ENFORCEMENT OF THE ZONING ORDINANCE
The building official shall enforce the provisions of this ordinance.

The building inspector official shall have the power to:
1.
Grant occupancy permits;
2.
Issue building permits; and
3.
Make inspections of buildings or premises necessary to carry out his duties in the enforcement of this ordinance.
The building official shall not approve any plans or issue a building permit for any excavation, construction, alteration or remodeling until he has inspected such plans in detail and found them to be in conformity with this ordinance and the building code. To this end, the building official shall require that every application for a change in type of use or the type of occupancy be accompanied by written statements and plans or plats in duplicate drawn to a scale of not less than one inch equals 50 feet. The required documentation shall show the following information in sufficient detail to enable the building official to ascertain whether the proposed structure, excavation or use is in conformance with this ordinance:
1.
The actual shape, location, and dimensions of the lot.
2.
The shape, size, and location of all buildings or other structures to be erected, altered or moved, and of any buildings or other structures already on the lot.
3.
The existing and intended use of the lot and of all such structures upon it, including in the residential areas the number of dwelling units the building is intended to accommodate.
4.
Existing and proposed grades to an extent necessary to allow the building official to properly determine the results of the proposed work.
5.
Such other information concerning the lot or adjoining lots as may be essential for determining whether the provisions of these regulations are being observed.
If the proposed excavation, construction, moving or alteration, or use of land, as set forth in the application is in conformity with the provisions of this ordinance and the building code, the building official shall issue a permit. If any application for such permit is not approved, the building official shall state in writing on the application the cause for such disapproval. Issuance of a permit shall in no case be construed as waiving any provisions of this ordinance.

It shall be unlawful for any person to commence excavation for, or to commence construction of, any building or structure without first obtaining a building permit from the building official. A building permit is also required to physically move any existing building.
2.
Plumbing, electrical, drainage and other permits shall not be issued until the building official has determined that the plans and designated use indicate that the structure and premises, if constructed as planned and proposed, will conform to the provisions of this ordinance.
3.
A building permit is required for any change in the use of an existing building or structure to a different classification of type of use.

Generally. It shall be unlawful to use or to permit the use of any land, building or structure for which a building permit is required until the building official has issued a certificate of occupancy stating that the provisions of this ordinance and of the building code have been complied with. It shall be unlawful to use or permit to be used any building or structure hereafter altered, extended, repaired, or physically moved until the building official has issued a certificate of occupancy stating that the provisions of this ordinance and of the building code have been complied with.
2.
Certificate validity. The certificate of occupancy as required in the building code for construction of new buildings and structures, or for renovations to existing buildings and structures, shall serve as the certificates of occupancy required by this ordinance as well.
3.
Certificates for existing buildings in satisfactory condition. Certificates of occupancy shall be issued for existing buildings and structures, or parts thereof, or for the existing uses of land if after inspection, it is found that such buildings and structures, or parts thereof, or such use of land, are in conformity with the provisions of this ordinance.

Records of certificates. A record of all certificates of occupancy shall be kept in the office of the building official.
6.
Accessory buildings for dwellings. Accessory buildings to dwellings do not require a separate certificate of occupancy. These structures may be included in the certificate of occupancy for the principal building if the accessory structure is constructed at the same time as the principal building.
7.
Application for certificates. Certificates of occupancy shall be applied for coincident with the application for a building permit. A certificate of occupancy shall be issued within ten working days after the erection or alteration of said building has been completed in conformity with the provisions and requirements of the building code and this ordinance. If the building official refuses to issue a certificate of occupancy, the applicant shall, within ten working days, be notified in writing of such refusal and the reasons justifying this action.

Fees for inspections and the issuance of permits or certificates or copies thereof required or issued under the provisions of this ordinance shall be collected by the building official in advance of the issuance of such permits or certificates.
The amount of such fees shall be established by the governing body from time to time.
