ARTICLE XXIV

Rotary Arts and Cultural District

§ 260-147 Purpose.

To promote and support the arts within the designated arts district and throughout the City of Butler.

§ 260-148 Designation of the Rotary Arts and Cultural District.

The geographic boundaries of the Rotary Arts and Cultural District is hereby designated as [insert geographic boundaries].

§ 260-149 Applicability to existing zoning.

The designation of the Rotary Arts and Cultural District does not amend or alter the applicability of the existing zoning provisions within the geographic boundaries of the Rotary Arts and Cultural District. The City may grant variances, as needed, for the installation of the Rotary Arts and Cultural District signage as set forth herein.

§ 260-150 Artwork outside of the Rotary Arts and Cultural District.

The City is committed to the promotion and support of the arts throughout the City of Butler. The creation of the Rotary Arts and Cultural District is not intended to limit or discourage the arts in other areas of the City. To the contrary, the City will continue to promote and support the arts throughout the City. To that end, the City hereby reserves the right to establish and approve designated areas for the display of artwork, whether on loan to the City or donated to the City, on which artwork will be installed, displayed, and maintained by the City.
A. 
If the artwork is on loan to the City, the artist or the owner of the artwork shall retain the control of the artwork, but the City and the artist shall enter into a written agreement setting forth the rights and obligations of the parties.
B. 
If the artwork is donated to the City, the City must approve the donation and, once approved, the artwork becomes the property of the City. As City property, the City shall retain final control over the artwork, including, but not limited to, decisions regarding the repair, maintenance, relocated, removal, and the right to discard the artwork. The City may in its sole discretion enter into a maintenance agreement with one or more community organizations for the general repair, maintenance, and upkeep of the artwork.
