Enforcement
The provisions of this Chapter shall be enforced by the following methods:
(1)
Requirement of a building permit.
(2)
Requirement of a certificate of occupancy.
(3)
Inspection and ordering removal of violations.
(4)
Criminal liability.
(5)
Injunction.

No building shall be erected, moved or substantially altered unless a building permit therefor has been issued by the Building Inspector. All permits shall be issued in conformance with the provisions of this Chapter and the Uniform Building Code.

(a)
No land or building shall hereafter be changed in use, nor shall any new structure, building or land be occupied or used, unless the owner first shall have obtained a certificate of occupancy from the Building Inspector.
(b)
If the uses are in conformance with the provisions of this Chapter, a certificate of occupancy shall be issued within five (5) days of the time of the notification that the building is completed and ready for occupancy, provided that all required actions required by the Town have been completed. A copy of all certificates of occupancy shall be filed by the Building Inspector and shall be available for examination by any person with either proprietary or tenancy interest in the property or building.

The Building Inspector is hereby empowered to cause any building, other structure or tract of land to be inspected and examined, and to order in writing the remedying of any condition found to exist herein or thereat in violation of any provision of this Chapter. After such order has been served, no work shall proceed on any building, other structure or tract of land covered by such order, except to correct or comply with such violation.

A person shall be guilty of a misdemeanor in any case where, a) any party violates a provision of this Chapter; b) any violation of any of the provisions of this Chapter exist in any building, any other structure or tract of land; c) an order to remove any such violation has been served upon the owner, general agent, lessee or tenant of the building, other structure or tract of land (or any part thereof) or upon the architect, building contractor or any other person who commits or assists in any such violation; and d) such person shall fail to comply with such order within ten (10) days after the service thereof.

In addition to any of the foregoing remedies, the Town Attorney, acting on behalf of the Town Council, may require an action for an injunction to restrain any violation of this Chapter, or an action for specific performance to cause compliance with this Chapter, or both.

(a)
Every person convicted of a violation of any provision of this Article shall be punished as provided in Section 1-4-20 of this Code.
(b)
In addition to other remedies available to the Town, the Town may commence an action to enjoin the alleged violation of any provision of this Article, or to authorize and compel the removal, termination or abatement of such violation.

This Chapter shall not be construed to hold the Town responsible for any damage to persons or property by reason of the inspection or re-inspection authorized herein or by reason of issuing a building permit as herein provided.
