ACCESSORY STRUCTURES/BUILDING

PROJECTIONS

§ 154.265 ACCESSORY STRUCTURE LOCATION REQUIREMENTS.

   The following provisions shall regulate the location of accessory structures with respect to required yards.
   (A)   Accessory structures shall be prohibited in any front yard, in any recorded or platted easement in side or rear yards and shall be a minimum of five feet from a side or rear lot line if no easements exist.
   (B)   Accessory structures shall be no less than five feet from any lot line, except that additions to accessory structures may be made which have the same yard setback as the original structure.
   (C)   Accessory structures shall not exceed the maximum height restriction for the zone in which they are located.
   (D)   Accessory structures in residential zones shall not exceed the total square footage of the principal structure to which it is accessory. The total square footage shall be an aggregate square footage of all accessory structures on the residential lot.
   (E)   For lots with multiple front yards, accessory structures may be located in the functional rear yard. The Department shall determine which yard area(s) is/are the functional rear yard and the applicable setback requirements.
   (F)   It shall be prohibited to use any manufactured home, mobile home, trailer or motor vehicle as an accessory structure for storage purposes in any zone.
   (G)   Storage containers, associated with a permitted commercial or industrial use shall be screened from any adjacent property and not inhibit fire and other emergency personnel.

§ 154.266 PORCHES, STAIRWAYS AND TERRACES.

   (A)   When open and unenclosed, these types of features may project into a required front, side or rear yard not more than eight feet and provided that such covered porches, stairways, terraces or other similar features conform to the provisions of the zoning regulations. Steps and overhangs shall be measured as part of the projection into the yard (setback).
   (B)   Exception: when adjacent properties have structures with existing porches or other similar projections, the porch may be placed with setbacks similar, but no closer to the property line than the existing structures.

§ 154.267 CHIMNEYS, EAVES, ORNAMENTAL FEATURES AND THE LIKE.

   (A)   Chimneys, flues, belt courses, sills, pilasters, lintels, ornamental features, cornices, eaves, gutters and similar features, may extend not more than 24 inches into any required yard.
   (B)   Notwithstanding any other provisions of the zoning regulations, no projection as listed in division (A) above shall extend into any required side yard more than one-half the width of such yard, not within ten feet of the front lot line, not within five feet of the rear lot line, not within three feet of any accessory structure; provided, however, that such limitations shall not apply to terrace and steps, or to a loading dock or tailboard in connection with an industrial use.

§ 154.268 HANDICAP RAMPS.

   Any ramp or similar feature used to provide accessibility to persons with disabilities is exempt from this regulation and may project into any yard to the extent necessary to provide access to structures in compliance with building or other applicable codes.

§ 154.269 CANOPIES.

   Canopies, as defined in the zoning regulations, shall be a minimum of five feet from any property line but shall not be located within any easement areas.

§ 154.270 TEMPORARY STRUCTURE SETBACKS.

   (A)   The following provisions shall regulate the location of temporary structures unless otherwise regulated in this zoning chapter.
      (1)   Temporary structures may not be placed in any required front yard.
      (2)   Temporary structures may not be placed in any recorded easement area.
      (3)   Temporary structures may not be placed so as to obstruct any ingress/egress from the site and shall not inhibit fire and other emergency personnel.
      (4)   Temporary structures must be a minimum of five feet from any lot line.
      (5)   Temporary structures shall be located in designated areas if located in a shopping center or other planned development. Designated areas to be shown on development plan or master plan.
   (B)   Final location of temporary structures shall be reviewed and approved by the Department prior to issuance of a permit.

§ 154.271 NEIGHBORHOOD STRUCTURES.

   Structures used for neighborhood recycling drop-off bins, composting, cluster mailboxes, neighborhood/subdivision message boards or other similar neighborhood subdivision improvements and any associated enclosure or roof over such structures may be permitted in the front yard and may be subject to other restrictions for accessory structures as outlined in this chapter. The location, design, construction materials and appearance of such structures may be approved by the Department or may be approved by the Commission at the time of preliminary plat approval for new subdivisions. Such structures shall comply with applicable construction codes and other city ordinances.
