CHAPTER 6

OFF STREET PARKING AND LOADING

10-6-1: PURPOSE:

The purpose of this chapter is to alleviate or prevent the congestion of the public streets, and so promote the safety and welfare of the public by establishing minimum requirements for the off street parking and loading and unloading of motor vehicles in accordance with the use to which property is put. 10-6-2: GENERAL PROVISIONS FOR PARKING AND LOADING:

   A.   Scope Of Regulations: The off street parking and loading provisions of this chapter shall apply as follows:
      1.   For all buildings and structures erected and all uses of land established after the effective date hereof, accessory parking and loading facilities shall be provided as required by the regulations of this section. However, where a building permit has been issued prior to the effective date hereof, and provided that construction is begun within one year of such effective date, and diligently prosecuted to completion, only the less restrictive parking and loading standards as required prior to the effective date shall be provided.
      2.   When the intensity of use of any building, structure or premises shall be increased through addition of dwelling units, gross floor area, seating capacity or other unit of measurement specified herein for required parking or loading facilities, parking and loading facilities as required herein shall be provided for such increase in intensity of use.
However, no building or structure lawfully erected, or use lawfully established prior to the effective date hereof, shall be required to provide such additional parking or loading facilities unless and until the increase in density or intensity of use exceeds fifteen percent (15%) in units of measurement. In the event that this situation occurs, parking or loading facilities as required herein shall be provided for the total increase.
      3.   Whenever the existing use of a building or structure is changed to a new use, parking or loading facilities shall be provided as required for such new use.
   B.   Existing Parking And Loading Facilities: Accessory off street parking or loading facilities which are located on the same lot as the building or use served, and which were in existence on the effective date hereof or were provided voluntarily after such effective date, shall not hereafter be reduced below, or if already less than, shall not further be reduced below the requirements of this title for a similar new building or use.    C.   Roosevelt Road Corridor Parking Requirements: For the purpose of allowing the existing mix and density of uses within the Roosevelt Road business district, additional off street parking is not required at locations where limited parking or no parking is currently provided. New uses which are similar to those in operation at the time that this title is adopted are not required to add additional parking. However, where new construction or a change in existing use warrants additional parking, one-half (1/2) of the standard parking requirements for commercial uses detailed in this section, excluding restaurants, shall be provided. Due to the nature of restaurants and the additional parking that they require, no reduction in required parking shall be granted without a variation, as described in this title.    D.   Permissive Parking And Loading Facilities: Nothing in this chapter shall be deemed to prevent the voluntary establishment of off street parking or loading facilities to serve any existing use of land or buildings provided that all regulations herein governing the location, design, improvement and operation of such facilities are adhered to.
   E.   Damage Or Destruction: For any conforming or legally nonconforming building or use which is in existence on the effective date hereof, which subsequent thereto is damaged or destroyed by fire, collapse, explosion or other cause, and which is reconstructed, reestablished or repaired, off street parking or loading facilities equivalent to any maintained at the time of such damage or destruction shall be restored or continued in operation. However, in no case shall it be necessary to provide parking or loading facilities in excess of those previously provided.
   F.   Control Of Off Site Parking Facilities: When required parking facilities are provided on land other than the zoning lot on which the building or use served by such facilities is located, they shall be and remain in the same possession or ownership as the zoning lot occupied by the building or use to which the parking facilities are accessory. No such off site parking facilities shall be authorized and no occupancy permit shall be issued where the plans call for parking facilities to be located on a lot other than on the same zoning lot as the principal use until and unless the planning and zoning board has reviewed the plans, heard the applicant and made findings that the zoning lot and the remote site are in common ownership and that the off site parking facilities will be maintained at all times during the life of the proposed use or building.
   G.   Submission Of Plot Plan: Any application for a building permit, or for a certificate of occupancy where no building permit is required, shall include therewith a site plan, drawn to scale and fully dimensioned, showing any parking or loading facilities to be provided in compliance with this chapter.    H.   Landscape Requirements: Landscaping for off street parking areas shall be provided in accordance with subsection 10-8-4I, "Landscaping", of this title. (Ord. 2006-15, 6-5-2006)

10-6-3: PARKING REGULATIONS:

   A.   Use Of Parking Facilities: Off street parking facilities accessory to residential uses located in any residential district shall be used solely for the parking of passenger automobiles or company vehicles of comparable size, owned or used by occupants of the dwelling structures to which such parking facilities are accessory or by guests of said occupants. Under no circumstances shall required parking facilities accessory to residential structures be used for the parking of automobiles belonging to the employees, owners, tenants, visitors or customers of business or manufacturing establishments.
   B.   Joint Parking Facilities: Off street parking facilities for properties with separate buildings or uses, or for buildings with mixed uses, may be provided collectively on the zoning lot, provided that the total number of spaces so located together shall not be less than the sum of the separate requirements for each use.
   C.   Shared Parking Facilities: Cumulative parking requirements for mixed use occupancies may be reduced where it can be determined that the peak requirement of the several occupancies occurs at different times (either daily or seasonally). The shared parking report published by the urban land institute may be used as a guideline in the estimation of parking demand for mixed use buildings and sites.
   D.   Computation: When determination of the number of off street parking spaces required by this chapter results in a requirement of a fractional space, any fraction of one-half (1/2) or less may be disregarded while a fraction in excess of one-half (1/2) shall be counted as one parking space.
   E.   Size: A required off street parking space shall be at least nine feet (9') in width and at least nineteen feet (19') in length, exclusive of access drives or aisles, ramps, columns, or office or work areas. The nineteen foot (19') length may include up to two feet (2') of abutting space in a vegetative buffer of landscaped area over which a parked vehicle may extend, provided that no parked vehicle may project over a sidewalk or other pedestrian walkway such that the sidewalk is reduced to less than five feet (5') in width. Each required off street parking space shall have a vertical clearance of at least seven feet (7').
   F.   Access:
      1.   Each required off street parking space shall open directly upon an aisle or driveway of at least the width below, based upon the angle of the parking stalls provided and whether the aisle serves one or two (2) rows of parking spaces:

      2.   All off-street parking facilities shall be designed with appropriate means of vehicular access to a street or alley in a manner which will least interfere with traffic movements. No driveway across public property nor curb cut shall exceed a width of thirty feet (30'). Driveways shall be located at least one foot (1') from the property line.
      3.   Shared driveways shall not be permitted in residential districts.
      4.   Off-street parking spaces may be located in any yard except required front yards, but shall not be closer than one foot (1') to the lot line. All such parking spaces are subject to the regulations of this chapter.
   G.   Design And Maintenance:
      1.   Open And Enclosed Parking Spaces: Accessory parking spaces located on the same lot as occupied by the use served may be open to the sky or enclosed in a building. Accessory parking spaces located in a residential district elsewhere than on the same lot occupied by the use served shall be open to the sky except when otherwise allowed as a special use.
      2.   Surfacing: All open off-street parking areas and driveways shall be improved with a compacted gravel base, not less than four inches (9") thick, surfaced with asphalt, not less than three inches (3") thick, concrete or some comparable all-weather dustless material. Construction of such surfacing shall be completed within one year of the issuance of a building permit.
      3.   Drainage: The surface drainage from every off-street parking area shall be in such a manner as not to overflow onto adjoining property. Off-street parking areas covering less than one thousand five hundred (1,500) square feet may have their surface drainage discharge directly into public rights of way. Off-street parking areas covering less than two thousand (2,000) square feet may have their surface drainage discharge directly into public alleys.
Off-street parking areas that exceed the above limitations shall have their surface drainage contained within their paved areas and removed by means of drainage structures and storm sewers. Where storm sewers must connect to the existing village sewer system, the connection shall be preceded by a catch basin structure having a half-trap device on its outlet pipe and a flow restrictor on its inlet pipe. The size of the flow restrictor shall be based upon the metropolitan water reclamation district of greater Chicago (MWRDGC) storm sewer detention requirements.
      4.   Lighting: Any lighting used to illuminate off-street parking areas shall be directed away from residential properties in such a way as not to create a nuisance. Lighting should have a total cutoff of light at an angle less than ninety degrees (90°) and is located so that a light source is completely shielded from the direct view of an observer five feet (5') above the ground at the point where the cutoff angle intersects the ground.
      5.   Signs: Incidental signs are permitted in parking areas in accordance with the regulations of chapter 9 of this title.
      6.   Repair And Service: No motor vehicle repair work of any kind shall be permitted in conjunction with accessory off-street parking facilities in a residence district, except for minor repairs of the occupant's personal vehicle, provided that the vehicle is not rendered immobile for more than two (2) days.
The sale of gasoline and motor oil in conjunction with accessory off-street parking facilities is not permitted in any residence district. (Ord. 2001-08A, 4-2-2001)

10-6-4: LOCATION OF ACCESSORY OFF-STREET PARKING FACILITIES:

The location of off-street parking spaces in relation to the use served shall be as prescribed hereinafter. All distances specified shall be walking distances between such parking spaces and a main entrance to the use served.
   A.   For Uses In A Residence District: Parking spaces accessory to dwellings shall be located on the same zoning lot as the principal use. Spaces accessory to uses other than dwellings may be located on a lot adjacent to, or directly across a street or alley from, the lot occupied by the principal use, but in no case at a distance in excess of three hundred feet (300') from such use.
   B.   For Uses In Business And Manufacturing Districts: All required parking spaces shall be within one thousand feet (1,000') of the principal use. However, no parking spaces accessory to a use in a business or manufacturing district shall be located in a residence district, except that municipal parking lots may be allowed within two hundred feet (200') of and adjacent to any business or industrial district by special use permit in accordance with chapter 5 of this title. 10-6-5: SCHEDULE OF PARKING AND LOADING REQUIREMENTS:

   A.   Applicability: Accessory off-street parking spaces shall be provided for the following uses as required hereinafter. For uses not listed herein, the parking requirements shall be determined by the zoning administrator. Parking spaces required on an employee basis shall be based on the maximum number of employees on duty or residing, or both, on the premises at any one time. For the uses listed in table 6-1 of this section, off-street loading berths shall be provided on the basis of gross floor area of buildings or portions thereof devoted to such uses in the amounts shown:

10-6-6: AMERICANS WITH DISABILITIES ACT REQUIREMENTS:

A. Number Of Spaces: In any self-park facility, a certain number of spaces must be set aside for wheelchair access as summarized in the following table:

B. Exceptions:
1. Outpatient units at medical care facilities: ten percent (10%) of total spaces for that facility.
2. Medical care facilities specifically for treatment of the mobility impaired: twenty percent (20%) of the total spaces for that facility.
C. Accessible Parking Space Dimensions:
1. Standard Accessible Spaces: Accessible spaces shall consist of an eight foot (8') wide parking stall adjacent to an eight foot (8') wide access aisle.
2. Vertical Clearance: Along at least one aisle to and from each accessible space, a minimum clearance of eight feet two inches (8'2") (98 inches) is required.
D. Location Of Accessible Spaces:
1. Accessible parking spaces serving a particular building shall be located on the shortest accessible route of travel to an accessible entrance.
2. Accessible parking spaces may be provided on one level of a multi-level parking structure.
E. Accessible Route:
1. At least one accessible route with a continuous minimum clearance of thirty six inches (36") must be provided from accessible parking spaces to the nearest accessible pedestrian entrance.
2. If an accessible route has less than sixty inches (60") clear width then passing spaces at least sixty inches by sixty inches (60" x 60") must be located at reasonable intervals not to exceed every two hundred feet (200').
3. The floor slope along an accessible route shall not exceed a ratio of one to twelve (1:12) with a maximum rise of thirty inches (30") for any run.
4. A level landing shall be provided at the bottom of each ramp and top of each ramp run. The width of the landing shall be at least as wide as the ramp run and at least sixty inches (60") long. At changes in direction a sixty inch by sixty inch (60" x 60") landing shall be provided.
5. The cross slope of ramps shall not exceed a ratio of one to fifty (1:50).
6. The floor slope at loading zones shall not exceed a ratio of one to fifty (1:50).
7. It is preferable to provide the accessible route at the front of the stalls. Also, the accessible route shall avoid crossing lanes of vehicular travel. When crossing vehicular travel lanes is necessary, the route of travel shall be designated and marked by a crosswalk.
F. Relation To State Or Federal Standards: Where any conflicts with state or federal legislation may exist, the state and federal standards shall control. (Ord. 2001-08A, 4-2-2001)

10-6-7: OFF-STREET LOADING REQUIREMENTS:

A. Location: All required loading berths shall be located on the same zoning lot as the principal use. No loading berth for vehicles over two (2) tons' capacity shall be closer than fifty feet (50') to any property in a residence district unless completely enclosed by building walls, or a uniformly painted solid fence or wall, or any combination thereof, not less than six feet (6') in height. No permitted or required loading berth shall be located in any required front or side yard. No permitted or required loading berth shall be located within twenty five feet (25') of the nearest point of intersection of any two (2) streets.
B. Size: A required loading berth shall be at least ten feet (10') in width by at least sixty feet (60') in length, exclusive of aisles and maneuvering space, and shall have a vertical clearance of at least fourteen feet (14').
C. Access: Each required off-street loading berth shall be designed with appropriate means of vehicular access to a street or alley in a manner which will least interfere with traffic movements.
D. Surfacing: All open off-street loading berths shall be improved with a compacted macadam base, not less than seven inches (7") thick, surfaced with not less than two inches (2") of asphalt, concrete or some comparable all-weather dustless material.
E. Repair And Service: No motor vehicle repair work or service of any kind shall be permitted in conjunction with loading facilities provided in any residence or business districts.
1. Space allocated to any off-street loading berth shall not, while so allocated, be used to satisfy the space requirements for any off-street parking facilities or portions thereof.
2. For uses other than prescribed for in this section, loading berths adequate in number and size to serve such uses, as determined by the zoning administrator, shall be provided.
3. Uses for which off-street loading facilities are required herein but which are located in buildings of less floor area than the minimum prescribed for such required facilities shall provide adequate receiving facilities off any adjacent alley, service drive, or open space on the same lot which is accessible by motor vehicle. 10-6-8: ELECTRIC VEHICLE CHARGING PARKING SPACES:

Requirements for electric vehicle charging parking spaces shall be set forth and governed by the building code and electrical codes approved by the Village of Broadview, which may be amended from time to time. In addition, said requirements shall be subject to the Electric Vehicle Charging Act, 765 ILCS 1085/1 et seq., as amended.
Any required electric vehicle parking space(s) shall be included in the total number of required parking spaces as provided in Table 10-6-5: Schedule of Parking and Loading Requirements. (Ord. 2025-6, 4-21-2025)
