ARTICLE VI

OFF-STREET LOADING FACILITIES

Sec. 21-406.- Location of berths; screening.

(a)

All loading berths shall be located on the same zoning Lot as the use served. All loading berths for new construction shall be completely screened from the right-of-way and adjacent properties by building walls, a uniformly painted solid fence, wall, or structural gates or door, or any combination thereof, or landscaping not less than eight feet in height.

(b)

All existing loading berths shall be screened from the public right-of-way and adjacent properties as follows:

(1)

Such screening may include structural gates or doors; nonstructural screens, fencing, walls, gates or doors; or landscaping a minimum of eight feet in height.

(2)

The owner, manager or operator of each hotel or condominium or apartment building currently failing to provide the appropriate screening, shall, within 90 days of the effective date of this section, submit an application and appropriate plans to the Architectural Review Board providing for compliance with this section.

(3)

Installation/construction and/or implementation of the approved plans, complying with this Section, must be complete no later than 90 days after the approval of such plans by the Architectural Review Board.

(c)

All loading berth gates or doors, whether structural or non-structural, shall remain closed at all times except as necessary for active delivery or Garbage and Trash removal.

(d)

No permitted or required loading berth shall be located within 30 feet of the nearest point of intersection of any two Streets.

(e)

No loading berth shall be located in a required front Setback area. Any loading berth located in a required side Setback area may be open to the sky, provided it is effectively screened from the abutting Lot.

Sec. 21-407. - Size of berths.

Unless otherwise specified in this chapter, an off-street loading berth shall be at least 12 feet in width by at least 30 feet in length, exclusive of aisle and maneuvering space, and shall have a vertical clearance of at least 15 feet.

Sec. 21-408. - Access.

Each off-street loading berth shall be designed with appropriate means of vehicular access in a manner which will least interfere with traffic movement, and shall be subject to approval by the Building Department.

Sec. 21-409. - Surfacing of open berths.

All open off-street loading berths shall be surfaced with a dustless all-weather material capable of bearing a live load of 200 pounds per square foot.

Sec. 21-410. - Use of loading and parking facilities for vehicle repair, service.

No motor vehicle repair work or service of any kind shall be permitted in conjunction with loading or parking facilities.

Sec. 21-411. - Space allocated for off-street loading use not to be used to satisfy parking facilities requirements.

Space allocated to any off-street loading use shall not, while so allocated, be used to satisfy the space requirements for any off-street parking facilities or portions thereof.

Sec. 21-412. - Number of berths.

(a)

Hotels. For Buildings containing 10,000 to 200,000 square feet of gross floor area, one off-street loading berth shall be provided, plus one additional loading berth for each additional 200,000 square feet of gross floor area or fraction thereof.

(b)

Multiple-Family Dwellings. For Buildings containing 20,000 to 200,000 square feet of gross floor area, one off-street loading berth shall be provided, plus one additional loading berth for each additional 200,000 square feet of gross floor area or fraction thereof.
