ARTICLE XIX

VALIDITY, SEVERABILITY, INJUNCTION AND PENALTY

Sec. 40-507.- Validity and severability.

It is hereby declared to be the intention of the city council that the sections, subsections, paragraphs, sentences, clauses, phrases or provisions of this chapter are severable, and if any section, subsection, paragraph, sentence, clause, phrase or provision of this chapter shall be adjudged invalid or declared unconstitutional, the unconstitutionality or invalidity shall not affect the validity of this chapter as a whole or any remaining part or provisions thereof, other than the part so declared to be invalid or unconstitutional.

Sec. 40-508. - Injunction and penalty.

(a)

Injunction. A person who violates any provisions of this chapter is subject to a suit for injunction and/or for administrative penalties in addition to prosecution for violations.

(b)

Penalty. Any person violating any provisions of this chapter shall be guilty of a misdemeanor, and, upon conviction, shall be punished by a fine of not more than $2,000.00. Each day that such a violation continues or is permitted to continue, shall be deemed a separate offense.
