ARTICLE II

Purpose and Authority

§ 260-2 Grant of power; purposes; administration.

For the purpose of promoting the health, safety, or the general welfare of the community, the Board of Trustees of the Village of Clinton is hereby empowered, by local law, to regulate and restrict the height, number of stories and size of buildings and other structures, the percentage of lot that may be occupied, the size of yards, courts and other open spaces, the density of population, and the location and use of buildings, structures and land for trade, industry, residence or other purposes. As a part of the Comprehensive Plan and design, the Village Board is empowered by a local law to regulate and restrict certain areas as national historic landmarks, special historic sites, places and buildings for the purpose of conservation, protection, enhancement and perpetuation of these places of natural heritage. Such regulations shall provide that a Board of Appeals may determine and vary their application in harmony with the general purpose and intent, and in accordance with general or specific rules therein contained.
Purpose. This chapter is enacted for the following purposes:
To promote the economic, cultural, educational, and general welfare of the public.
To prevent crime, maintain property values, protect retail trade, generally protect and preserve the quality of neighborhoods, commercial districts and quality of resident's lives.
To protect and enhance the Historic District and promote the historic, architectural, and cultural resources which constitute the Village heritage and its attractiveness to all.
To lessen congestion on the streets.
To secure safety from fire, flood, panic and other dangers.
To promote health and the general welfare.
To provide adequate light and air.
To prevent the overcrowding of land.
To facilitate the adequate and efficient provision of transportation, water, sewage, schools, parks and other service requirements.
To conserve the value of buildings.
To encourage the most appropriate use of land throughout the municipality.
To insure the harmonious, orderly, and efficient growth and development of the Village.
To preserve and protect the supply of safe and healthful drinking water for the Village of Clinton, local residents, employees, and the general public.
The Village Zoning Board of Appeals shall administer the provisions of this chapter.

§ 260-3 Applicability of stormwater regulations.

The stormwater management requirements of this chapter and Chapter 196, Stormwater Management, shall be applicable to all land development activities as defined in § 260-5.
In addition to the requirements imposed by this chapter, no application for approval of a land development activity (see § 260-5, Definitions) shall be reviewed until the appropriate board has received a stormwater pollution prevention plan (SWPPP) prepared in accordance with the NYS SPDES General Permit for Construction Activities GP-02-01, the requirements in Chapter 196, Stormwater Management, and until the SWPPP has been reviewed and approved by the DEC.
The Planning Board shall accept stormwater pollution prevention plans and forward such plans to other applicable municipal boards. The Planning Board may:
Review the plans;
Upon approval by the Village Board of Trustees of the Village of Clinton, engage the services of a registered professional engineer or other agency to review the plans, specifications and related documents at a cost not to exceed a fee schedule established by said governing board;
Accept the certification of a licensed professional that the plans conform to the requirements of this chapter; or
Postpone local action on the plans until such time as the applicant has obtained all necessary permit coverage from other state and/or federal agencies.
