A portable storage container is any container that is not considered a building or structure under this title and used for the storage or collection of personal property including but not limited to what are commonly referred to as cargo containers or portable on demand storage containers, conveyances/structures constructed for purposes of the transportation of people or goods, including, but not limited to, truck trailers, railroad cars, rail piggy-back container units, travel trailers, mobile or manufactured homes and other similar units, shall not be placed on any lot or parcel of land as an accessory, on-site storage structure ("Container") but shall not include a container used only for the removal of garbage, refuse, and waste under this Code relating to solid waste. 9-15-2: PERMIT REQUIRED:
It shall be unlawful for any person to place or maintain a portable storage container on private or public property (except for use in an Industrial District and commercial use set forth in section 9-15-7) unless a permit for temporary use is obtained in advance pursuant to this section. No permit may be granted for a portable storage container more than eight feet (8') wide or more than twenty feet (20') in length. (Ord. 734, 4-9-2019)
9-15-3: APPLICATION:
An application for a permit shall be made to the Village Office providing such information as the building permit director shall require by rules adopted by the building permit director and approved by the Board of Trustees. A permit issued by the building permit director shall allow the temporary use of a portable storage container for a period not to exceed thirty (30) days. The building permit director shall have the right to grant one extension for an additional thirty (30) day period upon application to and approval by the building permit director of such extension. If an extension is granted an additional permit fee must be paid by the applicant. The building permit director may require insurance or security if the permit provides for placement of the portable storage container on public property. Permits shall be limited to one permit per zoning lot per year and no applicant shall be granted another permit within a period of one year after the application date for a permit granted hereunder. 9-15-4: PERMIT FEE:
A permit fee shall be paid in the amount provided according to the fee schedule on file and available for public inspection in the office of the Village Clerk. (Ord. 734, 4-9-2019)
9-15-5: LOCATION:
No portable storage container shall be placed in any of the following locations:
(A) Within the front yard as defined in this title;
(B) On any parkway or sidewalk; or
(C) In violation of the setback requirements for the side yard or back yard as set forth in this title. (Ord. 734, 4-9-2019)
9-15-6: PLACEMENT, APPEARANCE AND MAINTENANCE OF PORTABLE STORAGE CONTAINERS:
It shall be the responsibility of the person issued the permit to place the portable storage container in the appropriate location granted by the permit, to maintain the portable storage container free of graffiti and to ensure that no spillage of materials or materials escape from the container and litter any property in the Village. No person or entity granted a permit for a portable storage containers shall rent or sublet the container to a third party. (Ord. 734, 4-9-2019)
9-15-7: INDUSTRY DISTRICT AND COMMERCIAL USE:
Notwithstanding anything to the contrary herein, portable storage containers shall be permitted without regard to the regulations stated in this chapter on any property zoned as an Industrial District under this title and the provisions of this chapter regulating portable storage containers shall not apply to property located in an Industrial District as defined in this title. Furthermore, portable storage containers may be used for commercial uses as approved by the Board of Trustees. (Ord. 734, 4-9-2019)
9-15-8: PENALTIES:
Any person violating this chapter shall be subject to a fine in an amount not less than fifty dollars ($50.00) and not more than seven hundred fifty dollars ($750.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. (Ord. 734, 4-9-2019)
