CHAPTER 1167

Parking and Loading Requirements

1167.01 COMPLIANCE REQUIRED.

   (a)   At the time of the erection of any building or structure, or of the alteration, enlargement or increase in capacity of any building, structure or use or at the time of establishment of any use, permanent off-street parking shall be provided as specified herein.
   (b)   Each application for a Zoning Permit or a Certificate of Occupancy shall include information on the location and dimensions of off-street parking and the means of ingress and egress. The information provided shall be in sufficient detail to enable the Zoning Inspector to determine whether the requirements of this chapter are met.

1167.02 JOINT USE OF FACILITIES.

   The required off-street parking for any number of separate uses may be combined in one (1) parking lot provided that such facility or lot contains the total number of required spaces for all of the uses sharing the facility and that a valid legal instrument setting forth rights of access and use and maintenance responsibilities is executed by all parties to such joint uses. Where such joint parking is intended to serve uses with non-overlapping hours of usage, the Planning Commission may, where it deems appropriate, approve a reduction in the total number of required spaces based upon such shared sequential use of spaces.

1167.03 MINIMUM PARKING REQUIREMENTS.

   (a)   The number of off-street parking spaces required by this chapter shall be provided on the same lot as the principal use and the required number of off-street parking spaces specified for each use shall be considered as the absolute minimum. For purposes of this Zoning Ordinance, an off-street parking space shall be no less than one hundred eighty (180) square feet in area plus adequate ingress and egress provided for each off-street parking space. All parking facilities shall meet the requirements of the "Americans with Disabilities Act" (ADA). Required off-street loading areas shall not be included as off-street parking.
   (b)   For the purposes of this section, floor area shall mean the gross square footage contained within the exterior walls of any building or structure.

One (1) parking space for each four hundred (400) square feet of gross floor area.

One (1) parking space for each four hundred (400) square feet of gross floor area.
Lodging Facilities, including Hotels, Motels, Rooming Houses, Tourist Homes, Boarding Houses, and Bed and Breakfast Inns
One and one-half (1-1/2) parking space for each room.
Medical Facilities and Special Care Homes, including Retirement Homes, Hospitals, Sanitariums, and Nursing and Convalescent Homes
Medical Offices and Clinics
One (1) parking spaces for each one hundred fifty (150) square feet of gross floor area.
Offices
One (1) parking space for each three hundred (300) square feet of gross floor space.

One (1) parking space for each two hundred fifty (250) square feet of gross floor area.
Shopping Centers
Five (5) parking spaces for each 1000 square feet of gross leasable floor space in the center.
Theaters, Indoor
One (1) parking space for each four (4) seats.
Vehicle, Mobile Home, and Farm Equipment Sales and Service
Two (2) parking spaces for each one thousand (1,000) square feet of sales area, plus five (5) spaces for each service bay. Required parking spaces shall not be used for inventory.

1167.04 REQUIREMENTS FOR PARKING LOTS.

   Parking lots designed or intended to accommodate more than five (5) cars shall comply with the following criteria:
   (a)   Parking lots shall be used only for parking and not for any type of loading, sales, dead storage, repair work, dismantling or servicing, but may be used for convention exhibits or parking of rental vehicles.
   (b)   All entrances, exits, barricades at sidewalks, and drainage plans shall be approved and constructed before occupancy.
   (c)   Parking areas shall be graded and drained to minimize standing water, to provide drainage away from buildings, and to prevent runoff onto adjacent properties.
   (d)   Every parking lot shall have adequate pavement markings to delineate the spaces.
   (e)   Parking lots shall be set back ten (10) feet from any right-of-way line or any lot zoned for residential uses which area shall be reserved as open space, guarded with curbs or wheel blocks and planted with grass, shrubs and trees.
   (f)   At each entrance or exit, only one (1) sign, no larger than two (2) square feet, prescribing parking regulations, may be erected.
   (g)   Required off-street parking areas including drives and access ways, shall be surfaced with an all-weather surface material.
   (h)   Parking areas intended for use during non-daylight hours shall be illuminated.
   (i)   Lighting of parking areas shall be shielded to prevent casting light upon adjacent properties or creating glare visible from public streets or residential properties.
   (j)   Parking lots containing more than fifteen (15) parking spaces shall be improved with landscape islands or other landscaping techniques to provide visual relief.
   (k)   Parking lots shall be paved with asphalt, concrete, or hard surface treatment as approved by the Planning Commission and in accordance with design criteria and specifications established by the Village Engineer.

1167.05 SITE ACCESS.

   (a)   Drive access or curb cuts shall generally be limited to one (1) per site provided, however that the Planning Commission may authorize additional access drives or curb cuts where it deems appropriate to handle anticipated traffic volumes and/or to promote vehicular safety.
   (b)   All driveways shall comply with the following standards:
      (1)   Driveways shall not exceed twenty-five (25) feet in width at the curb line of the street, except where the Zoning Inspector finds that a greater width is necessary to accommodate the vehicles customarily using the driveway.
      (2)   Where the Planning Commission authorizes two (2) or more driveways to be located on the same lot, the distance between such drives shall be as directed by the Commission, but in no case less than thirty (30) feet or one third (1/3) of the lot frontage, whichever is greater.
      (3)   No driveway shall be located closer than fifty (50) feet to the radius turnout of any street intersection.

1167.06 DOWNTOWN OFF-STREET PARKING.

   Within the BD-Downtown Business District, off-street parking shall be required as set forth above; provided, however, that the Planning Commission may reduce or modify such parking requirements as it may determine as part of the review and approval of a Site Plan pursuant to Chapter 1153 of this Zoning Code. Where upon, the parking requirements for the property shall become those determined by the Planning Commission as set forth on the approved Site Plan, and said requirements shall remain in effect until such time as the use of the property changes or is expanded.

1167.07 VEHICLE STORAGE.

   (a)   Residential Districts.
      (1)   Only vehicles intended for personal use shall be parked or stored on any property zoned for residential use. No storage of commercial inventory whatsoever shall be permitted. No inoperative vehicle shall be permitted to be parked or stored out of doors longer than twenty-four (24) hours.
      (2)   To protect the residential character of neighborhoods and the public from the danger and nuisance of large commercial vehicles, the storage or parking of commercial vehicles exceeding 7,000 pounds gross vehicle weight or twenty-five (25) feet in length, including but not limited to tractors, trailers, semi-trailers and trucks, is hereby classified as an industrial use and is prohibited in residential zones except for loading and unloading.
      (3)   No commercial vehicle of any type shall be parked upon any driveway or yard except for emergencies and making deliveries or loadings, temporary stopping for not more than one (1) hour, or to complete a service call.
   (b)   Business and Industrial Districts.
      (1)   In any business or industrial district, customer and employee parking is permitted along with the parking and storing of governmental or commercial vehicles. Inoperative vehicles shall be permitted to be parked or stored only while undergoing repairs at a commercial garage or automobile service station.
      (2)   Outside storage of materials shall only be permitted where specifically authorized by the Planning Commission and in compliance with such standards, conditions, and restrictions as the Commission may require.
   (c)   Except as set forth herein, a violation of this section shall be classified as a minor misdemeanor and shall be punishable by a fine of up to one hundred fifty dollars ($150.00). If an individual or entity has been previously convicted of a violation of this section within one (1) year, any violation of this section shall be classified as a fourth degree misdemeanor, punishable by a fine of up to two hundred fifty dollars ($250.00), thirty (30) days incarceration, or both. If an individual or entity has been previously convicted of two (2) or more violations of this section within one (1) year, any violation of this section shall be classified as a third degree misdemeanor, punishable by a fine of up to five hundred dollars ($500.00), sixty (60) days incarceration, or both.

1167.08 MOBILE HOME AND TRAILER PARKING AND STORING.

   It shall be unlawful to park or otherwise store for any purpose whatsoever any mobile home or trailer within any zoning district except as follows:
   (a)   At a safe, lawful, and unobstructive location on a street, alley, highway, or other public place, provided that the trailer or mobile home shall not be parked overnight.
   (b)   On any lot or plot provided that:
      (1)   The Zoning Inspector has issued a storage permit for any mobile home to be parked or stored for longer than seven (7) days.
      (2)   A Temporary Occupancy Permit has been obtained.
      (3)   Trailers, as defined in Chapter 1143 shall be stored in a garage or carport or in the rear or side yard.
   (c)   Except as set forth herein, a violation of this section shall be classified as a minor misdemeanor and shall be punishable by a fine of up to one hundred fifty dollars ($150.00). If an individual or entity has been previously convicted of a violation of this section within one (1) year, any violation of this section shall be classified as a fourth degree misdemeanor, punishable by a fine of up to two hundred fifty dollars ($250.00), thirty (30) days incarceration, or both. If an individual or entity has been previously convicted of two (2) or more violations of this section within one (1) year, any violation of this section shall be classified as a third degree misdemeanor, punishable by a fine of up to five hundred dollars ($500.00), sixty (60) days incarceration, or both.

1167.09 OFF-STREET LOADING REQUIREMENTS.

   (a)   Off-street loading requirements are established in order to ensure the proper and uniform development of loading areas throughout the Village, to relieve traffic congestion in the streets, and to minimize any detrimental effects of off-street loading areas on adjacent properties.
   (b)   Each application for a Zoning Permit or Certificate of Occupancy shall include plans and other information of sufficient detail to enable the Zoning Inspector to determine whether or not the requirements of this chapter have been met. Plans for off-street loading areas shall include the following information:
      (1)   The location and dimensions of driveway entrances, access aisles and loading spaces.
      (2)   The provision for vehicular and pedestrian circulation.
      (3)   The location of sidewalks and curbs.
   (c)   The Zoning Permit or Certificate of Occupancy for the construction or use of any building, structure or land where off-street loading space is required, shall be issued by the Zoning Inspector only when the provisions of this chapter have been met. If at any time such compliance ceases, any Certificate of Occupancy shall immediately become void.

1167.10 MINIMUM LOADING REQUIREMENTS.

   Off-street loading shall be provided and maintained as specified in the following schedule:
   (a)   Loading spaces shall be located and designed to minimize interference with on-site traffic movement and to prevent the overhang of loading and unloading vehicles in the public right-of-way.
   (b)   For uses containing a gross floor area of less than twenty thousand (20,000) square feet, each off-street loading space shall have minimum dimensions of fifteen (15) feet in width and thirty (30) feet in length.
   (c)   For uses containing a gross floor area of twenty thousand (20,000) square feet or more, each off-street loading space shall be fifteen (15) feet in width and forty-five (45) feet in length as a minimum.
   (d)   Uses which normally handle large quantities of goods, including but not limited to industrial plants, wholesale establishments, storage warehouses, freight terminals, hospitals or sanitariums, and retail sales establishments shall provide off-street loading facilities in the following amounts:
