ZONING DISTRICTS ESTABLISHED; ZONING MAP
(a)
The establishment of zoning districts is controlled by land use as depicted on the Town of Beverly Beach Future Land Use Map 2035. Zoning designations must correspond with the underlying land use designation, i.e., a residential zoning designation must have an underlying residential land use designation, commercial zoning must have an underlying commercial land use designation, etc.
(b)
For the purposes of protecting public health, safety and welfare of the residents of the town, the town's land area is hereby structured into the following zoning districts:

The town is hereby divided into zoning districts as listed and described in this division and as shown on the official zoning district map, for the purpose of:
(1)
Providing a residential environment free of incompatible uses, safe from natural and manmade hazards.
(2)
Promoting, where possible, planned residential and commercial areas in appropriate locations, with appropriate standards and minimum service cost to local government.
(3)
Providing a level of flexibility of control sufficient to promote innovation and creativity in community development, to encourage maximum commercial profitability and maximum living comfort and convenience at lowest cost.

(a)
The official zoning map of the town, with all notations, references and other information shown thereon, is hereby made a part of this article. The official zoning map is hereby made a public record and shall be kept permanently in the office of the town clerk, where the map will be accessible to the general public.
(b)
The official zoning map shall be identified by the signature of the mayor, attested by the town clerk, signed and dated at the time of adoption of the ordinance from which this section is derived.
(c)
If, in accordance with the provisions of this article, changes are made in the district boundaries or other information portrayed on the official zoning map, changes shall be made on the map promptly after the amendment has been approved by the town commission, together with a numerical entry on the official zoning map referring to the record on file of the official action making the change, and a date notation on the map. Unauthorized alterations of the official zoning map shall be considered a violation of this article and subject to penalties as prescribed under section 26-753.
(d)
If the official zoning map becomes damaged, destroyed, lost, or difficult to interpret because of the nature or number of changes and additions, the town commission may by ordinance adopt a new official zoning map which shall supersede the prior official zoning map.

Where uncertainty exists with respect to the boundaries of any of the districts established by this division as shown on the official zoning map, the following rules shall apply:
(1)
Unless otherwise indicated, the district boundaries are indicated as approximately following property lines, land lot lines, centerlines of streets, highways, alleys or railroads, shorelines of streams, reservoirs, or other bodies of water, or civil boundaries, and they shall be construed to follow such lines.
(2)
Where a district boundary line as appearing on the official zoning map divides a lot which is in single ownership at the time of enactment of the ordinance from which this article is derived, the use classification of a larger portion may be extended to the remainder by the zoning administrator without recourse to the amendment procedure.
(3)
In case the exact location of a boundary cannot be determined by the methods set forth in this section, the planning and zoning board shall, upon application, determine the location of the boundary.
