CHAPTER 4

B OUTLYING BUSINESS DISTRICT

9-4-1: SCOPE:

The regulations set forth in this chapter, or set forth elsewhere in this title when referred to in this chapter, are the regulations in the B outlying business district. (Ord. 215, 9-17-1962)

9-4-2: USE REGULATIONS:

A building or premises shall be used only for the following purposes:
Any use permitted in the A residence district.
Bakery whose products are sold at retail on the premises.
Bank.
Barbershop or beauty parlor.
Business or commercial school, or dancing or music academy.
Catering establishment.
Class IV garage, except that the repair or storage portion of such building shall occupy not more than fifty percent (50%) of the total floor area and shall not be less than thirty feet (30') from the front of the building, and no lot or portion thereof shall be used for the display of used cars, except that the display of not to exceed ten (10) used cars on premises used primarily for the sale of new automobiles shall be permitted.
Electric and shoe repair shops.
Filling stations.
Hospitals and clinics for animals, but not open kennels.
Messenger or telegraph service station.
Office.
Painting and decorating shop.
Photograph gallery.
Recreation or amusement building.
Restaurant.
Sales or show room.
Service establishments.
Store for the collection and distribution of laundry and dry cleaning articles, but not for the treatment, cleaning or processing of such articles.
Store or shop for the conduct of a retail business.
Tailor shop.
Theater, except open air drive-in theaters; provided, however, that no theater shall be erected or reconstructed unless there is provided on the same lot, or within three hundred feet (300') thereof, parking space which contains an area adequate to accommodate one automobile for every five (5) seats in the theater.
Tire repair shop.
Undertaking establishment.
Accessory buildings and uses customarily incident to the above uses, including a sign or a bulletin board relating only to services, articles and products offered within the building to which the sign is attached.
Any building used primarily for any of the above enumerated purposes may have not more than forty percent (40%) of the floor area devoted to industry or storage purposes incidental to such primary use; provided, that not more than five (5) employees shall be engaged at any time on the premises in such incidental use. 9-4-3: PARKING REGULATIONS:

The parking regulations for uses permitted in the A residence district shall apply to such uses when located in the B outlying business district.
Whenever a structure is erected or reconstructed for any of the other purposes permitted in this district, there shall be provided parking spaces in the ratio of not less than one parking space for each two hundred (200) square feet of floor space in the building which is used for commercial purposes, and except that any recreation or amusement building or any restaurant or establishment whose primary use is to serve meals, lunches or drinks to patrons, either in their cars or in the building, shall provide parking spaces on the lot in the ratio of not less than one parking space for each one hundred (100) square feet of floor space in the building. Such parking space may be located on the same lot as the building or in an area within three hundred feet (300') of the building. Two (2) or more owners of buildings may join together in providing this parking space, provided that the minimum requirements of this section are maintained. (Ord. 215, 9-17-1962)

9-4-4: HEIGHT REGULATIONS:

No building shall exceed two and one-half (21/2) stories, nor shall it exceed thirty five feet (35') in height, except as otherwise provided. (Ord. 215, 9-17-1962)

9-4-5: AREA REGULATIONS:

   (A)   Front Yard: The front yard regulations are the same as those in the A residence district.
   (B)   Side Yard: The side yard regulations for uses permitted in the A residence district when located in the B outlying business district are the same as those in the A residence district. Where a corner lot is used for any of the commercial purposes permitted in this district the yard on the side of a lot adjacent to the street shall not be less than ten feet (10') in width, except that the building width of the lot shall not be reduced to less than twenty five feet (25'). In all other cases a side yard is not required except on the side of a lot abutting on a dwelling district, in which case there shall be a side yard of not less than five feet (5').
   (C)   Rear Yard: Except as otherwise provided in this code, there shall be a rear yard having a depth of not less than twenty five feet (25'), unless the lot is less than one hundred twenty five feet (125'), in which case the rear yard need not exceed twenty percent (20%) of the depth of such lot. 9-4-6: INTENSITY OF USE:

When a lot is improved with a dwelling the intensity of use regulations shall be the same as those required in the A residence district. When living facilities are erected above stores there shall be a lot area per family of not less than three thousand (3,000) square feet. Where a lot of record contains less than three thousand (3,000) square feet it may contain living facilities for not more than one family. (Ord. 215, 9-17-1962)
