ARTICLE VI
Beach Strand and Dune Stabilization Districts
§ 525-29 Intent.
It is the intent of the Beach Strand and Dune Stabilization Districts to protect the City's important beach resources from development and use that is inconsistent with their natural character or which could have an adverse impact on them.

A.
Use regulations.
(1)
Uses by right.
(a)
Beach protection projects constructed by a governmental agency.
(b)
Recreational uses of a nature ordinarily permitted on a beach.
(c)
Amusement centers in existing structures.

A minimum of 300 square feet of operating area.
[2]
Maximum of 2,000 square feet of operating area.
[3]
Off-street parking at a ratio of one off-street space for each two licensed machines.
[4]
Adequate special parking facilities for bicycles and mopeds as determined by the Planning Board as part of site plan review.
[5]
No such enterprise shall be located closer than 1,000 feet to a primary or secondary school, measured door to door.
[6]
No sound from any licensed machine shall be discernible in any adjacent premises.
[7]
No device shall be placed within 15 feet of an entry or exit of the premises.
[8]
In considering the approval of such premises as a permitted use, the Planning Board shall consider the potential impact of the use at the proposed location on such factors as traffic circulation and safety, the impact on surrounding businesses and residences and any potential detrimental effects to the health, safety and welfare of the citizens of the City of Cape May.

B.
Area and bulk regulations.
(1)
Building regulations.
(a)
No permanent structure of any type, except protective works undertaken by the City of Cape May or other governmental agency, may be permitted.
(b)
Any temporary building such as a beach tent and facility for the storage of umbrellas and beach equipment shall be required to comply with the regulations contained in § 158-13B(2).[1] All such structures shall be constructed in a temporary fashion so that the same may be easily removed and may be permitted to be standing for the period of time between April 1 and October 15 of each year. Prior to the erection of any temporary building, a building permit must be obtained from the Construction Official of the City, as necessary.
