CHAPTER 10

- OFF STREET PARKING AND LOADING REQUIREMENTS

11-10-1: - APPLICABILITY OF REQUIREMENTS:

The off street parking and off street loading facilities, whether they are principal uses, accessory uses, or a minimum requirement of the initiation, enlargement or change of use, shall meet the requirements of this chapter as follows:

A.

Buildings, Structures and Uses: For all buildings and structures erected and all uses of land established after the effective date hereof, parking and loading facilities shall be provided as required by the applicable use unit.

B.

Increase in Intensity: When the intensity of use of any building, structure or premises shall be increased through the addition of dwelling units, floor area, seating capacity or other units of measurement, as specified herein for required parking or loading facilities, parking and loading facilities as required herein shall be provided for such increase in intensity of use.

C.

New or Nonconforming Use: Whenever the existing use of a building or structure shall hereafter be changed to a new use, parking and loading facilities shall be provided as required for such new use. However, if the existing use is nonconforming as to parking requirements, then parking requirements for a change in use shall be governed by section 11-11-8 of this title.

D.

Accessory Facilities: Accessory off street parking and loading facilities in existence on the effective date hereof and located on the same lot as the building or use served shall not hereafter be reduced below, or if already less than, shall not be further reduced below the requirements for a similar new building or use under the provisions of this title.

11-10-2: - GENERAL REQUIREMENTS:

A.

Space Required: Off street parking and off street loading facilities shall not occupy required livability space. Space allocated to any required off street loading berth shall not be used to satisfy the space requirements for any off street parking facilities. Space allocated to any off street parking shall not be used to satisfy the space requirements for any off street loading facilities.

B.

RM District: Within the front and exterior side yards in the RM districts, not more than one vehicle shall be parked for each six hundred (600) square feet of area contained in the front or exterior side yards.

C.

Use of Spaces and Berths: Required off street parking spaces and required off street loading berths shall not be used for the storage, sale, dismantling or servicing of any vehicle, equipment, materials or supplies.

D.

Location: Required off street parking spaces and required off street loading berths shall be located on the lot containing the use for which the required spaces or berths are to be provided.

E.

Enclosed Parking and Loading Areas: Required enclosed off street parking and loading areas shall meet the bulk and area requirements of the use district in which located, except that enclosed off street parking and loading areas which are required shall not be included in the computation of permitted floor area.

F.

Capacity of Area: The capacity of an off street parking area shall be the number of parking spaces, having minimum required dimensions, that are located thereon in such a manner that each space can be entered without passing through another space, except in an RE or RS district, where access may be obtained through another parking space.

G.

Surfacing: Required off street parking surfacing shall be completed prior to the initiation of the use.

H.

Number of Spaces: The number of parking spaces shall not exceed fifteen percent (15%) of the minimum number required by this title, unless otherwise approved for a special exception in accordance with the substantive and procedural standards therefor.

11-10-3: - SETBACKS:

For other than RS Single-Family Residential or RD Duplex use:

A.

Off street loading areas shall not be located within fifty feet (50') of any abutting property which is within an R district unless it is wholly within an enclosed building or screened on all sides abutting the R district by a screening wall or fence. Any use which abuts residential development and is accessed between the hours of ten o'clock (10:00) p.m. and seven o'clock (7:00) a.m. shall be screened by the erection and maintenance of an eight foot (8') screening wall made of masonry, masonry-like product, stucco, stone, concrete tilt-up panels, or some combination thereof. The property owner may appeal the interpretation of the screening requirement to a specific building project or may request, in writing and with showing of sufficient good cause, that the city council reduce or waive the requirement altogether.

B.

Unenclosed off street parking and loading areas shall be set back from abutting streets as set forth in table 1 of this subsection.

11-10-4: - DESIGN STANDARDS FOR OFF STREET PARKING AREAS:

A.

Design and Dimension: The design and dimensions of off street parking areas shall be in accordance with the provisions of the following tables of minimum dimensions.

B.

Spaces Marked: Off street parking spaces shall be clearly marked according to the standard stall layout as shown in figure 1 or 2 of this subsection. Parking spaces abutting an adjoining property line or street right-of-way shall be provided with wheel guards or bumper guards so located that no part of a normally parked vehicle will extend beyond the property line. When wheel guards are used, they shall be centered at least 2.5 feet from the property line for ninety degree (90°) parking, 2.3 feet for sixty degree (60°) parking and 2.0 feet for forty-five degree (45°) parking, and 2.5 feet of the parking space(s) beyond the wheel stop(s) may be considered part of the required stall length if that area is unobstructed and not part of another parking space or access drive.

Note:

1  Dimensions for other angles may be approved by the planning commission upon site plan approval.

C.

Pathways: Pedestrian access to buildings shall be provided from rights-of-way and parking areas by means of a pathway leading to at least one public entrance. Such pathway shall be clear of any and all obstructions and any parking spaces shall be designed so as not to permit any portion of a vehicle to obstruct the sidewalk. Where curbs exist along such pathways, as between a parking lot surface and sidewalks surface, inclined curb approaches or curb cuts having a gradient of not more than one foot (1') in twelve feet (12') and width of not less than four feet (4') shall be provided for access by wheelchair.

D.

Level Parking Spaces: A parking lot servicing each entrance pathway shall have a number of level parking spaces, as set forth in the following table, identified by above grade signs as being reserved for physically handicapped persons; provided that a maximum of two (2) handicapped spaces shall be required for industrial uses in industrial districts. Each parking space so reserved shall not be less than twelve feet (12') in width.

Parking spaces for the physically handicapped shall be located as close as possible to elevators, ramps, walkways and entrances. Parking spaces for the physically handicapped shall be located so that such persons are not compelled to wheel or to walk behind parked cars to reach entrances, ramps, walkways and elevators.

E.

Compact Car Allowance: Twenty-five percent (25%) of the total required off street parking spaces may be a minimum of seven and one-half feet (7½') in width and fifteen feet (15') in length exclusive of access drives or aisles. Such space shall have a vertical clearance of at least six feet six inches (6'6").

F.

Access: Each required parking space shall be accessible from a street without passing through another required space, except in the RE or RS districts.

G.

Lighting: Lighting used to illuminate an off street parking area shall be so arranged as to direct the light away from properties within an R district which do not contain uses for which the parking is being provided. Shielding of such light shall be designed so as to prevent the light producing element of the light fixture from being visible to a person standing in an R district.

H.

Surfacing: Unenclosed off street parking areas shall be surfaced with an all weather material of asphalt or concrete, designed and constructed in accordance with the engineering design standards for off street drives and parking areas. In all RE and RS zoning districts, such parking areas surfaced with an all weather material shall not cover more than the following portion of the required front yard:

I.

Screening: Unenclosed off street parking area which are principal uses shall be screened by the erection of a screening wall or fence on the lot line or lines in common with an R district. Any use which abuts residential development and is accessed between the hours of ten o'clock (10:00) p.m. and seven o'clock (7:00) a.m. shall be screened by the erection and maintenance of an eight foot (8') screening wall made of masonry, masonry-like product, stucco, stone, concrete tilt-up panels, or some combination thereof.

Unenclosed off street parking areas, containing six (6) or more spaces, which are accessory to uses not required to provide screening shall be screened by the erection of a screening wall or fence on the lot line or lines in common with an RE or RS district; provided, that if the parking area is located more than fifty feet (50') from the RE or RS lot line or lines, the screening requirement shall not apply. The property owner may appeal the interpretation of the screening requirement to a specific building project or may request, in writing and with showing of sufficient good cause, that the city council reduce or waive the requirement altogether.

11-10-5: - DESIGN STANDARDS FOR OFF STREET LOADING AREAS:

A.

Berth Size: Unless otherwise specified, a required off street loading berth shall be at least ten feet (10') in width, thirty feet (30') in length, exclusive of aisles, and shall have a vertical clearance of at least fourteen feet (14').

B.

Access: Required off street loading berths shall be provided access to and from a street or alley by an access drive of at least ten feet (10') in width designed to permit convenient access by semitrailer trucks.

C.

Surfacing: Unenclosed off street loading areas shall be surfaced with an all weather material.

D.

Screening: Unenclosed off street loading berths shall not be located within fifty feet (50') of any property in an R district unless it is screened on all sides abutting the R district by a screening wall or fence. Any use which abuts residential development and is accessed between the hours of ten o'clock (10:00) p.m. and seven o'clock (7:00) a.m. shall be screened by the erection and maintenance of an eight foot (8') screening wall made of masonry, masonry-like product, stucco, stone, concrete tilt-up panels, or some combination thereof. E.
