The purpose of this article is to amend Chapter 260, Zoning, of the Code to establish the Ritts Historical and Architectural District, which will further create, protect and maintain the living environment of the residents of the City of Butler.

Section 260-12, Enumeration of districts, of Chapter 260, Zoning, is hereby amended to include a new district designed as the Ritts Historical and Architectural District, which is bound and more fully defined as beginning at a point at the center line of North Cedar Street and Howard Street; south on North Cedar to the corner of North Cedar and East Penn Street; east on East Penn to the corner of East Penn Street and North Cliff Street; north on North Cliff to the corner of North Cliff Street and Howard Street; east on Howard to the corner of Howard and North Elm Street; north on North Elm to the corner of North Elm Street and Elm Court; west on Charles Street to the terminus of Elm Court at the Elm Court property; west on a line that includes all properties in Elm Court, to the corner of Lumar Drive and North McKean Street; north on North McKean Street to the Dingham Road; west on Dingham Road to North Main Street; south on North Main Street to Charles Street; east on Charles to the corner of Charles and North Cedar Street; and south on North Cedar Street to the corner of Cedar and Howard Street at the point of beginning. The parcels contained within the Ritts Historical and Architectural District are highlighted on the map attached hereto and incorporated herein as Appendix 1.[1]

The Official Zoning Map of the City of Butler, as previously adopted by the City of Butler, is hereby amended to delete all parcels with zoning designations of R-2, R-3 or C-2; and to rezone said parcels as R-1 parcels. The parcels affected by this rezoning are highlighted on the map attached hereto and incorporated herein as Appendix 2.[1]

Further, it is the intent of this article that the provisions of Chapter 260, Zoning, applicable to R-1 Low-Density Residential parcels shall, upon implementation of this article, be applicable to all parcels within the Ritts Historical and Architectural District, except for those parcels qualifying as preexisting, nonconforming lots, structures and/or uses which shall continue to be governed by the applicable provisions of the Code.
