Clinton Village City Zoning Code

ARTICLE XVI

Miscellaneous

§ 260-59 Interpretation.

The provisions of this chapter shall be the minimum requirements for the promotion of public health, safety and general welfare. When this chapter imposes a greater restriction on the use of buildings or land or the heights of buildings, or requires larger open spaces, or makes any other greater requirement than is imposed or required by any other law, rule or regulation, or by easements, covenants or agreements, the provisions of this chapter shall govern.

§ 260-60 Partial invalidity and severability.

If any part or provision of this chapter or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part or provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this chapter or the application thereof to other persons or circumstances, and the Village Board of the Village of Clinton hereby declares that it would have passed this chapter or the remainder thereof had such invalid application or invalid provision been apparent.

§ 260-61 Conflicting provisions repealed.

The Zoning Ordinance of the Village of Clinton, NY adopted July 27, 1961, and amended 7-24-1963, 8-14-1963, 9-12-1963, 6-11-1964, 3-5-1969, 4-19-1976, 11-10-1976, and 8-4-1986, is hereby superseded and repealed, except that this repeal shall not affect or prevent the prosecution or punishment for any person for any violation of said Zoning Ordinance and amendments thereto which occurred prior to the taking effect of this chapter.
