ARTICLE VI

CONDITIONS FOR PARTICULAR USES SUBJECT TO CONDITIONAL USE PERMITS

Sec. 50-116.- Pawnshops.

Pawnshops may be permitted by conditional use permit in the freeway commercial zoning district, but are not allowed in any other districts. In addition to other standards of the city ordinances, conditions specific to this use are as follows:

a.

The zoning lot containing the pawn shop shall be at least 1,000 feet from the property line in a site containing another pawnshop, Currency Exchange, payday loan agency, firearm sales, alcoholic beverage sales or sexually-oriented business. In the case of a shopping center or multi-use structure, the distance shall be measured from the portion of the structure occupied by the pawnshop.

b.

The pawnshop use shall not operate in conjunction with a sexually-oriented business or payday loan agency or Currency Exchange.

c.

The zoning lot containing the pawn shop shall be located a minimum of 750 feet from the property line of any zoning lot or parcel of land that is zoned residential, or has an educational use, religious institution, park, library or community center. In the case of a shopping center or multi-use structure, the distance shall be measured from the portion of the structure occupied by the pawnshop.

d.

The site shall have direct access to a roadway identified in the comprehensive plan as a collector or arterial. Access to and from other streets is prohibited.

e.

In-vehicle sales or service are prohibited.

f.

Fire arm purchases and sales are prohibited.

g.

The use shall be contained within a completely enclosed structure, and no outside storage, display, or sale of merchandise is permitted.

h.

Exterior loudspeakers or public address systems are prohibited.

i.

Visibility into the store shall be maintained by utilizing clear, transparent glass on all windows and doors, and by keeping all windows free of obstructions for at least three feet into the store. Product may be displayed for sale in the window as long as the display, including signage, does not occupy more than 30 percent of the window area.

j.

Interior and exterior bars, grills, mesh or similar obstructions, whether permanently or temporarily affixed, shall not cover any exterior door or window.

k.

Neon accents and back-lighted awnings shall be prohibited.

Sec. 50-117. - Payday loan agency and currency exchange.

This use may be permitted by conditional use permit in the freeway commercial zoning district, but are not allowed in any other districts. In addition to other standards of the city ordinances, the conditions specific to this use are as follows:

a.

The zoning lot containing the payday loan agency or Currency Exchange shall be at least 1,000 feet from the property line of a site containing a pawnshop, Currency Exchange, payday loan agency, firearms sales, alcoholic beverage sales or sexually-oriented business. In the case of a shopping center or multi-use structure, the distance shall be measured from the portion of the center or structure occupied by the payday loan agency or Currency Exchange.

b.

These uses shall not operate in conjunction with a sexually-oriented business or pawnshop.

c.

The zoning lot containing the payday loan agency or Currency Exchange shall be located a minimum of 750 feet from the property line of any zoning lot or parcel of land that is zoned residential, or has an educational use, religious institution, park, library or community center. In the case of a shopping center or multi-use structure, the distance shall be measured from the portion of the center or structure occupied by the use.

d.

Sec. 50-118. - Firearms sales.

This use may be permitted by conditional use permit in the freeway commercial zoning district, but are not allowed in any other districts. In addition to other standards of the city ordinances, the conditions specific to this use are as follows:

a.

This section pertains to those dealers who require a license under the Gun Control Act of 1968, as amended from time to time. Exempted from the requirements of a conditional use permit are those retailers for which firearm sales are an incidental portion of the sales for a single retailer operating a store with retail floor area of at least 100,000 square feet for which firearm sales shall be considered a permitted use.

b.

The zoning lot containing the firearm sales shall be at least 1,000 feet from the property line of a site containing a pawnshop, Currency Exchange, payday loan agency, alcoholic beverage sales or sexually-oriented business. In the case of a shopping center or multi-use structure, the distance shall be measured from the portion of the center or structure occupied by the firearm sales.

c.

The zoning lot containing the firearm sales shall be located a minimum of 750 feet from the property line of any zoning lot or parcel of land that is zoned residential, or has an educational (academic) use, religious institution, park, library or community center. In the case of a shopping center or multi-use structure, the distance shall be measured from the portion of the center or structure occupied by the use.

d.

Access shall be to a roadway identified in the comprehensive plan as a collector or arterial. Access to and from local residential streets is prohibited.

e.

In-vehicle sales or service are prohibited.

f.

The use shall be contained within a completely enclosed structure.

g.

Exterior loudspeakers or public address systems are prohibited.

h.

Windows must be clear, transparent glass and be free of obstructions for at least three feet into the store. Product may be displayed in the window as long as the display, including signage, does not occupy more than 30 percent of the window area.

i.

Neon accents and back-lighted awnings shall be prohibited.

Sec. 50-119. - Production breweries.

This use may be permitted by conditional use permit in the freeway commercial zoning district, central business district, and general commercial district, but are not allowed in any other districts. In addition to other standards of the city ordinances, the conditions specific to this use are as follows:

a.

The owner of the brewery qualifies for and receives a brewer license and a malt liquor wholesale license (if wholesale of malt liquor is an intended activity) from the State of Minnesota, according to M.S.A. § 340A.301.

b.

An accessory brewer's taproom for the on-sale of beer produced onsite shall require a brewer taproom license from the City of Carver, according to City Code section 4-46(h).

c.

On-site sale of beer in the form of growlers shall require a brewer off-sale license, according to City Code section 4-46(i).

d.

Total production of malt liquor may not exceed 10,000 barrels annually. Of the 10,000 barrel production limit, onsite taproom retail sales shall not exceed 3,500 barrels annually, 500 barrels of which may be sold off-sale as growlers. The brewer shall annually submit production reports with the request to renew a brewer taproom or off-sale malt liquor license.

e.

The brewery facility provides adequate space for off-street loading and unloading of all trucks greater than 22 feet in length. In the absence of off-street loading, the city may impose limits on deliveries or shipments using the public rights-of-way, including regulating the number of trucks per day and the hours that deliveries are permitted.

f.

Loading docks shall be located and designed so they are not visible from adjoining public streets or adjoining residential zoning.

g.

No outdoor storage is permitted on the site, with the exception that waste handling (refuse and/or recycling) may occur in an enclosure that is fully screened from adjoining streets and residential zoning.

h.

No odors from the business may be perceptible beyond the property line.

i.

All exterior lighting shall be compliant with section 50-86 of the Carver City Code.

Sec. 50-120. - Brew pubs.

This use may be permitted by conditional use permit in the freeway commercial zoning district, central business district, and general commercial district, but are not allowed in any other districts. In addition to other standards of the city ordinances, the conditions specific to this use are as follows:

a.

The use shall meet all requirements for and be in possession of a brew pub license from the City of Carver, as required in City Code section 4-46(j).

b.

No outdoor storage is permitted on the site, with the exception that waste handling (refuse and/or recycling) may occur in an enclosure that is fully screened from adjoining streets and residential zoning.

c.

No odors from the business may be perceptible beyond the property line.

d.

All exterior lighting shall be compliant with section 50-86 of the Carver City Code.
