CONTINGENT USES

SPECIFICATION E

§ 154.125 WHAT CONSTITUTES A CONTINGENT USE.

   For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
   CONTINGENT USES. Uses which are likely or liable, but not certain, to occur and which are not inappropriate to the principal use of the district in which located.

§ 154.126 LOCATION PERMITTED; VEHICLE PARKING SPACES.

   Contingent uses, as listed below, are permitted in the district indicated below. Each use shall provide on the lot, or within 300 feet thereof on a site approved by the Board of Zoning Appeals, parking spaces, open or enclosed, as follows:

§ 154.127 PAVING.

   Open parking areas shall be paved with a dustproof or hard surface, meeting the standard specifications of the town.

§ 154.128 CHURCH OR TEMPLE PARKING.

   A church or temple requiring parking area at times when nearby uses do not need their parking facilities may, by agreement approved by the Board of Zoning Appeals, utilize those facilities in lieu of providing their own parking facilities.

§ 154.129 HEIGHT PERMITTED.

   (A)   The height permitted for contingent uses shall be as follows, except as provided in divisions (B) and (C) below:

   (B)   Buildings may be erected to heights in excess of the normal maximum if they are set back from required front, side and rear yard lines, or property lines where yards are not required as follows:

   (C)   In all districts, spires, church steeples, chimneys, cooling towers, elevator bulkheads, fire towers, scenery lofts, water towers, transmission towers and other essential mechanical appurtenances may be erected to any height not prohibited by other laws or ordinances.

§ 154.130 YARDS, VISION CLEARANCE AND ACCESSORY BUILDINGS.

   The provisions for yards, vision clearance and accessory buildings as they pertain to group houses in residence districts, local business uses in LB or I Districts, or general business uses in GB Districts, shall apply to contingent uses listed in this subchapter.
