Permitted Modifications
§ 193-29 Existing lots of record; lot frontage.
A.
Existing zone lots of record. In any residential district within the Town/Village, a single-family detached dwelling may be erected on a nonconforming zone lot of official record at the effective date of this chapter, irrespective of its area or width, provided that the owner of said lot does not own any adjoining property which would create a conforming lot if all or part of said property were combined with the subject zone lot. Single-family dwellings approved under this section shall comply with all other provisions of this chapter, except that no principal building shall be constructed closer than three feet to any side lot line or 15 feet to the rear lot line. No lot or lots in single ownership shall hereafter be reduced so as to create one or more nonconforming lots.
B.
Lot frontage. The width of any residential lot at the front lot line shall not be less than 30% of the depth of said lot, except that no lot need exceed 100 feet in width at the front lot line.
§ 193-30 Exceptions to height limitations.
A.
The height limitations of this chapter shall not apply to church spires, belfries, cupolas, domes or similar structures not intended for human occupancy.
B.
Chimneys, ventilators, skylights, water tanks, television and radio antennas and similar features and necessary mechanical appurtenances usually carried on and above the roof level may not extend more than 10 feet above the highest point on the roof.
C.
The provisions of this chapter shall not apply to prevent the erection of a parapet wall or cornice or ornament extending above the height limits of this chapter by not more than five feet.
D.
Public and quasi-public buildings, schools, churches and other similar permitted uses may exceed the maximum height specified for the district, provided that the minimum front, side and rear yard setbacks shall be increased by one foot for each one foot of such additional height permitted, up to a maximum height of 40 feet.
§ 193-31 Projections into required yards.
A.
Certain architectural features may project into required yards as follows:
(1)
Cornices, canopies, eaves or other architectural features may project into side yards a distance not to exceed 14 inches.
(2)
Fire escapes shall not be located in the front of any building. Fire escapes may be permitted in a side or rear yard but shall not extend into a required side or rear yard setback area.
(3)
Bay windows, balconies, fireplaces, uncovered stairways and necessary landings and chimneys may project into required rear yards a distance not exceeding three feet, provided that such features do not occupy, in the aggregate, more than 1/3 of the length of the building wall on which they are located. Such architectural features shall not be permitted within three feet of an adjacent side property line.
(4)
Patios may be located in side and rear yards, provided that they are not closer than three feet to an adjacent property line. If located closer than 10 feet to an adjacent property line, the patio shall be screened with a fence maintained in good condition or evergreen hedges or shrubs spaced at intervals of not more than six feet.

B.
No patios or open porches shall be permitted in any required front yard area.
