CHAPTER 1141

General Provisions

1141.01 PURPOSE.

   In order to lessen congestion in the streets; to secure safety from fire, panic, and other dangers; to promote health and the general welfare; to provide adequate light and air; to prevent the overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, sewerage, schools, parks and oihei public requirements; to conserve the value of buildings and encourage the most appropriate use of land throughout the corporate area, there is hereby adopted and established an official Zoning Ordinance and map of the Village of Doylestown, Ohio.

1141.02 AUTHORITY.

   This Zoning Ordinance is adopted pursuant to the authority vested in the Village of Doylestown, Ohio by the General Statutes of the State of Ohio.

1141.03 JURISDICTION.

   The provisions of this Zoning Ordinance shall apply within the corporate limits of the Village of Doylestown, Ohio as shown on the Zoning Map on file in the Village Hall.

1141.04 INTERPRETATION AND CONFLICT.

   The interpretation and application of the provisions of this Zoning Ordinance shall be held to be the minimum requirements for the promotion of the public safety, health, convenience, prosperity and general welfare. It is not intended by this Zoning Ordinance to interfere with, abrogate, or annul any easements, covenants, or other agreements between parties; provided, however, that where this Zoning Ordinance imposes a greater restriction upon the use of buildings or premises or upon the height of buildings, or requires larger open spaces than are imposed or required by other ordinances, rules, regulations, or by easements, covenants, or agreements, the provisions of this Zoning Ordinance shall govern. Upon and after the adoption of this Zoning Ordinance, no building or land shall be used and no building or part thereof shall be erected, moved, or structurally altered except in conformity with the regulations specified herein for the district in which it is located. The Doylestown Village Council shall have the authority to interpret this document.

1141.05 VALIDITY.

   If any section, subsection, sentence, clause or phrase of this Zoning Ordinance is for any reason held to be invalid by the courts, such decision shall not affect the validity of the remaining portions of this Zoning Ordinance. The Council hereby declares that it has passed this Zoning Ordinance and each section, subsection, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid.

1141.06 EFFECTIVE DATE.

   This Zoning Ordinance and its provisions governing the use of land and buildings, the height of buildings, and other matters as hereinafter set forth are hereby established and declared to be in full force and effect from and after its passage and any Zoning Ordinance previously adopted is hereby repealed.
