ARTICLE 5

ZONING DISTRICTS

5.1 - ZONING DISTRICTS ESTABLISHED

The zoning districts set forth in this article are hereby established for the purpose of classifying all land within the territorial jurisdiction of the Town of Boiling Springs in furtherance of achieving the goals of the land use plan and to provide for the health, safety and general welfare of the public.

5.2 - TYPES OF ZONING DISTRICTS

Zoning districts shall be classified into the following types:


Sec. 5.2.1. - Base zoning districts.

Base zoning districts are intended to establish the general character of an area through the regulation of uses, lot sizes, density and other development standards unique to each district. Base districts are further divided into the following classes:

(A)

Residential districts. Residential districts are intended to provide for the use and development of land for household living, while also permitting limited nonresidential uses, such as civic and institutional uses, that may be developed and used in a manner that is compatible with the residential character of these areas.

(B)

Nonresidential districts. Nonresidential districts are intended to provide for the use and development of land for commercial, office, civic, institutional, industrial and similar uses of land in areas that are suited for more intensive land uses and development.

Sec. 5.2.2. - Overlay districts.

Overlay districts are intended for use as a method of implementing additional regulatory provisions that address situations that are unique to portions of the town's jurisdiction, irrespective of the boundaries of the base districts. These districts are also intended to facilitate the use and development of land for a unique purpose or in a unique manner, where such use or development would not be appropriate throughout a particular Base district. Where assigned, overlay districts shall apply in addition to the base district, conditional district or Special Purpose District that is used to classify the land.

Sec. 5.2.3. - Conditional districts.

(A)

Conditional districts are zoning districts in which individual development standards may be proposed to address unique situations where the application of a general base zoning district may not be appropriate due to the full range of uses permitted in the district, the density or intensity of development that would be allowed, or similar circumstances. Conditional zoning may also be utilized to propose innovative development patterns that are not contemplated by the general standards of the Ordinance.

(B)

Only a property owner may propose a zoning map amendment to a conditional district. Such proposal may be either based upon a parallel conditional district where the general standards of such district are applicable unless modified by the proposed conditions of the district, or, it may be a unique conditional district where all use and development standards are established for the district unless a general or analogous standard is made applicable in the conditions.

Sec. 5.3.1. - Residential districts.

(A)

Residential district (R-20). The R-20 district is established as a district in which the principal use of the land is for medium density residential or agricultural purposes and to provide and protect low density residential areas for those desiring that type of environment. The R-20 district also permits associated public and private facilities typically associated with such districts.

(B)

Residential district (R-15). The R-15 district is established as a district in which the principal use of land is for medium density residential uses and associated public and private facilities typically associated with such districts.

(C)

Residential district—Townhomes (R-15TH). The R-15TH residential district is established as a district in which the principal use of land is for townhouses and townhouse development as defined herein.

(D)

Residential district (R-10). The R-10 district is a district in which the principal use of land is for medium density, one, two, and multi-family dwellings and associated public and private facilities typically associated with such districts.

Sec. 5.3.2. - Nonresidential districts.

(A)

Institutional district (I-1). The I-1 institutional district is established primarily to accommodate institutional uses and facilities customarily associated with such institutional uses.

(B)

Office and consumer services district (O & CS). The O & CS office and consumer services district is established as a district in which the principal use of land is for business and general offices and consumer service facilities catering to the general public but excluding retail sales facilities.

(C)

Central business district (B-1). The B-1 business district is established as a district in which the principal use of land is to provide for general retail and consumer services for the community in a central business location.

(D)

General business district (B-2). The B-2 district is established as a district in which retail and consumer services are provided to serve the town and surrounding area.

(E)

Manufacturing district (M-1). The M-1 manufacturing district is established as a district in which the principal use of land is for manufacturing, industrial, and warehousing uses located on large tracts buffered from adjoining residential neighborhoods.

Sec. 5.4.1. - Downtown design overlay district (DDO).

The downtown design overlay is established to further the implementation of the downtown master plan and to maintain a high-quality aesthetic environment in Downtown Boiling Springs.

Sec. 5.4.2. - Airport overlay district (AO).

The airport overlay district is established to promote health, safety and general welfare by preventing the creation of hazards to safe aerial navigation in the vicinity of the Shelby Municipal Airport and thereby preserve the utility of the airport and the public investment therein.

Sec. 5.4.3. - Watershed overlay (WO).

The watershed overlay district is established to comply with statutory mandates for the protection of water quality within drinking-water supply watersheds by imposing limitations on certain uses, requiring stormwater controls and limiting development density.

Sec. 5.4.4. - Flood damage prevention overlay (FO).

The flood damage prevention overlay district is established to promote the safety of the community through the enactment of regulatory standards within flood hazard areas identified through the flood insurance rate study program.

Sec. 5.4.5. - Manufactured home overlay district (MHO).

The manufactured home overlay district is established to permit the planned use of manufactured homes in the Town of Boiling Springs.

Sec. 5.5.1. - Parallel conditional districts.

A parallel conditional district directly corresponding to, and having the same intent and basic regulations as each base zoning district is established. Such districts shall be differentiated from the base district by the notation of CD (conditional district). In addition to the "CD" designation, each adopted conditional district shall be assigned a unique identifier that is indexed to the case number of the zoning map amendment by which it was established to ensure that all associated conditions and restrictions unique to that district are maintained for future reference.

Sec. 5.5.2. - Special purpose conditional districts.

Applicants may propose the establishment of a special purpose conditional district, which is hereby established as an option in addition to the parallel conditional districts. Such special purpose conditional districts shall require a concept plan and shall fully address all use and development standards contained in this ordinance in the submitted concept plan and accompanying written conditions. No special purpose conditional district may be established unless it proposed to apply to a minimum of 20 acres of contiguous land. Upon approval, the district shall be noted on the zoning map as "SPCD" and assigned a unique identifier that is indexed to the case number of the zoning map amendment by which it was established to ensure that all associated conditions and restrictions unique to that district are maintained for future reference.
