DIMENSIONAL AND DENSITY STANDARDS
Table 6-1 on the following page establishes the dimensional standards for each of the zoning districts. The following is a key to the notes contained in the table:
(A)
On corner lots, five feet shall be added to the street side setback.
(B)
No side yard is required in the B-1 district, except that where adjoining an R-20, R-15, R-15TH, or R-10 district, a side yard of 20 feet shall be required.
(C)
No rear yard is required in the B-1 district, except that where adjoining an R-20, R-15, R-15TH, or R-10 district, a rear yard of 20 feet shall be required.
(D)
Where public water and sewer are not available, additional lot area may be required to meet the minimum requirements to accommodate onsite utilities per Cleveland County Health Department standards.
(E)
No parking and /or driveways shall be permitted in any front setback that is less than 20 feet in a townhome / attached single-family development. Parking and driveway access shall be provided in the rear.
(F)
Lots having frontage on NC 150, SR 1003, or SR 1161 and an intersecting street shall provide the minimum required front setback on both street frontages. This shall not apply to the B-1 district.

Each lot shall contain the minimum area for the zoning district, use of the lot, and proposed density, if applicable, as established in section 6.2.
The area of a lot is equal to the area contained within all established property lines. In no case shall portions of a platted lot that extend into a street right-of-way be included in the calculation of lot area.
Lot width is the horizontal distance between the side lot lines, measured at right angles to the lot depth at the point of the front building setback.
Setbacks shall be measured from the front, side and rear property lines to the point of the structure nearest to the applicable property line.
For dwellings in residential districts, where lots located on either side of a center lot are improved with dwellings having a front yard setback of less than 25 feet, and the structures are no more than 200 feet apart, the required setback of the center lot shall be the average of the setback of the two adjacent main buildings.
(A)
Unenclosed porches, attached carports, balconies or decks which do not project into any required yard more than three feet; and
(B)
Chimneys, flues, eaves, roof overhangs, window sills and bay windows which do not project into any required yard more than three feet; and
(C)
Patios, drives, walkways, if no portion of the same extends more than 12 inches off the ground.
(D)
Any structure that is a mere appendage to a building such as a flagpole or fountain.
(E)
Residential handicap ramp shall be permitted to encroach into a required street and/or side setback up to 50 percent.
The height of a structure shall be measured from the finished grade adjacent to the structure at its central point along the front building line to the highest point of the coping of a flat roof or to the mean height level between the eaves and ridge of a pitched roof.
The height limitations of this article shall not apply to public buildings, churches, temples, schools, hospitals, belfries, cupolas and domes not intended for residential purposes, or to monuments, water towers, observation towers, power and wireless communication transmission towers, flag poles and similar structures provided such structures meet the required North Carolina Building Code.
