The area designated as the Cheviot Community Reinvestment Area constitutes an area in which housing facilities or structures of historical significance are located, and in which new construction or repair of existing facilities have been discouraged.

§ 156.02 ESTABLISHED.
(A) Pursuant to R.C. § 3735.66, the Cheviot Community Reinvestment Area is hereby established as follows: all those properties that front along the following segments of streets located within the City of Cheviot, Ohio, are within the Cheviot Community Reinvestment Area:
(1) Harrison Avenue. Beginning at the boundary line between Green Township and the City of Cheviot where Harrison Avenue intersects with the Green Township boundary line, and thence eastward along Harrison Avenue until it intersects with the City of Cincinnati boundary limits.
(2) Bridgetown Road. Beginning at the boundary line between Green Township and the City of Cheviot where Bridgetown Road intersects with the Green Township boundary line, and thence eastward along Bridgetown Road until it intersects with Harrison Avenue.
(3) Glenmore Avenue. Beginning at the intersection of Glenmore Avenue and Harrison Avenue, and thence southward along Glenmore Avenue until it intersects with the City of Cincinnati boundary limits.
(4) North Bend Road. Beginning at the intersection of North Bend Road and Harrison Avenue, and thence northward along North Bend Road until it intersects with the Green Township boundary limits.
(B) The Cheviot Community Reinvestment Area is depicted on the map marked as "Exhibit B" attached to this Ordinance No. 05-13 and made a part hereof. Only commercial or combined commercial/residential properties consistent with the applicable zoning regulations within the designated Community Reinvestment Area will be eligible for exemptions under this program.

§ 156.03 ELIGIBILITY FOR INCENTIVE.
All properties identified in "Exhibit B" as being within the designated Community Reinvestment Area are eligible for the incentive. The City of Cheviot may determine that all or any combination of project types - commercial or combined commercial/residential -are eligible. This proposal is a public/private partnership intended to promote and expand conforming uses in the designated area. As part of this project, the City of Cheviot intends to undertake supporting public improvements in the designated area.

§ 156.04 NEGOTIATION FOR TAX EXEMPTION.
(A) Within the Community Reinvest Area, the percentage of the tax exemption on the increase in the assessed valuation resulting from the improvement to commercial real property and the term of those exemptions shall be negotiated on a case-by-case basis in advance of construction or remodeling occurring according to the rules outlined in R.C. § 3765.67. The result of the negotiation as approved by this Council will be set in writing in a Community Reinvestment Area Agreement as outlined in R.C.§ 3735.671.
(1) A period of exemption up to 12 years for existing commercial facilities may be negotiated on a case-by-case basis in advance of construction or remodeling occurring.
(2) A period of exemption up to 15 years for new commercial facilities may be negotiated on a case-by-case basis in advance of construction occurring.
(B) If remodeling qualifies for an exemption, during the period of the exemption, the exempted percentage of the dollar amount of the increase in market value of the structure shall be exempt from real property taxation. If the new construction qualifies for an exemption, during the period of the exemption, the exempted percentage of the structure shall not be considered to be an improvement on the land on which it is located for the purpose of real property taxation.

§ 156.05 COMMERCIAL PROJECT REQUIREMENTS.
All commercial projects are required to comply with the state application fee requirements of R.C.§ 3735.672 and the local annual monitoring fee of one percent of the amount of taxes exempted under the agreement - a minimum of $500 up to a maximum of $2,500 annually.

§ 156.06 HOUSING OFFICER DESIGNATED.
To administer and implement the provisions of this chapter, the Safety-Service Director is designated as the Housing Officer as described in R.C. §§ 735.65 through 3735.70.

§ 156.07 COMMUNITY REINVESTMENT AREA HOUSING COUNCIL CREATED.
A Community Reinvestment Area Housing Council shall be created, consisting of two members appointed by the Mayor of Cheviot, two members appointed by the Council of the City of Cheviot, and one member appointed by the Planning Commission of Cheviot. The majority of the members shall then appoint two additional members who shall be residents within the City of Cheviot. Terms of the members of the Housing Council shall be for three years. An unexpired term resulting from a vacancy in the Council shall be filled in the same manner as the initial appointment was made.

A Tax Incentive Review Council shall be established pursuant to R.C. § 709.85 and shall consist of three representatives appointed by the Board of County Commissioners, two representatives of the City of Cheviot, appointed by the Mayor with City Council concurrence, the County Auditor or his designee, and a representative of the Cincinnati Public School Board of Education. At least two members must be residents of the City of Cheviot. The Tax Incentive Review Council shall review annually the compliance of all agreements involving the granting of exemptions for commercial property improvements under R.C. § 3735.671 and make written recommendations to the Council as to continuing, modifying, or terminating the agreement based upon the performance of the agreement.

This City Council reserves the right to reevaluate the designation of the Cheviot Community Reinvestment Area after December 31, 2006, at which time the council may direct the Housing Officer not to accept any new applications for exemptions a described in R.C. § 3735.67.
