Application of Regulations

§ 350-10 Conformity to regulations required.

No building, structure or land shall be used or occupied and no building or structure or part thereof shall hereafter be erected, constructed, reconstructed, moved, or structurally altered unless in conformity with the regulations of this bylaw, except those already lawfully existing as provided in Article VIII of this bylaw.

§ 350-11 Buildings must meet applicable open space requirements.

No part of a yard or other open space or off-street parking or loading space, used in connection with any building or use to satisfy the requirements of this bylaw, may be used to satisfy similar requirements for any other building or use.

§ 350-12 Reduction of lots and yards below minimums prohibited.

A. 
No yard or lot existing on the effective date of this bylaw shall be reduced in dimension or area below the minimum requirements set forth herein. Yards and lots created after the effective date of this bylaw shall meet at least the minimum requirements established by this bylaw.
B. 
Lots and yards pertaining to mobile home parks are governed by Article XIII of this bylaw.

§ 350-13 Unlawfully established uses or structures do not acquire nonconforming rights.

No lot created, structure built, or use established in violation of the provisions of the Zoning Bylaw as such bylaw existed at the time of such violation shall be deemed to have achieved any nonconforming status solely as the result of the adoption of a subsequent amendment.

§ 350-14 Minimum standards; most restrictive to govern in case of conflict.

In their interpretation and application, the provisions of this bylaw shall be held to be minimum requirements adopted for the promotion of the public health, safety or general welfare. Whenever the requirements of this bylaw are at variance with the requirements of any other lawfully adopted rules, regulations or bylaws, the most restrictive or that imposing the higher standards shall govern.
