CHAPTER 1139

Temporary Structures

1139.01 PURPOSE.

   For the purposes of promoting the public health, safety, morals, comfort and general welfare; to conserve and protect property and property values; to provide general regulations for structures which are temporary in duration and in conjunction with an existing, permitted use. 1139.02 TYPES OF STRUCTURES.

   (a)   Tents and Other Membrane Structures. A structure, enclosure or shelter, with sidewalls or drops, constructed of fabric or other pliable materials supported by any manner except by air or the contents that it protects. Excludes personal recreation tents.
   (b)   Canopy. A structure, enclosure or shelter, without sidewalls or drops, constructed of fabric or other pliable materials supported by any manner except by air or the contents that it protects. Excludes personal recreation dining fly or pop up tents.
   (c)   Temporary Outdoor Storage Unit. A storage unit or container intended for the purpose of storing or keeping household goods and other personal property to be filled, refilled, and/or emptied while located outdoors on a residential property, and later removed from the property for storage off-site.
   (d)   Construction Trash Receptacles.
   (e)   Portable Toilets.

1139.03 ZONING PERMIT.

   (a)   Permit Required for:
      (1)   Tents
      (2)   Canopy
      (3)   Temporary Outdoor Storage
   (b)   Permit not required for
      (1)   Construction Trash Receptacles
      (2)   Portable Toilets
   (c)   Permit fee of twenty-five dollars ($25.00) shall be required.
   (d)   A plot plan or survey shall be provided at the time of application, depicting the proposed location of the temporary structure.

1139.04 GENERAL REQUIREMENTS.

   All temporary structures must adhere to the following:
   (a)   Must be located five (5) feet from side lot line and rear lot line.
   (b)   Must be ten (10) feet from front lot line.
   (c)   Must be ten (10) feet from any existing or proposed structure.

1139.05 REQUIREMENTS FOR TENTS AND CANOPIES.

   (a)   Must adhere to Ohio Fire Code and Fairport Harbor Fire Rules
   (b)   Must adhere to Ohio Building Code and Lake County Building Rules.
   (c)   Tents and Canopies shall not be electrified unless approved by the Lake County Building Inspector.
   (d)   Tent and canopy cannot be occupied until a zoning compliance certificate has been issued.
   (e)   May only be erected on site for forty-five (45) days. Extensions may be granted, but no unit shall receive more than two 45-day periods (not to exceed a total of ninety (90) days).

1139.06 TEMPORARY OUTDOOR STORAGE UNIT.

   Temporary outdoor storage units, shall be subject to the following restrictions:
   (a)   Not more than two (2) temporary outdoor storage units shall be permitted per address in a calendar year.
   (b)   The maximum size of a temporary outdoor storage unit shall not exceed a dimension of l0'x l0'x 22' .
   (c)   Only one (1) temporary outdoor storage unit shall be stored on a property at any given time, for a period up to thirty (30) days. Extensions may be granted, but no unit shall receive more than two 30-day extensions (not to exceed a total of ninety (90) days).
   (d)   Temporary outdoor storage units are prohibited from being placed within the right-of-way, on the front lawn of a property, or in any temporary road or cul-de-sac easements. Units must be kept in the driveway, or on a paved surface, at the furthest accessible point from the street, or as otherwise approved by the Zoning Inspector.
   (e)   A Temporary Structure Permit shall be obtained from the Zoning Office prior to locating the storage unit on the property. A plot plan or survey shall be provided at the time of application, depicting the proposed location of the unit.

1139.99 PENALTY.

   Any temporary structure found to be in violation of these requirements will be subject to the penalties set forth in this Codified Ordinance.
