LEGAL STATUS

PROVISIONS AND EFFECTIVE DATE

§ 154.390 SEVERABILITY.

   It is the legislative intent of the Town Council in adopting this chapter that all provisions and sections thereof shall be liberally construed to protect and preserve the peace, health, safety and general welfare of the inhabitants of Beech Mountain, and, further, that should any provision, portion, section or subsection of this chapter be held to be invalid by a court of competent jurisdiction such ruling shall not be construed as affecting the validity of any of the remaining provisions, portions, sections or subsections; it being the intent of the Town Council that this chapter shall stand, notwithstanding the invalidity of any provision or section, or part thereof.

§ 154.391 CONFLICT WITH OTHER LAWS.

   When provisions of this chapter require a greater width or size of yards or courts, or require a lower height of a building, or fewer number of stories, or require a greater percentage of a lot to be left unoccupied, or impose other higher standards than are required in any other statute or local ordinance or regulation, provisions of this chapter shall govern. When the provisions of any other statute or local ordinance or regulation require a greater width or size of yards or courts, or require a lower height of a building or a fewer number of stories, or require a greater percentage of a lot to be left unoccupied, or impose other higher standards than are required by the provisions made by this chapter, the provisions of that statute or local ordinance or regulation shall govern.

§ 154.392 EFFECTIVE DATE.

   This chapter shall take effect and be in force on October 12, 1982.
