ARTICLE XIII

CHANGES AND AMENDMENTS

Sec. 1301.- Amendment procedure.

(a)

The mayor and board of aldermen of the city may from time to time on their own motions or on petition, after at least fifteen (15) days' public notice and hearings as provided by law, amend, supplement or change, modify or repeal the boundaries or regulations herein as subsequently established, after submitting same to the city planning commission for its recommendations and reports.

(b)

However, in cases of a protest against such change, signed by the owners of twenty (20) percent or more, either of the area of the lots included in such proposed change, or of those immediately adjacent to the rear thereof, extending one hundred sixty (160) feet therefrom or of those directly opposite thereto, extending one hundred sixty (160) feet from the street frontage of such opposite lots, such amendment shall not become effective except by the favorable vote of two-thirds of all the members of the mayor and board of aldermen of the city.
