ZONING REGULATIONS

§ 154.035 ZONING MAP.

   The city is hereby divided into zones and districts as provided herein and as shown on the zoning map dated July 1, 2008, which together with all explanatory matter thereon, is hereby adopted by reference and declared to be a part of the zoning regulations. The zoning map shall be the official record of zoning status of all land in the city and be kept on file in the office of the Department and shall be known herein as the “zoning map”.

§ 154.036 MAP AMENDMENT IDENTIFICATION.

   Amendments to the zoning map shall be promptly posted by the Department. Each amendment shall be identified on the map by a numerical designation referring to the Commission record of the amendment proceedings.

§ 154.037 INTERPRETATION OF ZONING DISTRICT BOUNDARIES.

   Where uncertainty exists as to the boundaries of zones and districts as shown on the zoning map, the following rules apply.
   (A)   Boundaries indicated as approximately following the centerlines of streets, highways or alleys shall be construed to follow such centerline.
   (B)   Boundaries indicated as approximately following platted lot lines shall be construed as following such lines.
   (C)   Boundaries indicated as following railroad lines shall be construed to follow the centerline of the railroad right-of-way.
   (D)   Boundaries indicated as following shore lines shall be construed to follow such shore lines, and in the event of change in the shore line, shall be construed as moving with the actual shore line.
   (E)   Boundaries indicated as approximately following the centerline of streams, rivers or other bodies of water shall be construed to follow such centerlines.
   (F)   Should a centerline of a street, highway, alley, stream, river or other body of water move, the zoning line shall be construed as moving with the actual centerline.
   (G)   Boundaries indicated as parallel to the above features shall be construed to follow such centerlines.
   (H)   Boundaries indicated as an extension of the above features shall be construed as an extension of such features.
   (I)   Where the zone boundaries in question are a result of a map amendment request, the plat and legal description filed in conjunction with the map amendment request as approved by the City Council shall be deemed the official boundaries of the zone.
   (J)   When the above stated rules do not indicate the exact location of the zone or district boundaries, then said boundaries shall be determined by appeal before the Board as provided by the zoning regulations.

§ 154.038 APPLICATION OF ZONING DISTRICT REGULATIONS.

   The regulations set by the zoning regulations within each zone shall be the minimum or maximum limitations as appropriate to the case and shall apply uniformly to each class or kind of structure or land, except as hereinafter provided.
   (A)   No building, structure or land shall hereinafter be used or occupied, and no building or structure or part thereof, shall hereinafter be erected, constructed, reconstructed, moved or structurally altered except in conformity with all of the regulations herein specified for the zone and district in which it is located unless otherwise specifically permitted in the zoning regulations.
   (B)   No building or structure shall hereinafter be erected or altered:
      (1)   To exceed the height, bulk or floor area ratio;
      (2)   To accommodate or house a greater number of families;
      (3)   To occupy a greater percentage of lot area;
      (4)   To have narrower or smaller rear yards, front yards, side yards or other open spaces, unless specifically authorized or permitted in the zoning regulations; and
      (5)   To have less perimeter and interior lot landscaping for vehicular use area and non-compatible land uses than herein required, or in any other manner contrary to the provisions of these zoning regulations.
   (C)   No part of a yard, open space, off-street parking, loading space or other special use area required about or in conjunction with any building or land for the purpose of complying with the zoning regulations shall be included as a part of a yard, open space, off-street parking, loading space or other special use area similarly required for any other building or land use unless otherwise specifically permitted in the zoning regulations.
   (D)   No yard or lot existing at the time of the adoption of the zoning regulations shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or lots created after the adoption of these zoning regulations shall meet at least the minimum requirements established by the zoning regulations unless specifically permitted.
   (E)   Except as hereinafter permitted, there shall be no more than one principal structure on any lot or parcel of land unless a development plan is approved by the Commission as provided in §§ 154.105 through 154.116.
   (F)   Only those uses specifically named as principal, accessory or conditional uses or substantially similar to principal, accessory or conditional uses are permitted in each zone or district and all uses not specifically permitted or substantially similar to permitted uses are prohibited. Prohibited uses shall include, but not be limited to, those specifically named as prohibited.

§ 154.039 CONVERSION OF DWELLING STRUCTURES.

   The conversion of any structure or structures either residential or non-residential so as to accommodate an increased number of dwelling units or families, or another permitted use, shall be permitted only within the zone in which a new building for similar occupancy would be permitted under the zoning regulations. The resulting occupancy shall comply with all requirements governing new construction in such zone including, but not limited to, floor area, dimension of yards, open space, landscaping and off-street parking. The aforesaid requirements with respect to yards and other open spaces shall not apply if the conversion involves no exterior structural changes to a principal building but shall apply if any accessory building is converted to a principal building.

§ 154.040 AGRICULTURAL LAND USE EXEMPTION.

   Notwithstanding any other provisions of the zoning regulations, land which is used solely for agricultural use as defined herein shall be regulated in conformance with KRS Chapter 100.

§ 154.041 GOVERNMENTAL LAND USE EXEMPTION.

   Notwithstanding any other requirements of KRS Chapter 100, the commonwealth and its political subdivisions shall be exempt from complying with any and all requirements of the zoning regulations.

§ 154.042 ZONING DISTRICTS.

   (A)   Generally. This section divides the city into the districts set forth in Table 154.042-1, Zoning Districts, below. The purpose statements and development type combination, as applicable, are included within each zoning district:

   (B)   The boundaries of each zone are located on the zoning map. All development within these zones shall be planned and constructed in accordance with the requirements of the zoning regulations.
