SECTION 21
21 Access and Streets
§ 21-21.1 General.
Each development shall have access to a street. Such access shall be designed and constructed for and shall be evaluated by the Board as to adequacy for entering and exiting vehicles and for emergency vehicles. Public and private streets shall be provided in accordance with subsections 21-21.2 and 21-21.3, respectively, and shall be evaluated by the Board as to capacity and safety of operation. No plat involving any street(s) requiring additional right-of-way width shall be approved unless such additional right-of-way width, along one or both sides of the street(s), as applicable, shall be deeded to the Township or other appropriate government agency. [Ord. #585, § 509A) |
§ 21-21.2 Public Streets.

a.
All lots shall have frontage on a public street unless development occurs under the PRD provisions of this chapter or unless specifically provided for elsewhere in this chapter.

b.
All public streets shall be located in a right-of-way dedicated to the Township and having the following minimum widths, measured from lot line to lot line, unless another width is specifically recommended in an adopted element of the Master Plan or on an adopted Official Map for the Township:
1.
Arterial streets: 60 feet.
2.
All other streets: 50 feet.
Developments that adjoin or include existing public streets which do not conform to the above required right-of-way widths shall dedicate the required additional width along one or both sides of the street. If development is proposed along one side of the street only, then 1/2 of the required extra width shall be dedicated. |
§ 21-21.3 Private Streets.

a.
Development under the PRD and Natural Resource Conservation Development Overlay Zone provisions of this chapter or where specifically permitted elsewhere in this chapter may include private streets.

b.
The applicant shall demonstrate, prior to final approval, a means to maintain the streets. The Board shall require a maintenance agreement. (See Section 21-58A.) This agreement shall include the Township's right to enter the premises to make repairs and/or conduct other necessary maintenance in accordance with the provisions of Subsection 21-58A.4, Paragraph c. The cost for such repairs and/or maintenance by the Township shall be paid by the property owner(s) and shall include all legal, administrative, clerical, planning and engineering costs associated with the work.

§ 21-21.4 Clear Sight Triangle.

Clear-sight triangles shall be provided at all street intersections. Within such triangles, no vision-obstructing objects shall be permitted which exceeds a height of 30 inches above the elevation of the intersecting street. (See Subsection 21-37.1 for dimensions.)
§ 21-21.5 Access to Nonresidential Uses.

Private access to nonresidential uses shall not be through a residentially zoned lot or lots, except that as part of site plan review, the Planning Board may permit emergency access to nonresidential uses through a residential lot or lots.
