but not affecting generally the district in which it is situated, a literal enforcement of such bylaws, ordinances or Regulations would result in exceptional difficulty or unusual hardship so that substantial justice will be done and the public safety and welfare secured.

WATERCOURSE
Rivers, streams, brooks, waterways, lakes, ponds, marshes, swamps, bogs, and all other bodies of water (natural or artificial), which are contained within, flow through, or border upon the Town of Avon or any portion thereof.
WETLAND
Land, including submerged land, which consists of any of the soil types designated as poorly drained, very poorly drained, alluvial, or flood plain by the U.S. Department of Agriculture Soil Conservation Service.
WHOLESALE
The sale of goods or merchandise to retailers; to industrial, commercial, institutional, or other professional business users; or to other wholesalers and related subordinated services.
WIND FACILITY
A facility powered by wind located at a residential property that will consume more than 50% of the electricity generated by the facility.
WIND FACILITY EQUIPMENT
All equipment, machinery, and structures utilized in connection with the conversion of wind to electricity. This includes, but is not limited to, transmission lines and support structures, storage, collection and supply equipment, substations, transformers, service, and access roads, and one or more wind turbines.
WIND TURBINE
A device that converts kinetic wind energy into rotational energy that drives an electrical generator. A wind turbine typically consists of a tower, accelerator platform or nacelle body, and one or more rotors, with two or more blades for each rotor.
WORK/LIVE SPACE
A space or unit within a building which is used jointly for commercial and residential purposes where the residential use of the space or unit is secondary or accessory to the primary use as a place of work.
YARD, FRONT
A space extending across the full width of the lot between the street line and a parallel line set back a distance equal to the front yard requirement. Lots with frontage on more than one street shall have a front yard provided on each street. Rear lots shall have the front yard requirement measured from that lot line which most closely parallels the street from which the rear lot gains access.
YARD, REAR
A space extending across the full width of the lot between the rear lot line and a parallel line set back a distance equal to the rear yard requirement. On a lot with no rear yard, the side yard shall extend to the opposite lot line.
YARD, SIDE
A space extending from the front yard to the rear yard between the side lot line and a parallel line set back a distance equal to the side yard requirement. On a lot with no rear yard, the side yard shall extend to the opposite lot line.

ZONE
