District Regulations

§ 210-10 Single-Family Residential (R1) District.

Purpose. R1 Districts are established to provide for the development of residential neighborhoods occupied primarily by single-family residences. No building or other structure or land shall be used and no building or other structure shall be built or altered for any purpose not listed under this section.

Minimum lot width: 100 feet.

Minimum setback, measured from front property line: 25 feet.
Minimum rear yard: 10 feet.
Minimum side yard: 10 feet.
Maximum stories: 2 1/2.
Minimum floor space: 800/640 square feet*.

Note: 800 square feet for one-story dwelling and 640 square feet for first floor of a multilevel dwelling.

§ 210-11 Residential (R2) District.

Purpose. R2 Districts are established to provide for the development of residential neighborhoods occupied by a variety of types of residential structures together with certain additional uses which are supporting to and compatible with residential neighborhoods.

Minimum lot size per unit: 13,000 square feet.
Minimum lot width: 110 feet, plus 20 feet per unit over three units.
Maximum lot coverage: 35%.
Minimum front yard, measured from front property line: 50 feet.
Minimum rear yard: 25 feet.
Minimum side yard: 25 feet.
Maximum floor stories: 4 1/2.
Minimum floor space: 600 square feet*.

Note: For developments four units or under, the minimum lot size shall be 1/2 acre, while developments over four units shall require one acre minimum.

§ 210-12 Commercial (C1) District.

§ 210-14 Central Business/Shoreline Commercial (C3) District.

Purpose. C3 Districts are established to provide for the establishment and maintenance of a central business corridor, recreational uses and residential neighborhoods which will take advantage of the close proximity to business and recreation opportunities.

Business uses along the "Main Street" corridor as designated on the Official Zoning Map of the Village of Celoron, NY, shall meet the following standards:
Minimum lot size: none.
Minimum lot width: none.
Minimum front yard: none.
Minimum side yard: none, except that where there is one it shall be six feet, and where a side yard abuts a lot in an R District, it shall be 30 feet for each side yard.
Minimum rear yard: none.
Maximum height of buildings: 75 feet.
Business uses and other allowed uses (excluding structure which house or are intended to house family units) shall meet the following standards:
Minimum lot size: 15,000 square feet.
Minimum lot width: 110 feet.
Maximum lot coverage: 40%.
Minimum front yard, measured from front property line: 30 feet.
Minimum rear yard: 20 feet.
Minimum side yard: 15 feet.
Minimum lake front set back: 100 feet.
Dwellings and multiple dwellings shall meet the following standards:
Minimum lot size per unit: 5,000 square feet.
Minimum lot width: 120 feet, plus 20 feet per unit over three units.
Maximum lot coverage: 45%.
Minimum front yard, measured from front property line: 75 feet.
Minimum rear yard: 60 feet.

§ 210-15 Industrial (I) District.

Purpose. I1 Districts are established to allow for light industrial uses which do not create nuisances (noise, odor, etc.).

Maximum stories: 4 1/2.
Multiple dwelling shall meet the following standards:
Minimum lot size per unit: 6,000 square feet.
Minimum lot width: 100 feet, plus five feet per unit.
Maximum lot coverage: 40%.
Minimum front yard. measured from front property line: 20 feet.
Minimum side yard: 20 feet, plus two feet per unit.
Minimum rear yard: 20 feet.
Maximum structure height-stories: 2 1/2.
Minimum floor space per unit: 650 square feet*.

§ 210-16 Culture and Recreation (CR) District.

Purpose. CR Districts are created to preserve areas for public recreational and cultural purposes.

All uses shall meet the following standards:

Minimum lot width: 150 feet.
Maximum lot coverage: 30%.
Minimum front yard, measured from front property line: 40 feet.
Minimum rear yard: 40 feet.
Minimum side yard: 30 feet.

§ 210-17 Flood Damage Prevention District.

Purpose. Flood Districts overlap other zoning districts and thus the regulations which apply to floodplain areas supplement the regulation of the zoning district (e.g., residential, agricultural, etc.) for which the land is located. It is the purpose of the flood damage regulations to promote the public health, safety, and general welfare, and to minimize public and private losses due to flood conditions in specific areas by provisions designed:
To protect human life and health;
To minimize expenditure of public money for costly flood control projects;
To minimize the need for rescue and relief efforts associated with flooding and generally undertaken at the expense of the general public;
To minimize prolonged business interruptions;
To minimize damage to public facilities and utilities such as water and gas mains, electric, telephone, and sewer lines, and streets and bridges located in areas of special flood hazard;
To help maintain a stable tax base by providing for the sound use and development of areas of special flood hazard so as to minimize future flood blight areas;
To insure that potential buyers notified that property is in an area of special flood hazards; and
To insure that those who occupy the areas of special flood hazard assume responsibility for their actions.
Flood district boundary. The flood damage regulations which follow apply to the areas of special flood hazard identified by the Federal Insurance Administration on its Flood Hazard Boundary Map (FHBM), No. Ho1-04, dated September 20, 1974, and any revisions thereto, and are adopted by reference and declared to be a part of this chapter. The FHBM is on file at the Municipal offices.
Provisions for flood hazard reduction. The following standards shall apply to special flood hazard areas:
Anchoring.
All new construction and substantial improvements shall be anchored to prevent flotation, collapse, or lateral movement of the structure.
All mobile homes and any additions thereto shall be anchored to resist flotation, collapse, or lateral movement by providing an anchoring system designed to withstand a wind force of 90 miles per hour.
Construction materials and methods.
All new construction and substantial improvements shall be constructed with materials and utility equipment resistant to flood damage.
All new construction and substantial improvements shall be constructed using methods and practices that minimize flood damage.
Utilities:
All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of flood waters into the system.
New and replacement sanitary sewage systems will be designed to minimize or eliminate infiltration of flood waters into the systems and discharge from the systems into flood waters.
On-site waste disposal systems shall be located to avoid impairment to them or contamination from them during flooding. All subdivision proposals shall be consistent with the need to minimize flood damage.
Subdivisions.
All subdivision proposals shall have public utilities and facilities such as sewer, gas electrical, and water systems located and constructed to minimize flood damage.
All subdivision proposals shall have adequate drainage provided to reduce exposure to flood damage.
Base flood elevation data shall be provided for subdivision proposals and other proposed development which contain at least 50 lots or five acres (whichever is less).
Encroachments. Any proposed development shall be analyzed to determine effects on the flood-carrying capacity of the area of special flood hazard.
Residential construction (where other base data is available). New construction and substantial improvement of any residential structure shall have the lowest floor, including basement, elevated to or above the base flood elevation.
Nonresidential construction (where other base elevation data is available). New construction and substantial improvement of any commercial, industrial or other nonresidential structure shall either have the lowest flood, including basement, elevated to or above the base flood elevation; or, together with attendant utility and sanitary facilities, shall:
Be floodproofed so that below the base flood level, the structure is watertight with walls substantially impermeable to the passage of water;
Have structural components capable of resisting hydrodynamic loads and effects of buoyancy.
Setback from lake. No structure shall be built within 50 feet of the Chautauqua Lake shoreline, except in the C3 District, where no structure shall be built within 100 feet of the Chautauqua Lake Shoreline. The shoreline shall be considered to be the natural waterline at 1,308 feet mean sea level.
