ARTICLE III

CLASSIFICATION OF ZONING DISTRICTS

Sec. 52-58.- List of districts.

For the purpose of this chapter, the Township is hereby divided into the following district types.

(1)

Conservation District (C).

(2)

Agricultural District (A).

(3)

Low Density Residential District (R-1).

(4)

Suburban Residential District (R-2).

(5)

Urban Extension Residential District (R-3).

(6)

Village Center District (R-4).

(7)

Multifamily Residential District (R-5).

(8)

General Commercial District (GC).

(9)

Planned Commercial District (PC).

(10)

Industrial District (I).

(11)

Airport Commercial District (AC).

(13)

Historic Preservation Overlay District (HS).

Sec. 52-59. - Zoning map.

The boundaries of the zoning districts shall be as shown on the zoning map of the Township which is on file in the Township office. Said map and all notations, references and data shown thereon are hereby incorporated by reference into this chapter, and shall be as much a part of this chapter as if all were fully described herein.

Sec. 52-60. - Interpretation of district boundaries.

Boundaries between zoning districts, unless indicated otherwise, are to be interpreted as follows:

(1)

Boundaries indicated as approximately following the centerlines of streets, railroad rights-of-way, utility rights-of-way and watercourses shall be construed to follow such centerlines.

(2)

Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.

(3)

Boundaries indicated as approximately following Township limits shall be construed as following such limits.

(4)

Boundaries indicated as being parallel to the centerline of streets, railroad rights-of-way, utility rights-of-way or watercourses shall be at a numerical distance from such centerline as shown on the zoning map, or if such a numerical distance is not shown on the map, the distance shall be determined by the scale of the map.

(5)

Where a district boundary line divides a lot which was in single ownership at the time of passage of this chapter, the zoning hearing board may permit, as a special exception, the extension of the regulations for either portion of the lot into the remaining portion of the lot for a distance of 50 feet, provided the lot was not previously granted a special exception for such an extension under the jurisdiction of a previous zoning ordinance duly enacted by the Township board of supervisors.

Should any uncertainty exist, the zoning hearing board shall interpret the intent of the zoning map as to the exact location of district boundaries.

Sec. 52-61. - Application of district regulations.

The regulations set by this chapter within each district shall be minimum regulations and shall apply uniformly to each class or kind of structure or land, and particularly, except as hereinafter provided in conformity with this chapter.

(1)

No building, structure or land shall hereafter be used or occupied, and no building or structure or part thereof shall hereafter be erected, constructed, reconstructed, moved or structurally altered except in conformity with all the regulations herein specified for the zoning district in which it is located.

(2)

No building or other structure shall hereafter be erected or altered:

a.

To exceed the height or bulk;

b.

To accommodate or house a greater number of families;

c.

To occupy a greater percentage of lot area;

d.

To have narrower or smaller rear yards, front yards, side yards or other open spaces than herein required; or in any other manner contrary to the provisions of this chapter.

(3)

No part of a yard, or other open space, or off-street parking or loading space required about or in connection with any building for the purpose of complying with this chapter, shall be included as part of a yard, open space or off-street parking or loading space similarly required for any other building.

(4)

No yard or lot existing at the time of passage of the ordinance from which this chapter is derived shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or lots created after the effective date of the ordinance from which this chapter is derived shall meet at least the minimum requirements established by this chapter.

Sec. 52-62. - Non-specified uses.

Where a use is neither specifically permitted nor denied, it shall be assumed to be prohibited, unless and until approved by the zoning hearing board, which shall determine through a special exception process, that the proposed use shall be of the same general character as the uses permitted in the specific zoning district and in no way is in conflict with the purpose of this chapter and the intended purpose of the zoning district.
