ARTICLE 13

AIRPORT DISTRICT

SECTION 1300 AIRPORT (A)

  1. A.
    The purpose of this article is to provide a specific zoning classification for aviation, industrial, service and commercial uses related to or compatible with Airport operations. In addition, it is the intent of the Airport zone to ensure compatibility between airport facilities and operations and the surrounding land uses. It is furthermore the intent of this Article that the Airport notify the Commission of any proposed development or construction within this zoning district in order to determine the type of review and its associated impact.

Section 1300.1 Principally Permitted And Accessory Uses

  1. A.
    Table 5-6, in Section 505.5, identifies the principally permitted and accessory uses within the A district.

Section 1300.2 Conditional Uses And Criteria

  1. A.
    Table 5-6, in Section 505.5, identifies those uses which are conditionally permitted within the A district,  subject to the approval and qualifications of the Board of Adjustment provided: a) the activity is an integral and subordinate function of an Airport district or zone but not directly related to an Airport; b) the proposed activity will further add to, not detract from, the creation of a multi-purpose transportation modal system, and c) the arrangement of uses, buildings or structures will be mutually compatible with the organization of permitted and accessory uses to be protected in the district.

Section 1300.3 Intensity

  1. A.
    There are no maximum building intensities for Airport related uses. Any industrial, commercial, recreational and office uses not related to the Airport have a maximum building intensity and other dimensional standards based upon the corresponding I-1, C-2 and R zoning district requirements.

Section 1300.4 Minimum Size

  1. A.
    The minimum size of an Airport district is fifty (50) acres.

Section 1300.5 Minimum Standards

  1. A.
    See ARTICLE 31 for Performance Standards.  Site Plan review required for all non-Airport related uses (See ARTICLE 30.)

Section 1300.6 Kentucky Airport Zoning Commission

  1. A.
    Airports are also under the jurisdiction of the Kentucky Airport Zoning Commission as authorized in Chapter 183 of the Kentucky Revised Statues as it pertains to the safe and proper use of an airport.

Section 1300.7 Specific Use Standards

  1. A.
     Freight Terminal
    1. 1.
      The following standards apply to the City of Florence
      1. a.
        The use shall not be permitted if an adjoining property is residentially or agriculturally zoned.
      2. b.
        Street frontage buffers shall contain:
        1. 1.
          All required plantings per SECTION 3620 of the Boone County Zoning Regulations.
        2. 2.
          Staggered, undulating berms, which range from three and a half (3.5) and four (4) feet tall at crest, throughout the buffer.
      3. c.
        Access shall only be to a subcollector, collector, or arterial street.
      4. d.
        All trucks, truck tractors, trailers, or semitrailers shall be operable and road ready.
      5. e.
        Trucks or truck tractors shall not idle while parked.
      6. f.
        Refrigerated trailers or semitrailers shall not be in operation unless they are entering or exiting the freight terminal.
      7. g.
        The storage of freight containers shall be subject to the following:
        1. 1.
          Stacked freight containers shall be set back a minimum of one hundred 9100) feet from a public or private street right-of-way.
        2. 2.
          Stacked freight containers shall not exceed two (2) containers or seventeen (17) feet in height. 
    2. 2.
      The following standards apply to the City of Union
      1. a.
        Shall not be located within one thousand (1,000) feet of an Agricultural or Residential district.
      2. b.
        Access shall only be to a subcollector, collector, or arterial street.
      3. c.
        The facility shall be screened on all sides by a minimum six (6) foot high berm which shall be installed behind the required Buffer Yard.
      4. d.
        Trucks or truck tractors shall not idle while parked.
      5. e.
        Any refrigerated trailers or semitrailers are not permitted to be in operation.
      6. f.
        All trucks, truck tractors, trailers, or semitrailers shall be operable and road ready.
      7. g.
        The storage of freight containers shall be subject to the following:
        1. 1.
          The outermost stack shall not exceed two (2) freight containers in height.
        2. 2.
          The inner stack immediately adjacent to the outermost stack shall not exceed three (3) freight containers in height.
        3. 3.
          No other stack shall exceed four (4) freight containers in height. 
  2. B.
    Kennel
    1. 1.
      Within the City of Florence, kennels are only allowed when not adjoining a residential zoned property.
  3. C.
    Radio and TV Station
    1. 1.
      Relay, transmitting or receiving towers, or similar free standing equipment shall be prohibited.
  4. D.
    Veterinary Animal Hospital or Clinic
    1. 1.
      Boarding of animals shall be prohibited.
  5. E.
    Cannabis Business (applies only to the City of Union)
    1. 1.
      Shall only take place in an enclosed, locked facility.
    2. 2.
      Shall not be located within one thousand (1,000) feet of an existing elementary or secondary school or daycare center.
    3. 3.
      Shall not be located within five hundred (500) feet of a public park or playground.
    4. 4.
      Shall not be located within five hundred (500) feet of a religious assembly facility.
    5. 5.
      Shall not be located within five hundred (500) feet of a sexually oriented business.
    6. 6.
      A dispensary shall not be located within one thousand (1,000) feet of an existing dispensary
