CHAPTER 1249

Office Building, Research Laboratory and Light Manufacturing District

1249.01 PURPOSE.

   The Office Building, Research Laboratory and Light Manufacturing District and its regulations are established in order to achieve, among other things, the following purposes:
   (a)   To provide land area for office, research, wholesale and manufacturing uses in the community.
   (b)   To regulate development of such uses based upon standards in order that they may be compatible with the residential areas of the Village and provide for coordinated development of such uses.
   (c)   To provide, where appropriate, for the expansion and continued development of such uses, thereby meeting the future economic needs of the Village for such activities.
   (d)   To provide for such uses which do not create a substantial amount of noise, vibration, smoke, dust, odors, heat, glare, traffic or other objectionable influences which would create conditions detrimental to the health, safety and welfare of the public
   (e)   To provide such density regulations and landscape requirements as will further control any of the foregoing objectionable influences.

1249.02 PERMITTED USES.

   (a)   No building or premises shall hereafter be erected, altered, used, arranged or designed to be used, in whole or in part, for other than one or more of the following specified uses:
      (1)   Uses for professional, administrative, executive, sales, government, business and public utility offices;
      (2)   Uses for basic and applied research for experimental or testing purposes, including research of production processes, and such manufacturing and storage facilities as may be desirable for experimental or development work;
      (3)   Manufacturing uses including all uses involving processing, fabrication, packaging, assembly and related functions whether using machinery or labor, and associated with industrial operations of producing goods, components and other related items from processed or previously manufacturing materials;
      (4)   Trade services including establishments engaged in the general construction, maintenance or repair of tangible personal property, buildings or fixtures.
   (b)   All uses of buildings or premises prohibited under Section 1248.02(a) are hereby prohibited in the Office Building, Research Laboratory and Light Manufacturing District.

1249.03 ACCESSORY USES.

   Accessory uses clearly incidental to the main use on the same lot are also permitted.

1249.04 HEIGHT REGULATIONS.

   The height of any building or structure shall not exceed 75 feet from the finished grade line to the highest part of a wall or the main roof, exclusive of cornices or similar decorative features as approved by the Planning Commission, except for a building within 250 feet of a residential property district, the height shall not exceed 38 feet. Elevator housings or other rooftop mechanical equipment shall not exceed 15 feet in height above the top of any structure.

1249.05 MINIMUM LOT WIDTH.

   All lots and lands divided, subdivided, allotted, re-allotted or otherwise laid out after the effective date of this section shall have a minimum frontage of 125 feet on a dedicated, accepted and improved street.

1249.06 AREA REGULATIONS.

   (a)   There shall be no more than one main building or use on any lot.
   (b)   The required office portion of any use shall face the street.
   (c)   Minimum Lot Size. All lots and lands divided, subdivided, allotted, re-allotted or otherwise laid out after the effective date of this section shall contain a minimum of one acre.
   (d)   Maximum Building Coverage. The ground area occupied by all buildings shall not exceed 40 percent of the total area of the lot, unless otherwise allowed by the Planning and Zoning Board.

1249.07 YARD REGULATIONS.

   (a)   Minimum Front Setback. The minimum front setback to a building line shall be 25 feet in depth from the curb, unless shown otherwise on the Zone Map.
   (b)   Minimum Side Yards. 
      (1)   Two side yards shall be provided on each zoning lot. Where adjoining a lot in a Residential District, the side yard shall be a minimum of 100 feet unless shown otherwise on the Zone Map. When adjoining any other district or within this district, each required side yard shall be a minimum of 25 feet. No side yard shall be required between buildings located on the same zoning lot.
      (2)   Corner lots. In the case of a corner lot, the side yard on the street side shall be not less in width than the setback building line shown on the Zone Map or as provided in this Zoning Code for that side of the corner lot.
   (c)   Use of Yard for Accessory Off Street Parking and Loading Spaces. Accessory off street parking shall be permitted in a required side yard, but located not less than 30 feet from a Residential District line. Accessory off street loading shall be permitted in a required side or rear yard but located not less than 50 feet from a Residential District line. However, in any event, all parking shall be behind the building lines.
   (d)   Landscaping in Yards. All portions of required yards in which no off street parking or loading spaces are permitted shall be developed as lawn or planted areas. The Planning Commission may require a fence, wall or hedge or landscaping where a Residential District adjoins a side yard of this classification.

1249.08 OFF-STREET LOADING FACILITIES.

   (a)   Loading facilities shall be located on the same lot as the main building or use, served and located so that a public street or sidewalk will not be occupied during the loading or unloading process.
   (b)   Off-street loading facilities shall not be permitted in front of the building which faces the frontage street. This subsection shall not be construed to prohibit off-street loading at the side of a building, except on a corner lot adjacent to a street.
   (c)   Off-street loading spaces shall be provided with surface improvements as required for parking areas in this Code.
   (d)   The repairing or servicing of motor vehicles shall not be permitted in a required off-street loading space. Space required and allocated for off-street loading shall not be allocated or used to satisfy the space requirements for required off-street parking.
   (e)   Off-street loading space shall be provided as determined by the Planning Board.
   (f)   In all cases, off-street loading spaces shall be provided for a building or a group of buildings so that the length of the required space is in accordance with the usual size of truck employed for loading or unloading. Each space shall have a vertical clearance of at least 14 feet. The required areas shall be in addition to aisle and maneuvering space.

1249.09 PROJECTIONS.

   No portion of any building or structure shall project in front of the setback building line as established. On a corner lot, the projection of buildings and structures into the front yard shall also apply to the space between the side line of the lot which is also a street line and any setback building line on the lot parallel to such street line.

1249.10 PERFORMANCE STANDARDS.

   All industrial uses shall comply with the following performance standards as a condition of occupancy and use. Any use already established shall not be altered, added to, or otherwise modified so as to conflict with, or to further conflict with, the following performance standards. Statements that such uses comply or will comply may be required, in writing, by the Planning Board from the owner and operator. In cases of doubt, the Village shall select and arrange for an independent review by a professional qualified in the particular field and the costs for such services shall be paid by the owner or operator.
   (a)   Enclosed Buildings. All permitted main and accessory uses and operations, except off-street parking, shall be conducted wholly within enclosed buildings. All raw materials, partially finished products, finished products and mobile and other equipment shall be stored within enclosed buildings.
   (b)   Fire and Explosive Hazards.
      (1)   No explosive materials or devices may be manufactured.
      (2)   The storage, handling and use of flammable or explosive materials shall be permitted only in structures having incombustible exterior walls and roof.
      (3)   All activities concerned with flammable or explosive materials shall be provided with adequate safety and protective devices against hazards of fire and explosion as well as with adequate firefighting and suppression equipment and devices standard to the operation involved.
      (4)   Automatic sprinkling systems are required.
      (5)   All buildings shall be accessible to firefighting equipment and shall comply with the fire prevention codes of the Village and the State.
   (c)   Waste Materials. Liquid wastes shall not be discharged into a reservoir, stream, storm sewer or other open body of water unless treated or controlled so that the amount of solid substances, oils, grease, acids, alkaline and other chemicals shall not exceed the amount permitted by other codes of the State and County. Solid wastes shall be stored in fully enclosed buildings.
   (d)   Smoke and Dust. The emission of smoke, soot, fly ash, fumes, dust and other types of air pollution borne by the wind shall not be permitted.
   (e)   Odorous Matter. The emissions from odorous matter in such quantities as to produce a public nuisance or hazard beyond the boundaries of the lot shall not be permitted.
   (f)   Toxic or Noxious Matter. The emission of toxic, noxious or corrosive fumes or gases shall not be permitted.
   (g)   Radioactive, Electrical or Communication Disturbances. Radioactive, electrical or communication disturbances which adversely affect any form of life or equipment at or beyond the boundaries of the lot shall not be created or permitted.
   (h)   Vibration. Vibrations shall not be permitted beyond the boundaries of the lot, which would be perceptible without the aid of instruments.
   (i)   Sound. The sound pressure level of any operation on a lot shall not exceed the limits of Chapter 632, and shall further not exceed the average intensity of the street traffic noise in the District, and no sound shall be objectionable due to intermittence, beat frequency or shrillness.
   (j)   Service and Body Shops. Truck and/or automobile body shops and mechanical service garages shall not be permitted.

1249.11 MULTIPLE OCCUPANCY.

   The Planning Board may allow multiple occupancy on a zoned lot, provided that:
   (a)   The zoning lot is maintained in single ownership.
   (b)   Each multiple occupancy is a permitted use in the district.
   (c)   The multiple occupancy occurs within a single building on the zoning lot.
   (d)   The building and zoning lot containing the multiple occupancy meet all the area, yard and height requirements of the district.
   (e)   Each use within a multiple occupancy building, and all the uses in combination, meet the performance standards set forth in this chapter.

1249.12 PARKING SPACE FOR OFFICE AND MANUFACTURING USES.

   (a)   Required off street parking spaces for office, manufacturing, storage and laboratory uses shall be provided in the rear or side yard at the rate of:
      (1)   One space for each two employees on the major and secondary shift in laboratories, storage, service, and manufacturing uses.
      (2)   Off-street parking facilities shall be prorated on the premises as follows:
         A.   For each 200 square feet of gross office space, one parking space; and
         B.   For each 500 square feet of all other permitted uses one parking space.
   (b)   For both gross office and all other permitted uses, in the event there is more than one employee per 200 feet of office space and 500 square feet of all other permitted uses, the parking space requirement will be one parking space for each one and one-half employees, computed on the basis of the greatest number of persons employed at any one period during the day or night. Such parking yards shall be concrete or asphalt and adequately drained so that surface waters are not permitted to discharge over or onto public sidewalks or roadways or onto other premises. All parking yards shall be behind the building line.
   (c)   Where the computation of required off-street parking spaces results in a fractional unit, one additional off street parking space shall be provided.

1249.13 PARKING SPACE REGULATIONS.

   (a)   As used in this chapter, "gross floor area" of a building means the total area of all the floors including the basement measured from the exterior faces of the building.
   (b)   A parking space shall be not less than 200 square feet (10 feet by 20 feet) exclusive of driving and turning spaces.
   (c)   All parking areas and driveways shall be provided with an asphalt or concrete surface.
   (d)   All parking areas and driveways shall provide adequate drainage so that all water is contained within a drain connected to a storm sewer or discharged into a natural watercourse so that excessive runoff will not cause damage to neighboring property.
   (e)   Adequate bumper guards shall be provided to establish the limits of the parking area except at exits and entrances. Such guards shall restrain the vehicles in which off-street parking is prohibited.

1249.14 DRIVEWAYS AND LIGHTING.

   (a)   Location and Width of Driveways. The location and width of the entrance and exit driveways to parking facilities shall be planned to interfere as little as possible with the use of nearby property and with vehicular traffic on the nearest streets. Therefore, whenever possible, the centerline of the access driveways on the frontage street of a corner lot shall be at least 40 feet from the right-of-way line of the nearest intersecting street. Whenever possible, driveways shall be spaced at not less than 120-foot intervals, measured from the centerline of the driveways.
   (b)   Lots Fronting on a Major Street. Entrances and exits shall be limited to three lanes for all lots fronting on a major street. The width of such entrances and exits shall conform to the following schedule.

   (c)   Aprons and Curb Cuts. In all cases, the radius of the edge of the apron shall be not less than 12 feet so that a car may enter or leave the curb lane without obstructing vehicles in other traffic lanes. The maximum curb cut shall be limited to the width of the entrance or exit plus the radius of the apron.
   (d)   Lighting. Lights for the illumination of buildings or grounds shall be shielded so as not to be objectionable or hazardous to owners or users of adjacent property or public streets.
