Editor's note— Ord. No. O-43-06b, adopted Oct. 19, 2006 repealed Article XII, §§ 78-317—78-321, in its entirety. Section 39-1201 of said ordinance enacted new provisions to read as herein set out. Prior to amendment, Article XII pertained to administration, enforcement and remedies and derived from the original Code 2004, §§ 39-1201, 39-1202, 39-1202.1, 39-1203 and 39-1204.

(a)
No building or other structure shall be erected, moved, added to or structurally altered without a building permit issued by the city. Structurally altered is defined as any change in either the supporting members of a building such as load bearing walls, columns, beams or girders or in the roof and exterior walls.
(b)
Work exempt from needing a building permit. Building permits shall not be required for the following:
(1)
Ordinary maintenance and repairs to existing structures.
(2)
Fences not more than six feet in height.
(3)
Retaining walls not more than four feet in height, measured from the bottom of the footing to the top of the wall.
(4)
Patios not attached to a structure.
(5)
Yard water features.
(6)
Playsets.
(7)
Dog houses.
*Note: Electrical, plumbing and grading permits may be required.
(c)
No building permit shall be issued except in conformance with the provisions of this chapter. The planning and zoning commission must approve zoning compliance prior to issuance of any building permit in the following circumstances:
(1)
Construction in any residential district, which partitions a dwelling into two or more non-interconnected spaces.
(2)
Construction in any residential district resulting in more than one kitchen in a dwelling or any kitchen in an accessory structure.
(d)
All applications for building permits shall be accompanied by the following:
(1)
Estimated cost of construction.
(2)
Plans, in duplicate, drawn to scale.
(3)
For new construction, additions and accessory structures, a survey which has been signed by a registered surveyor shall be submitted. On that survey, the applicant shall show the following
a.
The actual dimensions of the lot to be built upon;
b.
The sizes and the locations on the lot of any existing buildings or structures, with all setback measurements noted;
c.
The shape, size, height, use and the location on the lot, with setback measurements noted, of the building or structure to be erected, moved, added to or structurally altered
d.
Percentage of lot coverage of all existing and proposed buildings or structures;
e.
For those houses on septic, the location of the septic tank and drain fields on the lot, noting setback measurements; and
f.
Such other information as may be necessary to provide for the enforcement of this article.
4.
A health department permit for new homes and additions or renovations in the immediate vicinity of the septic tank and drain field.
Note: Applicants are advised to consult with city hall staff when preparing to submit a building permit application.
(e)
For properties where a building permit is required, survey pins shall be visible upon the lot for the purpose of measuring setbacks. Such pins shall be visible throughout the construction project and at the completion of the project for the purpose of verifying setback compliance.
