ARTICLE 16

FLOOD HAZARD DISTRICT FH

§ 16-1 GENERAL PURPOSE AND DESCRIPTION.

The Flood Hazard District is designed to provide for the appropriate use of land that has a history of inundation or is determined to be subject to flood hazard, and to promote the general welfare and provide protection from flooding portions of certain districts. Flood hazard areas shall include all areas subject to inundation by floodwaters of the one hundred (100) year frequency as delineated by the most recent Flood Hazard Boundary Map or Flood Insurance Rate Map, as the case may be, issued by or on behalf of the Federal Insurance Administration, and are designated with a Flood Hazard Prefix, FH, on the official Zoning Map of the City.

§ 16-2 PERMITTED USES.

§ 16-3 CITY COUNCIL APPROVAL REQUIRED.

No structure shall be erected and no development, including excavation and/or fill work, shall occur in that portion of any district designated with a Flood Hazard, FH, prefix until and unless such structure and/or development activity has been approved by the City Council. The City Council shall act only after engineering studies have been made and the City Council determines, in writing, that such structure and/or development activity will not be subject to damage by flooding and will not constitute an encroachment, hazard, or obstacle to the movement of floodwaters and that such construction and/or development activity will not endanger the value and safety of other property or public health and welfare.
Development and/or use of any areas subject to inundation shall comply with the regulations and requirements of the zoning district where such is located, other relevant provisions of this Ordinance, and any additional relevant ordinances and regulations of the City.
