ARTICLE 3

P: - CP-1, CYBER PARK ONE DISTRICT Cyber Park One Economic Development District.

A.- Purpose and Intent.

The C-P, Cyber Park One District is established to provide locations within Danville for a variety of commercial, institutional and light manufacturing uses. This district is intended to serve as a site for the development of technology-based businesses and their accompanying service uses.

B. - Permitted Uses.

1.

Art gallery.

2.

Assembly plant (for pre-manufactured components).

3.

Bakery.

4.

Bank, savings and loan association, stock broker or similar financial institution.

5.

Catering service.

6.

College, university or community college.

7.

Conference center.

8.

Commercial recreation, provided no open recreational use is located closer than one hundred fifty (150) feet to property zoned T-R, S-R, NT-R, OT-R, A-R, M-R or MHP-R.

9.

Child care center.

10.

Distribution Plant.

11.

Emergency medical treatment center.

12.

Florist.

13.

Fraternal, social or civic organization.

14.

Health club, spa, fitness center.

15.

Hotel or motel.

16.

Industrial operations involving the assembly, fabrication, packaging, treatment, or processing of such products as bakery goods, electrical parts, glass, textiles, clothing, metals, wood, plastics, food products, instruments and machinery, paper products (but not paper manufacturing), pharmaceuticals, leather (not tannery), fiber, canvas, and tools, provided that the manufacturing process creates no danger to the health or safety of surrounding areas.

Research and/or Development Facility.

Medical or dental office, clinic, or laboratory.

Museum.

20.

Offices; provided a building shall have a ten thousand (10,000) square foot minimum floor area and each office occupancy shall have a three thousand (3,000) square foot minimum floor area.

Park, playground, play field (lighted or unlighted), community building, public or private, when open to the general public and operated by a public or nonprofit agency.

22.

Parking lot or parking garage for passenger or motor vehicles.

23.

Personal services, including barber and beauty shop, tailor, shoe repair, etc.

24.

Pharmacy.

25.

Plant nursery for the growth and development of crops for pharmacological research only, not for commercial wholesale or retail sales.

26.

Print shop for business and professional printing and reproduction.

27.

Private club.

28.

Professional offices, including accountant, architect, engineer, landscape architect, lawyer, etc.

29.

Restaurant, including open air cafes, excluding drive-thru facilities.

30.

Retail sales.

31.

Sales and service shop for small equipment, including gasoline-powered, except adjacent to residential use, bicycles, small appliances, locksmith.

32.

Sales of products manufactured on the premises or by the same corporate entity.

33.

School, commercial.

34.

Specialty shops, including boutiques, gourmet foods and wines, and tobacco shops.

35.

Studio for production of movie or television shows.

36.

Television or radio station, excluding on-site towers and antennas.

37.

Theater or auditorium.

C. - Uses Permitted by Special Use Permit.

1.

Warehouses.

2.

Wholesaling.

3.

Community facility (publicly or privately owned), including police station, fire station, library, life saving crew and other municipal services.

4.

Dormitory.

D. - Maximum Density.

Regulated by floor area ratio.

E. - Lot Size Requirements.

1.

Minimum district size: 5 acres.

2.

Minimum lot area: Three (3) Acres (130,680 square feet).

3.

Minimum lot width: 200 feet.

4.

Minimum lot frontage: 200 feet.

5.

No CP-1 District lot shall be configured such that more than 10% of the prescribed minimum lot area is comprised of either of the following physical land units: (a) wetlands and (b) water features.

F. - Bulk Regulations.

1.

Maximum building height: 80 feet.

2.

Minimum yard requirements:

A.

Front yard: 80 feet, except where the use abuts a residential district, the front yard shall be 100 feet.

B.

Interior and street side yards: 80 feet. Unless the property's interior or street side yard abuts a residential zoning district, then the required setback is 100 feet.

C.

Rear yard: 80 feet, provided, where rear yard abuts a residential district, the rear yard shall be 100 feet.

D.

Side and rear yard requirements may be reduced by special permit where a side or rear yard abuts a railroad right-of-way.

E.

Minimum side yard setbacks shall be for emergency vehicle use and at least the initial twenty (20) feet adjacent to a property line shall be kept clear of all obstructions, including parking spaces, bushes and trees.

3.

Maximum floor area ratio: 0.50.

4.

Maximum building area coverage: 0.50.

G. - Open Space.

1.

An open space plan and landscape plan shall be submitted with applications for any land use governed by this district.

2.

Stormwater management basins and structures and BMP facilities may be counted towards the minimum open space requirement provided that these basins, structures, and facilities include the appropriate landscaping and maintenance in accordance with the Landscape and Screening Regulations.

3.

Ten (10) percent of the lot shall be landscaped open space; provided that no more than fifty (50) percent of the landscaped open space shall consist of land classified as rivers, stream valleys, wetlands, slopes in excess of 30%, or drainage easements.

H. - Additional Regulations.

1.

Refer to the Airport Overlay District, where applicable, for specific regulations pertaining to development within the district.

2.

An environmental impact statement may be required for any permitted or special permit use. All uses shall conform to federal, state and City environmental performance standards and design criteria as related to:

(a)

Air pollution;

(b)

Fire and explosion hazards;

(c)

Radiation hazards;

(d)

Electromagnetic radiation and interference hazards;

(e)

Liquid, gas and solid wastes hazards;

(f)

Noise standards;

(g)

Vibration standards;

(h)

Illumination and glare;

(i)

Water quality; and

(j)

Others as may be requested by the Planning Commission.

3.

All uses shall be subject to site plan approval.

4.

All refuse shall be contained in completely enclosed facilities.

5.

On a corner lot, no curb cut shall be located closer than 60 feet to the curb line extended from the intersecting public street.

6.

No curb cut shall be located closer than 20 feet to a side or rear lot line, unless a common curb cut serves adjacent uses, and in no instance shall the distance between separate curb cuts serving adjacent uses be less than 60 feet.

7.

A freestanding use shall have no more than two curb cuts on any single right-of-way, and such curb cuts shall have a minimum distance of 100 feet between them.

8.

Where more than one main building is permitted on the same lot, there shall be a thirty-foot minimum separation between buildings.

9.

No mechanical equipment, tank, duct, elevator enclosure, cooling tower, or mechanical ventilator or air conditioner shall be erected, constructed, converted, established, altered, or enlarged on the roof of any building, unless all such equipment and appurtenances are contained within a completely enclosed structure whose top and sides may include grillwork, louvers and latticework.

10.

Outdoor storage of merchandise, material and equipment shall be permitted. Storage areas for merchandise, material and equipment must be completely enclosed by solid walls, fences, building or a combination thereof that is to be no less than six (6) feet in height and provided further that no merchandise or material shall be stored to a height greater than any adjacent wall, fence, or building. Outdoor storage of equipment, needed for approved production processes, may exceed six (6) feet in height without full enclosure, but may not exceed 125% of the height of the primary structure or eighty (80) feet, whichever is less. Equipment, not completely enclosed, must be without advertising copy or design. All equipment must be surrounded by appropriate landscaping and placed in the rear yard if it exceeds six (6) feet in height.

11.

The outdoor area devoted to storage, loading and display of goods shall not exceed 30% of the total lot coverage, provided that the combined building and outdoor storage, loading and display areas shall not exceed 60% of the total lot coverage. Such outdoor areas shall not be counted in the calculation of required open space. The location and use of outdoor storage, loading and display areas shall be limited to the designated area(s) on the approved site plan.

12.

Where a lot is contiguous to property located in a residential district, all buildings shall have a minimum setback of 50 feet from common property lines. A landscaped buffer yard shall be provided, with landscape materials and placement subject to final plan approval. Fencing may be required in such cases with fence material and heights subject to final plan approval.

13.

Refer to the Floodplain Zoning Overlay District, where applicable.

14.

Refer to Parking and Loading Requirements where applicable.

15.

Any subdivision or lot which is proposed to be developed on shrink/swell soils shall require a geotechnical report to be submitted with the preliminary plat and plans. Such report shall be prepared by a registered professional engineer and shall address the feasibility of development on the subject soils. No subdivision plat or site plan shall be approved for final recordation until a foundation engineering report has been reviewed by the City.

All recorded plats for lots containing shrink/swell soils shall bear the following note: "This lot contains shrink/swell soils which require special engineering design for foundations and structural elements. No structure will be approved for issuance of a building permit until a foundation engineering design prepared by a certified professional engineer has been approved for the proposed structure."

16.

In the evaluation of performance standards for any permitted or special permit use in the CP-1 District, the City Council, at its sole discretion, may impose other conditions and additional restrictions to that use for the purposes of ensuring the mitigation of impacts and promulgating the health, safety and general welfare of the citizens of Danville.
