CHAPTER 1244

Districts Generally; Boundaries

1244.01 ESTABLISHMENT OF DISTRICTS.

   For the purpose of regulating the location of trades, industries and all other uses of property within the Village, the Village is hereby divided into use districts as follows:
   (a)   General Residence District, Section One;
   (b)   General Residence District, Section Two;
   (c)   General Industrial District;
   (d)   Office Building, Research Laboratory and Light Manufacturing District; and
   (e)   General Residence District, Section Three.

1244.02 BOUNDARIES OF GENERAL RESIDENCE DISTRICT, SECTION ONE.

   General Residence District, Section One, shall include the following described territory:
   Being a part of Original Newburgh Township Lot 302 and a part of Original Independence Township Lot 5, Tract 1 east of the Cuyahoga River and bounded and described as follows:
   Beginning at the southwesterly corner of Original Newburgh Township Lot 302; thence northerly along the westerly line of said Original Lot 302 a distance of about 1,860 feet to its intersection with the southerly line of a parcel of land conveyed to the Board of Education Cuyahoga Heights Local School District by deed recorded in Volume 13865, Page 379 of Cuyahoga County Records; thence easterly along the southerly line of said land conveyed to the Board of Education, 145.25 feet to its intersection with the northeasterly line of said land so conveyed; thence northwesterly along the northeasterly line of said land conveyed to the Board of Education, 184.12 feet to its intersection with the westerly line of said Original Lot 302; thence northerly along the westerly line of said Original Lot 302, about 523 feet to a point distant 2,500.00 feet northerly measured along said line from the southwesterly corner of said Original Lot 302; thence easterly on a line parallel to the southerly line of said Original Lot 302 to a point distant 250.00 feet by rectangular measurement from the centerline of East 71st street; thence northerly parallel to the centerline of East 71st Street, and distant 250 feet therefrom by rectangular measurement about 320 feet to a point in the northerly line of a parcel of land conveyed to Cheryl A. Baumann by deed recorded as A.F.N. 200609050408 of Cuyahoga County Records; thence easterly along the northerly line of said land conveyed to Cheryl A. Baumann to its intersection with the centerline of East 71st Street, thence northerly along the centerline of East 71st Street about 274 feet to its intersection with the northerly line of a parcel of land conveyed to Chester and Geraldine Suchocki by deed recorded in Volume 14228, Page 497 of Cuyahoga County Records; thence easterly along the northerly line of said land conveyed to Chester and Geraldine Suchocki about 881.19 feet to its intersection with the easterly line of said Original Lot 302; thence southerly along the easterly line of said Original Lot 302 about 3,100 feet to the southeasterly corner of said Original Lot, being also the northeasterly corner of Original Independence Township Lot 5, east of the Cuyahoga River; thence westerly along the southerly line of Original Lot 302 to a point distant 350.00 feet easterly from its intersection with the centerline of East 71st Street, thence southerly and parallel to the centerline of East 71st Street to a point in the southerly line of land conveyed to Rose Pytel by deed dated March 23, 1946 and recorded in Volume 6051, Page 535 of Cuyahoga County Records; thence westerly along the southerly line of said land conveyed to Rose Pytel and its westerly prolongation, to its intersection with the easterly line of Brecksville Road Extension, known as the Willow Freeway, and as shown by the Dedication Plat recorded in Volume 131, Page 100 of Cuyahoga County Map Records; thence northerly along the easterly line of Brecksville Road Extension to its intersection with the northerly line of said Original Lot 5; thence easterly along the northerly line of said Original Lot 5 to the place of beginning.

1244.03 BOUNDARIES OF GENERAL RESIDENCE DISTRICT, SECTION TWO.

   General Residence District, Section Two, shall include the following described territory:
   Beginning at a point in the centerline of East 49th Street distant northerly 540.00 feet measured along the centerline of East 49th Street from its intersection with the southerly line of Original 100 Acre Lot 296; thence westerly by rectangular measurement a distance of 300 feet; thence southerly and parallel with the centerline of East 49th Street to a point in the southerly right-of-way line of the New York Central Lines, LLC Railroad; thence in a northeasterly direction along the northerly line of the right-of-way of the New York Central Lines LLC Railroad to a point distant easterly 1,000 feet by rectangular measurement from the centerline of East 49th Street; thence northerly and parallel with the centerline of East 49th Street to a point distant northerly 660 feet from the southerly line of Original Lot 304; thence westerly 1,000 feet by rectangular measurement to the centerline of East 49th Street; thence southerly along the centerline of East 49th Street about 120 feet to the place of beginning.

1244.04 BOUNDARIES OF GENERAL INDUSTRIAL DISTRICT.

   The General Industrial District shall include all of the territory within the corporate limits of the Village which is not included within the limits of General Residence District, Section One, and General Residence District, Section Two and Office Building, Research Laboratory and Light Manufacturing District Section 5, as described in this chapter.

1244.05 BOUNDARIES OF OFFICE BUILDING, RESEARCH LABORATORY AND LIGHT MANUFACTURING DISTRICT.

   The Office Building, Research Laboratory and Light Manufacturing District shall include the following described territory. Being part of Original Newburgh Township Lots 301, 302, 303, 305, 306 and 307 and bounded and described as follows:
   Beginning at the southeasterly corner of a parcel of land conveyed to the Board of Education Cuyahoga Heights Local School District by deed recorded in Volume 13865, Page 379 of Cuyahoga County Records; thence westerly along the southerly line of said land conveyed to the Board of Education, and its westerly prolongation, about 655 feet to a point in the easterly line of Brecksville Road Extension (1-77), variable width; thence northerly along the easterly line of Brecksville Road Extension, about 590 feet to an angle point, therein; thence southeasterly along the easterly line of Brecksville Road Extension, about 70.71 feet to an angle point, therein; thence northerly along the easterly line of Brecksville Road Extension, about 130.42 feet to an angle point, therein; thence northerly along the easterly line of Brecksville Road Extension, about 102.18 feet to an angle point, therein; thence northwesterly along the easterly line of Brecksville Road Extension, about 108.65 feet to an angle point, therein; thence southerly along the easterly line of Brecksville Road Extension, about 267.12 feet to an angle point, therein; thence northerly along the easterly line of Brecksville Road Extension about 1,420 feet to its intersection with the southeasterly line of the New York Central Lines LLC Railroad right-of-way; thence northeasterly along the southeasterly line of said New York Central right-of-way to its intersection with the centerline of East 71st Street; thence northerly along the centerline of East 71st Street to its intersection with the southeasterly line of said New York Central right-of-way; thence northeasterly along the southeasterly line of said New York Central right-of-way to its intersection with the easterly line of East 71st Street; thence northerly along the easterly line of East 71st Street to its intersection with the southerly line of Oak Avenue; thence easterly along the southerly line of Oak Avenue to its intersection with the northwesterly line of said New York Central right-of-way; thence northeasterly along the northwesterly line of said New York Central right-of-way about 35 feet to its intersection with the Corporation line between the Village of Cuyahoga Heights and the City of Cleveland; thence following the irregular Corporation line between the Village of Cuyahoga Heights and the City of Cleveland to the most northeasterly corner of said Village of Cuyahoga Heights; thence southerly along the easterly Corporation line of the Village of Cuyahoga Heights, about 1,300 feet to its intersection with the Corporation line between the Village of Cuyahoga Heights and the City of Garfield Heights; thence southwesterly along the irregular Corporation line between the Village of Cuyahoga Heights and the City of Garfield Heights to its intersection with the easterly prolongation of the northerly line of a parcel of land conveyed to Chester and Geraldine Suchocki by deed recorded in Volume 14228, Page 497 of Cuyahoga County Records; thence westerly along the easterly prolongation of the northerly line of said land conveyed to Chester and Geraldine Suchocki, and along said northerly line, about 1,490 feet to its intersection with the centerline of East 71st Street; thence southerly along the centerline of East 71st Street about 274 feet to its intersection with the northerly line of a parcel of land conveyed to Cheryl A. Baumann by deed recorded as A.F.N. 200609050408 of Cuyahoga County Records; thence westerly along the northerly line of said land conveyed to Cheryl A. Baumann to a point distant 250 feet by rectangular measurement from the centerline of East 71st Street; thence southerly along a line parallel to the centerline of East 71st Street, and distant 250 feet therefrom by rectangular measurement, about 320 feet to a point in a line drawn parallel to the southerly line of said Original Lot 302, and distant 2,500 feet therefrom measured along a line parallel to the westerly line of said Original Lot; thence westerly along a line parallel to the southerly line of said Original Lot 302 to a point in the westerly line of said Original Lot 302 distant 2,500 feet northerly from the southwesterly corner of said Original Lot; thence southerly along the westerly line of said Original Lot 302 about 523 feet to its intersection with the northwesterly line of said land conveyed to the Board of Education by deed recorded in Volume 13865, Page 379 of Cuyahoga County Records; thence southeasterly along the northeasterly line of said land conveyed to the Board of Education about 184.12 feet to the place of beginning, less and accepting the land within the New York Central Lines LLC Railroad right-of-way known as Cuyahoga County Auditor's Permanent Parcel Number 522-27-002.

1244.06 BOUNDARIES OF GENERAL RESIDENCE DISTRICT, SECTION THREE.

   General Residence District, Section Three, shall include the following described territory:
   Being a part of Original Newburgh Township One Hundred Acre Lot 299, and bounded and described as follows:
   Beginning at a point in the centerline of East 49th Street distant northerly 447.18 feet measured along said centerline from its intersection with the southerly line of Original 100 Acre Lot 300; thence westerly along the southerly line of Split Parcel "C" as shown by the plat recorded in Volume 319, Page 87 of Cuyahoga County Map Records, to a point distant 200 feet westerly by rectangular measurement from the centerline of East 49th Street; thence northerly parallel to the centerline of East 49th Street and distant 200 feet therefrom by rectangular measurement to its intersection with the easterly line of Parcel 5 of land conveyed to Cuyahoga Heights Commerce One, LLC, by deed recorded as A.F.N. 200205010783 of Cuyahoga County Records; thence northerly along the easterly line of said Parcel 5 of land conveyed to Cuyahoga Heights Commerce One, LLC, and its northerly prolongation, to the northwest comer of a parcel of land conveyed to Sheryl A. Lemiec by deed recorded in Volume 85-3529, Page 55 of the Official Records of Cuyahoga County; thence easterly along the northerly line of said land conveyed to Sheryl A. Lemiec to its intersection with the centerline of East 49th Street; thence southerly along the centerline of East 49th Street to the place of beginning.
