ARTICLE XII
Off-Street Parking
§ 193-61 General requirements.
A.
No building or other permit shall be issued until plans and evidence are presented and approved by the Zoning Board of Appeals to show how the off-street parking requirements are to be fulfilled and that property is and will be available for exclusive use as off-street parking space.

B.
Off-street parking space shall be provided as specified in this chapter and shall be furnished with necessary passageways and driveways. For the purpose of this chapter, a parking space shall not be less than nine feet in width and 18 feet in depth, exclusive of accessways and driveways.
C.
Off-street parking areas for nonresidential uses shall provide an additional 100 square feet of area per off-street parking space to provide sufficient area for access drives and aisles. Off-street parking areas with a capacity for more than 50 vehicles shall delineate fire lanes and shall include no-parking markers.
D.
All off-street parking space shall be deemed to be required space on the lot on which it is situated and shall not be encroached upon or reduced in any manner. Upon application to the Zoning Board of Appeals, the Board may, after a public hearing, permit an applicant to satisfy the off-street parking requirements of this chapter by providing all or part of the required parking spaces on another lot or lots owned or controlled by the owner of such building, provided that such parking spaces are within 500 feet of the main entrance of such building and further provided that the off-site parking is within the same zone district as the premises it is to serve.

E.
Parking spaces shall not be considered as provided, pursuant to this section, unless reasonable precautions are taken to assure that such parking spaces are used only by persons who are at the time residing or employed in or visiting the building or premises for which such parking spaces are provided.
F.
All parking areas, passageways and driveways (except when provided in connection with one- and two-family residential uses) shall be clearly marked for car spaces and adequately surfaced and drained, all subject to approval of the Town/Village Engineer.
G.
Off-street parking areas shall designate spaces for handicapped persons in a number and design to comply with state and federal requirements.
H.
Whenever a use existing on the effective date of this chapter is changed thereafter to a new use, parking facilities shall be provided as required herein for such new use, except that when any such existing use was deficient in required parking spaces on such effective date, such new use may be established if the deficiency in required parking spaces is equal to or less than the preexisting deficiency.
I.
Whenever there is a change in use or an addition in floor area or an increase in the number of employees which would create a need for an increase of more than 10% in the number of off-street parking spaces as determined by the requirements of this section, additional off-street parking spaces shall be provided on the basis of the increased requirements of the new use or on the basis of the increase in floor area or in the number of new employees. However, in those cases where such change creates a need for an increase of fewer than five off-street parking spaces, no additional parking facilities shall be required.
J.
The collective provision of off-street parking areas by two or more commercial or industrial buildings or uses located on adjacent lots shall be permitted, provided that the total of such facilities shall not be less than the sum required of the various buildings or uses computed separately, and further provided that the land upon which the collective facilities are located is owned or leased by one or more of the collective users.
K.
Central business district exception. Any other provisions of this chapter to the contrary notwithstanding, no off-street parking shall be required for any use within the 100 and 200 blocks of West Commercial and Main Streets. However, any such parking voluntarily provided shall comply with the development and maintenance provisions of this chapter.
§ 193-62 Location of facilities.
A.
Off-street parking facilities shall be located as hereinafter specified. Where a distance is specified, such distance shall be the walking distance measured from the nearest point of the parking facility to the nearest public entrance of the building that such facility is required to serve.
(1)
For one- and two-family and multiple-family dwellings: on the same lot with the building they are required to serve.
(2)
For multiple-family dwelling complexes: no more than 200 feet from the building they are required to serve.
(3)
For other uses: no more than 500 feet from the building they are required to serve.
B.
No off-street parking shall be permitted within a required front or side yard area in a residential district, with the exception of parking for residential uses on a driveway serving said residential use.
C.
Parking areas may be located in any yard space for nonresidential uses. Parking areas may abut side and rear yard lines except where the uses served abut residential zones or uses. In such instances, no parking shall be permitted within 10 feet of any property line.
§ 193-63 Screening; shade trees.
A.
Off-street parking areas for more than five vehicles shall be effectively screened on the rear and side yards by a fence of acceptable design, unpierced masonry wall, landscaped berm or compact evergreen hedge. Such fence, wall or hedge shall not be less than six feet in height and shall be maintained in good condition.
B.
Off-street parking areas located in commercial zones and which provide parking for 20 or more vehicles shall be provided with shade trees of a type approved by the Town/Village Engineer and located on the approved site plan as shown.
§ 193-64 Lighting.
All parking areas and appurtenant passageways and driveways serving nonresidential uses shall be illuminated adequately during the hours between sunset and sunrise when the use is in operation. Adequate shielding shall be provided by such uses to protect adjacent residential zones from the glare of such illumination and from that of automobile headlights.
§ 193-65 Required spaces.
A.
Required off-street parking space for specific uses as regulated by this chapter is described in Schedule II which is a part of this chapter.
B.
In cases of mixed uses, the total requirements for off-street parking facilities shall be the sum of the requirements for the various uses computed separately. In the case of a use which is not listed in Schedule II, the requirements for off-street parking facilities shall be determined by the Zoning Board of Appeals.
