ARTICLE V

- CLOSING PROVISIONS

Sec. 118-82. - Construction.

The terms and provisions of this chapter shall not be construed in a manner to conflict with V.T.C.A. Local Government Code, Chapter 211 and if any term or provision of this chapter shall appear to conflict with any term, provision or condition of Chapter 211, such Ordinance term or provision shall be read, interpreted and construed in a manner consistent with and not in conflict with such Chapter, and, if possible, in a manner to give effect to both. The standard and accepted rules of statutory construction shall govern in construing the terms and provisions of this chapter.

Sec. 118-83. - Amendment and repeal.

Ordinance Number 2005-02 is hereby amended in its entirety and all ordinances or parts thereof conflicting or inconsistent with the provisions of this chapter as adopted and amended herein, are hereby amended to the extent of such conflict. In the event of a conflict or inconsistency between this chapter and any other code or ordinance of the city, the terms and provisions of this chapter shall govern. Any violations of the ordinance or ordinances amended herein are hereby saved.

Sec. 118-84. - Severability.

If any provision of this chapter or the application of any provision to any person or circumstance is held invalid, the invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this chapter are declared to be severable.

Sec. 118-85. - Effective date.

This chapter shall take effect immediately from and after its passage and publication in accordance with the provisions of V.T.C.A., Local Government Code ch. 52.

Sec. 118-86. - Open meetings.

It is hereby officially found and determined that the meeting at which this chapter is passed was open to the public as required and that public notice of the time, place and purpose of said meeting was given as required by the Open Meetings Act, V.T.C.A., Government Code ch. 551.

Sec. 118-87. - Penalty.

Any person who shall violate any of the provisions of this chapter, or shall fail to comply therewith, or with any of the requirements thereof, within the city limits shall be deemed guilty of an offense and shall be liable for a fine not to exceed the sum of $2000.00. Each day the violation exists shall constitute a separate offense. Such penalty shall be in addition to all the other remedies provided herein.
